CANCELLATION Final payment and Passenger List are due (7) days prior to the charter date. No refunds are due in the event Client requests to end charter time early or if captain, in his sole discretion, deems it unsafe to continue the charter for any reason and decides to end the charter time early. RIGHT TO CANCEL OR RESCHEDULE Our company reserves the right to cancel or reschedule the charter due to unsafe conditions, USCG required maintenance, or any other reason that jeopardize passenger or crew safety. If our company or captain determines that weather conditions pose a risk to the safety of the vessel or its passengers, the charter may be canceled or modified. In the event of strong winds or rough seas, our team will explore alternative sailing locations that offer more protected waters. This may involve changing the pick-up location, modifying the route, or slightly adjusting the departure time. PASSENGER OBLIGATIONS The Client and their guests are prohibited from bringing or using the following items on board the Vessel. – Drugs, narcotics, or weapons – Cigarettes, cigars, or vape pens – Glass bottles or red wine – Messy and greasy food – Balloons, Styrofoam, feather boas, glitter, or confetti – No heels, dress shoes, or sneakers with black bottom soles Client and their guests are required to comply with all applicable seagoing rules and regulations, as well as all reasonable requests of the captain. Client and their guests are responsible for taking reasonable care of the Vessel and its equipment. Client shall be liable for costs or losses as incurred (or likely to be incurred) from damage caused by the Client or their guests (intentionally or otherwise) to the Vessel or any third party. Client shall be responsible to our company for any loss, damage or injury caused by the willful or negligent acts of themself or their guests. If the Client or any of their guests violate any laws or regulations in any jurisdiction, leading to the Vessel's detention, arrest, seizure, or fining, the Client shall be held responsible for reimbursing our company for all resulting losses, damages, and expenses. Client and their guests must sign Assumption and Acknowledgement of Risks and Release of Liability Agreement prior to boarding Vessel. ITEMS TO BRING ON VESSEL Passengers are permitted and encouraged to bring their own food, beverage, and Spotify playlist. Alcoholic beverages are allowed on the charter boat and may only be consumed by passengers aged 21 or older. Space is limited so please only bring what you need: phone, ID, sunglasses, food, beverage, waterproof bag, and maybe a jacket if you get cold. PHOTO AND VIDEO RELEASE The Client grants our company, including their agents and representatives, the exclusive right to take photographs and videos of the Client and their guests during the charter. The Client agrees that such photographs and videos may be used for any lawful purpose, including but not limited to promotional materials, marketing, or social media. The Client expressly waives any right to review, approve, or receive compensation for the use of such photographs or videos. ARBITRATION Any dispute in connection with the interpretation and fulfillment of this agreement shall be decided by arbitration or a court of competent jurisdiction at the Owner’s option. In the case of Arbitration, Owner shall have the right to appoint a third-party arbitrator (whose appointment shall not be unreasonably objected), whose decision will be final and binding. All reasonable costs of arbitration, enforcement of this agreement, courts, attorneys, etc. shall be borne by the non-prevailing party. The agreement shall be governed by and constructed in accordance with the laws of the State of Florida.
