Naples Sea Experience - The Gulf of Naples, by Catamaran

1. Who we are The website naplesseaexperience.com and the "Naples Sea Experience" brand are owned and operated by RENTANA S.R.L., registered office in Via Antiniana 59/L, 80078 Pozzuoli (NA), Italy — VAT no. IT09510711212, REA NA-1037445, PEC info@pec.rentana.it (the "Operator", "we", "us"). Rentana S.R.L. is the merchant of record for all payments made in connection with services booked through this website. 2. Our services We organise private catamaran experiences and charters in the Gulf of Naples and surrounding areas (including Capri, Ischia, Procida, the Sorrento and Amalfi coasts) aboard the catamaran Bali 4.3 "RAF IV". Each experience is tailor-made: itinerary, duration, number of guests and optional extras (such as food and beverages) are agreed individually with each customer through a written quote. 3. Quotes and booking process - You submit a request through the website form, by email or by messaging, indicating date, number of guests, preferred experience and any extras. - We reply with a written quote stating the itinerary, duration, included services and the total price in euro, inclusive of VAT where applicable. - The quote is valid for the period stated in it (or, if not stated, 7 days) and is subject to availability until confirmed. - To confirm the booking, you pay a deposit equal to 15% of the total price through the secure payment link we send you. The booking is confirmed only upon receipt of the deposit. 4. Prices and payment terms Summary: 15% deposit at confirmation (non-refundable, except where we cancel — see section 6) · balance due on the day of the experience, on board or via payment link the same day. - All prices are expressed in euro (€) and include VAT where applicable. The prices shown on the website are indicative starting points; the binding price is the one stated in your quote. - Deposit: 15% of the total price, payable via secure payment link at the time of confirmation. Payments are processed by MultiSafepay B.V., a licensed payment service provider. We accept major debit and credit cards and the digital wallets shown at checkout. - Balance (85%): due on the day of the experience, at your choice: (a) on board, by card or cash, before or at the end of the excursion; or (b) via a payment link sent to you on the same day. The experience is considered fully paid only upon receipt of the balance. - We do not store your card details; payment data are handled exclusively by the payment service provider. 5. Cancellation by the customer — deposit policy - The 15% deposit is non-refundable. It compensates the reservation of the catamaran, skipper and date, which are blocked exclusively for you. - If you cancel at any time before the experience, or in case of no-show, the deposit is retained. No balance will be due. - You may request to reschedule the experience to another date at least 7 days before the original date; rescheduling is subject to availability and is granted at our reasonable discretion. In case of rescheduling, the deposit is transferred to the new date. 6. Cancellation by the Operator — weather guarantee - Sea conditions come first. If we cancel the experience for weather, safety or technical reasons, you choose between: (a) a full refund of the deposit, processed to the original payment method within 14 days; or (b) a free rebooking to another available date. - The decision to sail rests solely with the skipper, whose judgement on safety matters is final. A change of itinerary imposed by weather or port authority orders (e.g. rerouting from the Amalfi Coast to the gulf) does not constitute cancellation; where the alternative itinerary has a lower price, the difference will be refunded or deducted from the balance. 7. Right of withdrawal — statutory exclusion Pursuant to art. 59(1)(n) of the Italian Consumer Code (Legislative Decree 206/2005) and art. 16(l) of Directive 2011/83/EU, the right of withdrawal for distance contracts does not apply to leisure services to be provided on a specific date or within a specific period. By confirming the booking you acknowledge this exclusion. The cancellation terms in sections 5 and 6 apply instead. 8. Your obligations on board - Follow the skipper's instructions at all times; the skipper may terminate the excursion without refund in case of dangerous, unlawful or abusive behaviour. - Arrive at the agreed boarding point on time. Delays exceeding 30 minutes may reduce the duration of the experience without price reduction. - Communicate in advance any relevant health conditions, reduced mobility or the presence of minors. Minors must be accompanied by an adult. - The number of guests may not exceed the boat's certified capacity. 9. Liability and insurance - The catamaran is covered by third-party liability insurance as required by Italian law. - We are liable for the services we provide within the limits of applicable law. We are not liable for events of force majeure, acts of third parties, or damage caused by the customer's failure to follow instructions. - Personal belongings are brought on board at the customer's own risk. 10. Complaints, governing law and jurisdiction - Complaints may be addressed to info@naplesseaexperience.com or by PEC to info@pec.rentana.it. We reply within 15 days. - These terms are governed by Italian law. For consumers resident in the EU, mandatory consumer protection rules of the country of residence remain unaffected; the competent court is the consumer's court of residence where required by law, otherwise the Court of Naples. - EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
