For groups up to 46 guests.   Terms & Conditions Day Cruises The following Booking Conditions, together with our General Information available at SailCR.com, form the basis of your contract. All bookings are subject to these booking conditions. The parties to that contract are yourself and B E Cruises LLC Ltda. of Bahia Ballena, Osa, Puntarenas, Costa Rica, who shall accept legal responsibility for the proper performance of this contract as set out below. In these booking conditions, ‘you’ and ‘your’ means all persons named on a booking, and ‘we’, ‘us’ and ‘ourselves’ means B E Cruises LLC Ltda., registered in Costa Rica with the identification number 3-102-810014. Partial or full payment of your cruise constitutes acceptance of the below terms and conditions. These Booking Conditions are subject to change without notice. 1. Pricing Prices of our services on our website are in US Dollars (USD) and are subject to the local Costa Rican taxes of 13%. In our office, you may pay either in cash or with a credit card in US Dollars (USD) or Costa Rican Colones (CRC). Credit Card surcharges from your credit card company may apply, and rates of foreign exchange at the time may vary. 2. Confirmed booking You will receive a booking confirmation via email. 3. Booking date changes In case you want to change your booked date, we will try to accommodate your wishes. However, this depends on availability, and we cannot guarantee to be able to change your booking. 4. Booking name changes Name changes are permitted free of charge at any time. 4. Cancellations & no-shows For cancellations received, the following cancellation policies will apply: A deposit of 30% will be retained if the trip is canceled 14 days or less prior to departure. For cancellations due to Government restrictions, B E Cruises LLC Ltda. will be offering 100% credit on payments made. Credit will be valid for 365 days from your original booking date and to be used towards a shared cruise at a later date. No refunds for no-shows or if you miss the boat. It remains the client's responsibility to ensure they are at the designated marina on time. 6. Wet weather Cruises will go out in wet weather. No refunds/transfers for cancellations due to poor weather unless B E Cruises LLC Ltda. is forced to cancel for safety reasons. 7. Delays B E Cruises LLC Ltda. prides itself on offering timely service. In case of unexpected delays due to mechanical, operational reasons, or otherwise unforeseen circumstances, B E Cruises LLC Ltda. holds no liability. 8. Damages All breakages & damages must be paid for. 9. Optional upgrades Optional upgrades, including meals and bar packages or any other upgrades that are not otherwise included in a cruise package, must be booked and paid in advance and are subject to availability. 10. Injury To the extent permitted by law, the Company, employees, and agents shall not be liable for any claims, losses, damages, injuries, costs, and expenses suffered, sustained, or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with the cruise. The Passenger releases the B E Cruises LLC Ltda. for any claim whatsoever and howsoever incurred, including but not limited to a claim for death, bodily injury damage, or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst on board the vessel itself unless caused by willful misconduct or reckless disregard of the Company. Whilst B E Cruises LLC Ltda. ensures a safe environment for all guests traveling on board our ship, we accept no liability for any injury or claim caused by the passenger's own negligence, including, but not limited to, tripping, falling, or any other accident that could be avoided by taking due care and caution of one’s surroundings. Equally, should any guest choose to disregard on-board safety rules and regulations or advice from our crew on board, then B E Cruises LLC Ltda. shall be free from liability for any claim or injury incurred as a result. Due to the sometimes unpredictable movements of the vessel(s), sensible/ flat footwear is highly recommended whilst on board.
