RENTAL CONTRACT - DAY CHARTER (1 DAY) Fountaine Pajot Isla 40 — Ibiza & Formentera Total price: 1,200€ — ALL INCLUSIVE (Captain, fuel, final cleaning and insurance included) 1) Rental price a. The rental price for a day of charter is 1,200€ including VAT, with everything necessary for navigation: professional skipper, fuel for the standard route (Ibiza—Formentera ) and final cleaning. b. The renter must pay 100% of the amount at the time of booking for confirmation . c. The price does not include port fees or moorings outside the base port (unless expressly agreed). 2) Insurance and coverage a. The boat has comprehensive insurance with civil and occupant liability coverage. The policy has a deductible of €3,000. b. By signing the contract, the renter and passengers are subscribed as insured to this policy. 3) Deposit a . For day charter rentals with skipper, an economic deposit of 1500€ is required. b. Any intentional damage, loss or misuse of the equipment may give rise to subsequent economic claims by the landlord. 4) Damage and use of toilets a. A toilet will be set up for use during the day . b. In the event of jams, breaks or blockages caused by improper use of the toilets, the associated expenses will be borne by the tenant . 5) Use of the auxiliary boat The use of the auxiliary boat (dinghy) is limited to the skipper, if necessary . 6) Itinerary, boarding and disembarking a. Boarding will take place at 10:00am and disembarkation at 18:00pm at the agreed port. b. The itinerary will be proposed by the tenant, but may be modified at the discretion of the skipper for reasons of safety, meteorology or sailing times. c. Overnight stays on board day charter rentals are not allowed. d. We recommend using soft travel bags; hard suitcases cannot be stored on board. 7) Failures In the event of a fault that prevents the continued navigation safely, the skipper will take the boat to the nearest port. If the activity cannot be completed, a rescheduling or proportional refund will be offered, at the company's discretion . 8) Pattern and behavior a. The pattern is included and is required. Its schedule is from 10:00 a.m. to 6:00 p.m. b. The renter and passengers must follow the instructions of the skipper at all times and respect the basic rules of coexistence and safety on board. c. Smoking or vaping is prohibited inside the boat. d. More people than those authorized by the navigability certificate (maximum 10 passengers + crew) are not allowed to board. and. The consumption of illegal substances, the use of fishing gear or any conduct that contravenes current legislation or this contract is prohibited . 9) Cancellations - Cancellations more than 60 days in advance: 10% Refund . - Less than 30 days: 20% penalty. - Less than 15 days: 50% penalty. - Less than 5 days before shipment : 100% NON-refundable. COVID-19 special policy: 100% will only be reimbursed in the event of an official border closure, express navigation ban or mandatory quarantine of more than 7 days. 10) Liability The landlord and the employer are not responsible for loss or damage to property, or for personal accidents resulting from negligence other than the service provided. 11) Navigation area Navigation is limited to waters off Ibiza and Formentera, unless expressly authorized . 12) Data protection and use of images a. The data provided will be treated in accordance with current legislation (LOPD and RGPD ). b. By signing the contract, the company is authorized to use images captured on board for promotional purposes, unless otherwise indicated .
