Additional Terms and Conditions In case of bad weather or unsafe conditions, guests will receive a 100% refund if the tour cannot be rescheduled to another available date and time. Extract of the Contract Art. 1. Obligations of the Lessor • Deliver the vessel in good maintenance condition. • Insure the vessel against usual risks. Art. 2. Obligations of the Customer • Comply with the onboard regulations. • Follow the Captain's instructions regarding the safety of participants and the vessel. Art. 3. Termination of the Contract • The contract can be terminated by either party with a 2-day notice. • In case of termination by the Customer, the deposit will not be refunded. • In case of termination by the Owner, the deposit will be refunded. Art. 4. Rental Conditions • The Customer is entitled to a refund of the advance payment ("Deposit") made at the time of booking only if the cancellation is communicated at least 72 hours before the start of the rental. • If the Customer cancels at least 24 hours before the start of the rental, the Lessor may retain half of the Deposit as compensation. • If the Customer does not show up at the embarkation location on the booked date and time, a penalty equal to the cost of the booked rental service must be paid to the Lessor. • In case of delay communicated by the Customer to the Lessor at least 30 minutes before the scheduled start time, the Lessor will keep the vessel available to the Customer until the end of the scheduled rental time without price changes. The total rental duration cannot be guaranteed due to subsequent bookings. • The Customer is not entitled to any refund in case of early return of the vessel, except in case of severe weather, where the Customer will be entitled to a refund of 50% of the price for the unused rental period. • If severe weather prevents the start of the rental, the Customer who shows up at the Lessor's location at the scheduled time will be entitled to a refund of the Deposit, unless they prefer to make a new booking, which the Lessor confirms. • The Lessor will require a security deposit ("Security Deposit") to cover any damages caused by the Customer or the members of the group represented by the Customer. Art. 5. Counting of Stopping Time for Temporary Disembarkation • In case of stops, whether scheduled or requested by the Customer, that involve temporary disembarkation for visits or lunch/dinner on land, the time spent is counted as normal navigation time. Art. 6. Speed, Routes, Stops, Moorings, Swimming • The speed and navigation routes are determined by the Captain based on Authority regulations, nautical traffic, weather conditions, and sea state. • Stops, moorings, disembarkations, and the possibility of swimming in the lake will be determined by the Captain based on regulations, nautical traffic, weather conditions, and sea state. The Customer agrees to follow the given instructions. • The Captain and Como Blue Lake are fully relieved of any responsibility for what happens to passengers during boarding, disembarking, land visits, and swimming in the lake, which remain the sole responsibility of the individual. Art. 7. Children and Minors on Board • The Lessor must be informed in advance if children or minors are part of the group. • Children and minors must be constantly supervised by their responsible guardians. The Captain and Como Blue Lake are fully relieved of any responsibility in case of lack of supervision of children and minors. The Captain may require children and minors to wear life vests for the entire time spent on board. The availability of appropriately sized life vests for children may be limited, so the Customer must coordinate with the Captain and, if necessary, provide them in advance before boarding. Art. 8. Swimming Ability • It is the Customer's responsibility to report any passengers who cannot swim, who may be required to wear a life vest for the entire time spent on board. Art. 9. Footwear • For hygiene and safety reasons, Como Blue Lake requires that no footwear be worn on board. • Please ensure that any socks worn do not increase the risk of slipping on wet surfaces of the vessel. • Religious reasons may constitute an exception to this rule. In such cases, Como Blue Lake will try to offer shoes or overshoes to be worn. Art. 10. Pets • For hygiene and safety reasons, animals are not allowed on board. Art. 11. Loss or Damage of Customer's Property • The Captain and Como Blue Lake are fully relieved of any responsibility for the loss, theft, or damage of any Customer's property (bags, wallets and their contents, watches, jewelry, phones and smartphones, computers and tablets, glasses, clothing, etc.) during any phase of the rental, including boarding and disembarking. Art. 12. Prohibitions It is strictly forbidden on board: o To smoke cigarettes, pipes, cigars due to the fire hazard posed by fuel presence and to avoid damage to passengers, the vessel, and onboard accessories. Electronic cigarettes are allowed in open areas. o To use drugs. o To bring and consume alcoholic beverages on one's own. o To bring and consume food and beverages without prior agreement with the Captain. Art. 13. Seasickness • In case of known or suspected intolerance to the vessel's rolling, the Customer is required to equip themselves with appropriate pharmacological or mechanical remedies (bracelets). • Como Blue Lake cannot provide any medication or product to mitigate the symptoms. Art. 14. Passengers' Health Conditions • The Captain reserves the right not to allow passengers on board who exhibit: o Poor health conditions that could compromise the passenger's safety during navigation or in boarding and disembarking operations. o Drunkenness or altered state due to, for example, drug use. Art. 15. Privacy and personal data treatment • The personal data communicated to the Lessor will be processed as provided by the Privacy Law art. 13 of Legislative Decree 196/2003 and GDPR, will not be disclosed to third parties, and can be rectified, updated, or deleted by sending a written communication. The data communicated to the Lessor will be used for the conclusion or execution of rental contracts and any related contracts, for the management of payment(s), and for accounting/administrative purposes related to the establishment and conduct of this contractual relationship. Such data may also be used to send any communications after the contract resolution or for judicial or extrajudicial purposes. Publishing on social media of photo and video taken during the boat tour with verbal consent by the Customer or digitally shared by the customer during or after the boat tour will be regulated by the consent expressed by the Customer in the proper section of this form. Jurisdiction and Contract Modifications • Any modification to this contract must be made in writing with the agreement of both parties. • In case of disputes, the competent court will be in Como.
