GENERAL CONDITIONS OF BOAT RENTAL WITHOUT SKIPPER  A. LEASED VESSEL Brand: Pacific Craft Sun Cruiser 630 Model Registration 6th 446-27-21 Authorized people: 6 + 1 skipper B. LEASE PERIOD Date: Duration: Half day: Full day: From: Until: C. LEASING COST The rental cost has been previously paid through an online boat rental platform. Before boarding you will have to pay a deposit. Gasoline price is not included. D. PAYMENT METHOD THE LESSEE must also deliver the amount of €2,000,00 as a DEPOSIT by payment at the time of appearing at the boat to hand over the keys and documentation. The amount of this deposit must be paid to the same account indicated above. Before delivery of the boat, the Lessor must have received the entire established price, as well as the corresponding deposit. Payment will be made using the agreed payment method. The deposit will be returned to the LESSEE at the time this contract ends and the condition of the boat has been verified by the LESSOR. THE LESSEE is obliged to return the boat to the LESSOR with a full fuel tank or to pay the difference consumed at the price of €2.50/L. CLAUSES 1. RENTAL PRICE: The rental price includes the use of a fully equipped boat, insurance for the value of the boat greater than the deposit deposited, and personal insurance for the crew members. The costs of provisioning, fuel, moorings outside the base port and crew or other extra services, if applicable, are the responsibility of the Lessee. 2. OBLIGATIONS OF THE LESSEE: a. The Lessee is obliged to navigate solely and exclusively in Spanish territorial waters, at a distance of less than 5 miles measured perpendicular to the coast and at a speed of less than 25 knots, always in favorable weather conditions. To navigate outside the aforementioned waters, prior written consent must be obtained from the Lessor. If the Lessee navigates over prohibited areas or exceeds the speed of 25 knots (3 warnings), the deposit will not be returned. The Lessee agrees not to rent or lend the boat to third parties, not to participate in regattas of any kind (except with the express permission of the Lessor), not to do cabotage or professional fishing, not to give navigation courses or use the boat for any purpose. another lucrative purpose, and to sail only under favorable weather conditions. For any of the aforementioned activities, express permission must be obtained from the Landlord. b. The Lessee must respect the laws of maritime navigation (International Convention to Prevent Collisions at Sea) and must take care of the equipment and inventory of the boat during the rental. The Lessee will be responsible for any possible infractions committed, in accordance with current Spanish laws, even if they are crewing the boat outside the rental period. d. In the event that, for reasons attributable to the Lessee, the skipper or the crew, the boat is delayed in delivery or is detained or sealed by any type of Authority and consequently the Lessee does not return the boat to the Lessor on the scheduled date. In the contract, the following amounts that the Lessee must pay to the Lessor for delay will apply: Base rate without VAT of the established daily cost per day of delay or proportional part. 3. MINIMUM QUALIFICATION REQUIRED: THE LESSEE ensures that he has the knowledge and experience necessary to manage the leased vessel and that he is the holder of the title of RECREATIONAL BOAT SKIPPER (PER) OR EQUIVALENT, duly approved and certified by the Maritime Authorities. 4. DOCUMENTATION: The Lessee will receive all the necessary documentation from the Lessor. It is necessary for him to keep this documentation in a safe place for the duration of the rental. 5. DELIVERY OF THE BOAT: The Lessor is obliged to deliver the boat in good condition, clean and ready to sail, with a full fuel tank. Before signing this rental contract, the Renter must inspect the rented boat, especially the equipment and inventory. Finding any type of failure or damage during the inspection that does not prevent the correct operation of the boat does not entitle the Lessee to reduce the initial price that appeared in the offer. The time of delivery of the vessel is considered to be the moment in which the Lessee receives on land the necessary material to use it. The return time will be the time in which the Lessee returns the boat and contracted material to the same place where it was received from the Lessor. The Lessee must know the operation and assembly of the boat and ensure that it is properly lined before going out on the water. The Lessee will use and take care of the boat received and all its accessories following good seafaring practices and will use all means to ensure that no losses, accidents or breakdowns occur. In particular, the Landlord mentions the importance of the amplitude of the tides and currents in the area, inclement weather, and peculiarities for navigation in the area. 6. BAIL: At the time of signing the documentation and entering the boat, the client must pay a deposit as a deposit that covers any damage, damage due to misuse or collision of the boat that is not covered by the Insurance Policy. The deposit will depend on the vessel and will be established in the Contract. The deposit can be formalized by transfer or in cash. The deposit will be returned once the boat has been inspected after leaving it at the port of destination and if the regulations of this contract are met. The cases for which the amount may not be returned are named in their respective points. 