TERMS AND DEFINITIONS a. Bareboat Charter: 7-12 people charter BOARDING TIMES The boat will be present and ready to board approximately 15 minutes prior to the scheduled departure time to allow for the inspection of the boat by the Charterer, the loading of provisions, the review of safety instructions from the Captain, and other matters. RESPONSIBILITIES OF CHARTERER The Charterer agrees to be responsible for all passengers on the boat. The Charterer agrees only to have the number of passengers specified in the confirmed booking reservation. DAMAGE TO VESSEL Charterer shall be responsible for and shall replace or pay for any damage to the boat, furnishings, fittings, and equipment, caused in whole or in part by himself/herself or any member of his/her party. This includes the leaving behind of possessions, clogged head systems, and lost halyards and lines. The boat shall be surrendered free of any indebtedness that may have incurred for the account of the Charterer for any reason. If the Vessel is re-delivered by the Charterer, not in the same condition in which it was delivered, the Capital Legacy LLC reserves the right to charge against the Charterer's security deposit the cost for repairs and labor needed to return the Vessel to its original condition. Charterer agrees to pay for any loss or damage not covered by Insurance that can occur on or to the Vessel during the charter. DRUGS Use or possession of any and all illegal or illicit drugs, as may be defined from time to time by government regulations, onboard the boat is strictly prohibited and shall result in the immediate termination of the charter with the forfeit of all monies paid. Furthermore, the Charterer and all members of his party shall be put ashore at the first available port, with any expenses or damages caused by such disembarkment to be borne solely by Charterer and party members. Any prescription medicines must be in the original container obtained from the pharmacy or shall be accompanied by the prescription itself. THIS IS A ZERO TOLERANCE BOAT. ALCOHOL The Captain has the absolute authority to determine, at his sole discretion, that further imbibing may impede the safety or comfort of the passengers, the crew or the boat. Charter Termination Due to Alcohol: The Captain retains the authority to terminate the charter if he deems it unsafe due to the Charterer's and his/her guest's alcohol consumption with the forfeit of all monies paid by Charterer. In this event, the Charterer and all members of his party shall be put ashore at the first available port, with any expenses or damages caused by such dismemberment to be borne solely by Charterer and party members. Notwithstanding his authority, at no time does the Captain or Capital Legacy LLC have any responsibility or duty to determine whether a passenger is under the influence of alcohol or to take any action regarding the use of alcoholic beverages. At no time may Charterer or any member of his party serve any alcoholic beverages to those who are under the legal age. CANCELLATIONS The deposit is non-refundable except under the following circumstances: The Boat becomes unfit for charter; or Capital Legacy LLC agrees in writing that a refund should be made; or Weather forecast on the day of the charter indicates that conditions would prohibit the safe navigation of the boat by the Charterer. CHILDREN Children are welcome onboard; however, the crew cannot take any responsibility to watch over them. Children under the age of fourteen (14) must be under the direct supervision of a parent or guardian at all times. Children under the age of twelve (12) must always wear a USCG approved life jacket (as provided by Capital Legacy LLC). COAST GUARD Charterer is advised that the U.S. Coast Guard has wide latitude to board the boat and conduct various searches pursuant to government rules and regulations. Full and complete cooperation with the Coast Guard is required by the Charterer and his party. FORCE MAJEURE Capital Legacy Group LLC shall not be liable for any loss, damages, or delay or failure in performance hereunder resulting from any force majeure event, including but not limited to acts of God, fire, the action of the elements, epidemics, war (declared or undeclared), warlike actions, insurrection, revolution or civil strife, piracy, civil war or hostile action, strikes or differences with workmen, acts of the public enemy, federal or state laws, rules and regulations of any governmental authorities having or asserting jurisdiction in the premises or of any other group, organization or informal association (whether or not formally recognized as a government), and any other cause beyond the reasonable control of the Capital Legacy LLC which makes the continuance of operations impossible. In the event of a delay or failure of performance-based upon an event described above: All payments made towards the charter shall be used as a credit for a future charter. No refunds will be provided. The Capital Legacy LLC will work with Charterer to book a new charter on new dates based upon availability and the Charterer's preference. If the parties cannot book a new charter at that time, Charterer's deposit will remain as a credit with the GOOD VIBES CHARTER LLC and will never expire. The Capital Legacy LLC will not be responsible for additional costs incurred by Charterer as a result of changes to their charter due to a force majeure event. MISCELLANEOUS a. Governing Laws: Any legal action arising under or in connection with this contract will be adjudicated in the state of Virginia and the counties therein.
