Acknowledgment and Assumption of Risks: I, the undersigned participant, hereby acknowledge that I have voluntarily chosen to rent and operate an underwater sea scooter from Joshua on GetMyBoat. I am aware that operating an underwater sea scooter involves certain inherent risks and dangers, including but not limited to: Risk of injury or harm due to water-related accidents, collisions, or falls. Risk of injury or harm due to equipment malfunction or failure. Risk of injury or harm due to underwater obstacles or wildlife. Risk of injury or harm due to inadequate training or experience. Risk of injury or harm due to dangerous weather, of which we reserve the right to cancel/reschedule due to bad weather. I understand and accept the risks associated with operating an underwater sea scooter. I acknowledge that Joshua has provided me with proper instructions and safety guidelines for the operation of the sea scooter. Release and Waiver of Liability: In consideration of being allowed to rent and operate the underwater sea scooter, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless Joshua, or agents, from any and all claims, actions, damages, liabilities, or expenses, including attorney's fees, arising out of or in connection with my rental and operation of the underwater sea scooter. I understand that this release and waiver of liability applies to any and all claims, whether caused by negligence or any other act or omission by Joshua, or agents. Indemnification: I agree to indemnify and hold harmless Joshua, or agents from any and all claims, actions, demands, expenses, or liabilities arising out of or in connection with my rental and operation of the underwater sea scooter, including but not limited to injury or damage to third parties or their property. Medical Condition: I hereby certify that I am in good physical and mental health and have no medical conditions that would prevent me from safely operating the underwater sea scooter. I understand that it is my responsibility to inform Joshua of any changes in my medical condition that may affect my ability to operate the sea scooter. I have carefully read and understood the terms and conditions of this waiver form and voluntarily accept these terms as my own free act, through a rental.
