Espalmador Continuation towards the private island of Espalmador, renowned for its turquoise waters and protected natural environment. Anchorage to enjoy the experience and the most exclusive atmosphere of Formentera. Additional stops & coves During the day, the captain may make different stops and anchorages depending on sea conditions and the group’s preferences, exploring some of the best spots around Ibiza and Formentera. Cruise back to Ibiza Relaxing navigation back to Marina Ibiza Magna while enjoying the coastline views and the Mediterranean sunset. Check-out at 19:00 at Marina Ibiza Magna base port --- Optional Additional Services Professional Chef on Board – €230/day Enjoy an exclusive culinary experience with our private chef, who takes care of everything: healthy breakfast, lunch, and dinner menus prepared with fresh local ingredients, as well as kitchen maintenance. A highly recommended service for a complete luxury experience. APA (Advance Provisioning Allowance) The APA covers provisioning expenses, fuel, and mooring fees during the charter. The captain manages the deposit, tracks all expenditures, and keeps receipts for complete transparency. Guests may review expenses at any time and top up the account if necessary. Any unused funds are refunded at the end of the charter. This system ensures the yacht remains fully supplied with minimal hassle and total transparency. Day Charter Boarding: 11:00 AM Disembarkation: 19:00 PM Return to the same departure point. Recommendation We recommend that all guests arrive 15 minutes before boarding to complete the embarkation process comfortably and ensure the experience starts on time. Check-out at 7:30 PM at Marina Ibiza Magna base port Security deposit 2000€ For certain services a security deposit may be required, which: - Must be provided before embarkation as indicated (cash, card pre-authorization, transfer, etc.) - Will be released within normal banking timeframes after the vessel and accessories are checked - May be withheld in whole or in part for damage, lost equipment, rule breaches or fuel/cleaning conditions other than agreed The amount, procedure and refund or settlement timelines will be communicated before the service. The company will provide reasonable justification for any charges retained, where appropriate. Cancellations and changes Cancellation terms depend on each booking and will be indicated in the contracting process. In general: - Customer-initiated cancellations may entail retention of amounts or penalties depending on proximity of the embarkation date and the policy applicable to that booking - Changes to dates, vessel or services are subject to availability and may involve a price adjustment - Failure to appear at the agreed place and time without prior notice may be treated as cancellation or no-show with the economic consequences provided for Requests must be made through the channels indicated in the confirmation email or on the platform. Percentages, deadlines and exemptions are those shown to the customer before payment, which should be retained for reference. Cancellations by the company The company may cancel or change the service in the event of: - Adverse weather conditions - Technical issues with the vessel - Force majeure In such cases: - Where possible, an alternative date or equivalent vessel will be offered - Amounts paid will be refunded when no reasonable solution exists and this follows from the condition applicable to that booking - The customer will not bear additional costs arising solely from the company's inability to provide the service for company-attributable reasons The company will notify the issue as soon as practicable using the customer's contact details. Unless there is bad faith or gross negligence by the company, no compensation for non-material loss or loss of profit will be due beyond refund or rescheduling as agreed and mandatory law. Weather conditions Safety is the priority. If conditions are unsuitable for navigation: - The decision on departure or continuing navigation lies with the appointed skipper or, failing that, the company - The activity may be moved to another compatible slot - The technical criterion aims to protect people, the vessel and the environment Inability to complete the service due to weather or other safety reasons does not by itself create additional liability for the company beyond what is agreed on changes or refunds, without prejudice to non-waivable consumer rights. Use of the vessel The customer undertakes to: - Use the vessel responsibly - Comply with safety rules - Follow the skipper's instructions (if applicable) The following is prohibited: - Navigating under the influence of alcohol or drugs - Dangerous activities, fishing or water sports not authorized by the company or owner - Carrying more people than authorized or exceeding safe load The customer must respect the inventory and vessel condition on takeover and return. Significant late return, negligent use of equipment or departure from the authorised itinerary may generate charges or deposit retention. Customer liability The customer will be liable for: - Damage caused by misuse - Failure to comply with the rules Additional charges may apply according to market rates or workshop estimates. The customer is jointly liable for the acts of guests or companions. Minors remain under the supervision of the contracting adult, who assumes full responsibility for them. Company liability The company. shall not be liable for: - Loss or forgetting of personal items on board or in port facilities, unless custody is expressly agreed in writing by the company - Incidents caused by serious negligence, rule breaches or intoxication by the customer - Failures, outages or content of external booking platforms (e.g. Booking Manager), without prejudice to rights against that service provider - Indirect loss or loss of profit where lawfully excludable Where a liability cap is lawful, The company's total contractual liability shall not exceed the total price paid for the affected service under the relevant booking, except in cases of intent or gross negligence. Insurance Vessels carry the mandatory insurance required by applicable regulations. However: - They do not cover negligent, unlawful or recklessly imprudent conduct by the customer or companions - Travel or supplementary liability cover is recommended where appropriate Before departure the customer should familiarize themselves with safety equipment and sign or acknowledge the condition report if required. Any incident or breakdown must be reported immediately to the contact person provided. User requirements To rent a vessel: - Meet the minimum legal age for the contract and for operation where applicable - Hold a valid nautical license, permits and experience required for the area and vessel type when renting without skipper - Provide identity documents and, if required, crew details in good time for port or insurance formalities The company may refuse embarkation or handover without compensation if essential requirements are not proven or there is a manifest safety risk. 16. Data protection Personal data will be processed in accordance with applicable law and the Privacy Policy. Data may be shared with: - Technology and payment partners (e.g. Booking Manager) - Insurers, nautical or port partners when essential to the service Data subjects may exercise rights of access, rectification, erasure, restriction, objection and portability (where applicable) by contacting the company at the details in the legal notice, and may lodge a complaint with the supervisory authority. Legal bases (contract, legitimate interest or consent) are described in the applicable privacy policy. Intellectual property Texts, graphics, logos, photographs, videos, structure and compilation of the website are owned by the company or used under license. Reproduction, distribution, transformation or public communication is prohibited without prior written consent, except as allowed by law for private copying or quotation. The «Moana Charter» trademark and other distinctive signs may not be used without express consent. Changes The company may update these terms at any time by publishing the revised version on the website or notifying customers by reasonable means. New bookings are governed by the version in force at contracting time. Confirmed contracts are interpreted under the version accepted in their confirmation unless mandatory law requires otherwise or the parties expressly agree an update. Applicable law and jurisdiction These terms are governed by Spanish law. The parties submit to the courts and tribunals of Madrid, waiving any other venue that may apply, except where mandatory consumer rules provide otherwise. Where the customer acts as a consumer under applicable Spanish law, non-waivable provisions that are more favorable on jurisdiction and governing law shall apply and these terms may not undermine them.