7. CANCELLATIONS: Consult the cancellation conditions of the rental platform. 8. DAMAGES: The Lessee must immediately inform the Lessor in the event of any damage, collision or deterioration of the vessel, regardless of the causes. The Lessee must inform the Lessor immediately of the necessary repair or need for spare parts. Each repair or repair without authorization by the Landlord will be charged directly to the Tenant. Any damage, loss or damage caused by improper use by the Lessee and her crew will be the responsibility of the Lessee. Said damages or defects will be deducted from the deposit and will be returned only if there is Vessel Insurance coverage and in the established amount. 9. RIGHTS OF THE LESSEE: If for any reason, and beyond the Lessee's responsibilities, the boat is out of service, the Lessor will follow the instructions of the boat rental platform. The Lessee agrees not to make any additional claim. 10. TERMINATION OF THE RENTAL: The Lessee must return the boat to the Lessor at the port of final destination, at the agreed time, clean and intact, and with a full fuel tank. The amount of said operation will be charged to the deposit deposited by the Lessee for a price of €2.5 per liter. If the Lessee does not return the boat to the base port at the agreed time, he must compensate the Lessor by paying 50€ for each half hour of delay, along with the possible expenses incurred during his delay to Joaquín Mª Moreno Sánchez, BUENA PROA IBIZA. The delay may be justified only in case of major cause and if the Tenant immediately communicated it to the Landlord. In the event that the boat is returned in poor condition and/or extremely dirty, the Lessor will have the right to deduct the final cleaning and/or arrangements from the deposit. If the boat, for any reason, could not be delivered to the base port, a surcharge of €7/mile would be applied. Falsehood or deception on the part of the Lessor in any of the particular specifications of this contract will result in its immediate cancellation, with the lessee losing the amounts delivered. 11. INSURANCE: The boat, equipment and crew have the following insurance: • All Risk helmet. • Civil Liability to Third Parties and Passengers. All damages and/or losses that must be covered by insurance must be reported to the Lessor or his representative immediately after the breakdown or accident. In the event that the damages are not covered by the Insurance, the Lessee will be responsible for paying them, even if they exceed the deposit. 12. RESPONSIBILITIES OF THE LESSEE: The Lessee is obliged to compensate the Lessor for damages to third parties caused by negligence and that are not covered by insurance, also bearing all expenses, both material and legal. The Lessee assumes full responsibility for his actions, especially in cases of confiscation of the boat for any type of legal violation. In case of loss or breakdown, the Lessee is obliged to write down the facts in detail or request a report of the incident from the Port Authorities, corresponding doctor or responsible person. The Tenant must inform the Landlord about what happened as soon as possible. In the event of loss of the vessel, impossibility of navigation, confiscation of the vessel or prohibition of navigation by the competent authorities, the Lessee will be obliged to inform the responsible persons and the Lessor immediately. If the Lessor observes during the rental period that the boat skipper performs dangerous maneuvers and/or that show his inexperience, that he does not respect the exit and entry channel of boats and navigates in a different area in the area designated for this purpose. and according to current regulations, the Landlord may cancel the rental contract early, without the Landlord having to return any money or benefits. The Lessor may proceed to rescue the rented boat and charge the rescue prices in the event that the boat does not comply with the current navigation regulations or understands that it does not have sufficient expertise when steering the boat or if the vessel has not been returned at the agreed time. In none of these cases will the tenant have the right to a refund of the money paid. 13. LOSSES OF PERSONAL PROPERTY: The LESSOR is not responsible for the loss, destruction and/or damage of personal property deposited or stored on the boat. The signing of this Contract implies the acceptance of these conditions by the Lessee and that there will be no obligation on the part of the Lessor to compensate the Lessee in any of the cases previously described. 14. COMPLAINTS Only written complaints received at the time of return of the boat to the Lessor will be considered. The parties involved agree that any dispute, discrepancy, issue or claim resulting from the execution or interpretation of this contract or related to the rental specified therein, will be resolved in the courts and tribunals of Ibiza. 15. SKIPPER (SKIPPER): If the services of a Skipper are not contracted, the lessee will be obliged to present a current qualification in accordance with the type of vessel leased. If at any time, from the beginning of the contract to its end, the Lessor considers that the Skipper does not meet minimum criteria and requirements for the management of the boat, either due to lack of knowledge or due to his physical/mental state, the contract will be canceled. in advance without refund of the amount paid until the moment of cancellation.
