BOAT RENTAL AGREEMENT & LIABILITY WAIVER Vessel: Chris-Craft Launch 25ft Heritage Edition Location: Dana Point, CA This Boat Rental Agreement and Liability Waiver is made between the Owner ("Owner") and the Renter ("Renter") for the rental of the Chris-Craft Launch 25ft Heritage Edition located in Dana Point, CA. 1. Acknowledgment of Risks The renter understands and acknowledges that boating involves risks, including, but not limited to, personal injury, property damage, or loss resulting from falls, collisions, mechanical failure, weather conditions, or the actions of others. 2. Assumption of Responsibility Renter agrees to operate the boat responsibly and comply with all laws and safety standards. The renter assumes all responsibility for passengers and personal property during the rental period. 3. Damage & Loss The renter is financially responsible for any damage to the boat, equipment, or other property caused during the rental. Any pre-existing damage will be noted before departure. 4. Alcohol & Substance Use Consumption of alcohol is permitted in moderation. No person may operate the boat while under the influence of alcohol or drugs. The Owner reserves the right to terminate the rental if unsafe behavior is observed. 5. Life Jackets & Safety All passengers must wear life jackets when required by law or at the discretion of the Owner or Captain. Children under 13 must wear life jackets at all times. 6. Release of Liability Renter releases and holds harmless the Owner from any claims, injuries, or damages sustained during the rental or use of the vessel, including those caused by negligence. 7. Indemnification Renter agrees to indemnify and defend the Owner against any claims or actions arising from the use or operation of the boat. 8. Cancellations Cancellations must be made at least 48 hours before a full refund. Cancellations due to unsafe weather will be honored at the Owner’s discretion. The Renter agrees to all terms and confirms they can legally operate the vessel or will designate a licensed captain.
