Come, you will find that Falls Lake, Jordan, Harris and Kerr Lake are the perfect setting for your next pontoon boat rental adventure. Your North Carolina adventure is minutes from Durham, Raleigh and several other large cities in North Carolina. This part of North Carolina has Falls Lake (12,400 reservoir), and approximately 20,000 acres of water between 3 of North Carolina’s most important water resources; Harris, Jordan and Kerr Lakes. An ideal area for your family’s water activities, this area offers bodies of water that are spacious, beautiful and equipped with several other fun features like campgrounds for an RV or Motor-home, beaches and hiking trails. Our Big Girl Pontoon is a spacious, powerful boat that hold 10 or more people to entertain. Pack up your cooler, swimsuit, snacks and sunscreen and board our rental pontoon for an unforgettable aquatic party in the sun. Our pontoon boats come equipped with a quality FM/AM player with Bluetooth capability so that you don’t have to leave your favorite tunes on shore, as well as a large bimini top that offers a place to relax in the shade. Prior to the boat leaving the dock, we provide all passengers with a operation and safety lesson – so even if this is your first time operating or being on a boat, you will feel confident and be safe on the water. PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK In consideration of the services Motor-Boatin LLC, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "MB"), I hereby agree to release, indemnify, and discharge MB, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows: 1. I acknowledge that my participation in boating, personal watercraft, jet skiing, wakeboarding, water skiing, fishing, swimming, tubing or other boating activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: slips and falls; collision with fixed or movable objects or other watercraft; boat capsize and entrapment; travel in remote areas; rapidly changing adverse weather and water conditions; water craft are slippery when wet and accidents can occur getting in or out; damage to equipment or personal injury; accidental drowning; forces of nature including extremes of weather, lightning and rapid weather changes, exposure to sun, strong wind, cold, large waves, eddies and whirlpools, tidal conditions, surf and currents; exposure to temperature and weather extremes which could cause cold water shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion,sunburn, dehydration; the negligence of other participants or persons who may be present; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; aggressive and/or poisonous marine life; wrist, arm, shoulder, and/or back injuries; consumption of food or drink; being impaled by a fish hook; improper lifting or carrying; my own physical condition, and the physical exertion associated with this activity. Traveling to and from the pier will raise the possibility of any manner of transportation accidents. Furthermore, MB personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. 2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) and wetsuit bottom (or clothing that provides equivalent protection) while participating in this activity. 3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless MB from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of MB’s equipment or facilities, including any such claims which allege negligent acts or omissions of MB. 4. Should MB or anyone acting on their behalf, be required to incur attorney'sfees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 6. In the event that I file a lawsuit against MB, I agree to do so solely in the state of North Carolina, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against MB on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at MB. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION (Must be completed for participants under the age of 18) In consideration of the following minor(s)______________________________________ (clearly print Minor’s or Minors’ name(s)) being permitted by MB to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless MB from any and all claims which are brought by, or on behalf of Minor(s), and which are in any way connected with such use or participation by Minor(s). Parent or Guardian Signature **SIGNATURE** : **CUSTOMER NAME** **SIGNED DATE** RULES If I am late returning the Boat/Waverunner to the rental dock time; I agree to pay a Late Return Fee at a rate of $25.OO per the first 60 minutes and after that, $15.00 for increments less than and up to 15 minutes. No one under 26 years of age is permitted to rent equipment. Passengers under the age of 5 years old are not allowed on Waverunner To stay at least l00 feet from shore, hazard buoys, shallow or dirty looking water, or trees. (Damage often includes damage to the shell, engine and propeller system). I agree to stay at least 100 feet from boats, jet skis, people and any other objects. Never follow directly behind or close to any vessel or boat. Rental equipment has no right of way. Look left, right, behind, and in front before turning. I agree that we will not cut off other vessels. I will not bring the Boat/Waverunner to any docks. If at a gas dock, use bumpers and have a person holding equipment 6+ inches from dock at all times. Life jackets will be worn by the driver and passenger(s) when operating Waverunner. No more than 3 persons on the Waverunner at any one time. If pulling tubes, only 3 people between the tube riders and Waverunner riders total. Anyone 12 years of age or younger must wear a life jacket at all times on boats. If one person provides all deposits for multiple vessels, then the total combined deposit amount may be held to pay any and all damage costs. Damage charges are $25/inch for scratches, and $250/inch for crack or holes. The marina speed limit is 3 MPH marina speed limit and renter will be responsible to pay all fines, (note the current fine is $300 for speeding). It is very important you do not flip the Waverunner upside down because water can get into the engine. There will be a minimum charge of $500.00 for having to do 4 to 6 oil changes to get the water out of the engine, charging the battery and for wear and tear to the bearings, valves and electrical system. If the PWC is still not running right after water is removed, we will have to bring it to a qualified repair shop to have it repaired. You will be responsible for parts and labor, up to the cost of a new engine. We will hold your deposit until we get the estimate. Operating the Boat/Waverunner in shallow water, less than 4 feet deep (or close to shore), can cause the cooling system to get clogged and cause the engine to overheat. You are liable for damages up to the cost of a new engine. Do not turn steering all the way and hold throttle wide open while driving Boat/Waverunner. This will cause motor to overheat and/or someone could get hurt or fly out/off of the boat/Waverunner. When pulling someone with a rope, like a water skier or tube, you must at all times try to keep the rope tight or it will break or pull handle out of skier’s hands. Renters are liable for replacement cost of ropes, accessories and equipment if returned damaged or broken. Stay with equipment at all times. If engine fails, is not running correctly or equipment is damaged, stay with equipment and wave arms overhead for help. Have help contact the rental office and send a passenger to the rental office with help so we can easily find you. Do not attempt to drive Boat /PWC back, because further damage may be caused and you will be responsible for those damages caused by driving it when it's not running correctly. Do not let anyone tow Waverunner when it has water in it. It will sink. Never shut motor off when the boat is moving. Slow down slowly. Shut off the motor only after the boat has come to a complete stop. No refunds are given. Only credit toward future rentals with the purchase of rental time of equal or greater value. If the cause of a day being shorten is due to renter error, there will be no refund or reschedules. There will be a minimum charge of $500.00 held until the repair has been completed. I will comply with the stated and customary terms and conditions for the use of the rented equipment. The equipment starts each rental with a full tank of fuel. Renter is responsible for their gas usage. The Marina on the lake is an option. We will be happy to fill it up for the Renter at $4.00/gallon.
