Cancellation In the event of cancellation by the Customer for any reason, it is obliged to notify in writing and shall be charged for the modification as follows: • Up to 50% of the total charge if canceled up to 30 days before the chartering date. • Up to 100% of the total charge if cancellation is less than 30 days before the chartering date begins. • Up to 0% of total charge if we NEPA manages to find another customer for the canceled period. If the cancellation of the Customer is due to Force Majeure or any objective reason (serious damage to the vessel during previous reservations), the Customer shall be compensated by: • a boat with the same or similar characteristics and equipment without delay or 100% of all money paid for it. • In the event of damage or loss of any parts of the boat during chartering that are not necessary for the safety of navigation, the Customer is not entitled to any cancellation of the charter or to request a reduction of the charge. Deposition and Insurance A) Deposit *Prior to the delivery of the vessel, the Customer is expected to pay in Euro. Upon completion of the voyage, the amount of the guarantee shall be refunded in full, unless damage to the yacht or damage to or loss of any item of boat equipment. Otherwise, the advance shall be maintained at the corresponding value of the repair or purchase value of the equipment that has been damaged or lost. If a master is hired by our company, the client will have to pay the security. In this case, the guarantee paid may not be used to cover any losses due to the captain’s negligence and poor navigation of the vessel and equipment. B) If the customer wishes to cross the Greek territorial waters, he/she must inform us as soon as possible in order to arrange additional insurance. The customer is charged for such expenses and expenses. C) Damage and serious damage *If during the chartering damage has been caused due to normal wear and tear, the Customer shall be entitled and obliged to provide any repair up to EUR 250.00, which shall be refunded to the Customer upon returning the vessel to the base. If the damage cannot be repaired and requires the ship to return to base, a timely return of the boat will be organized to enable the vessel to be repaired and prepared in time for the next charter. The Customer is entitled to a refund proportional to the number of days lost if the ship is damaged due to our error. In the event of serious damage to the sea, loss of boat, personal injury, the customer shall inform the our company accordingly and strictly follow the instructions of its representatives. The unreported loss is considered to have been caused entirely by the customer and is therefore due and payable by the customer. Shipping Procedure (Check In) Boat delivery takes place on Saturday at 17:00. The boat must be delivered with full fuel and water tanks and is expected to be returned to the same condition as the first delivery. During the delivery process the customer will have to inspect the list with our representative and confirm the signature of the vessel. The same procedure applies to devices on board. Any subsequent complaints will not be accepted, provided that the good working condition and full equipment of the vessel have been established and signed during the delivery process. Any possible defects on board that the our technicians could not expect prevent the customer from claiming a reduction in freight rates. We may ask the Customer to prove its ability to sail the vessel. The relevant costs are borne by the Customer and the test time is included in the charter period of the vessel. If, after the verification process, the our company is of the opinion that the customer is not capable or cannot be responsible for the vessel, an official commander will be hired and the customer will be charged for his services according to the price list. Should the customer refuse to accept the designated master, he is forbidden to leave the port and the agreement is terminated and the paid freight charge is kept without compensation. Vessel Control The boat will be delivered at 9am on Saturday at the latest. Fuel tanks must also be checked at the time of board inspection. If the fuel tank is not full, the Customer will be charged for the missing fuel to fill the tank and for damage to the sum of the warranty, if found during the yacht inspection. Otherwise, the guarantee is returned to the customer. If the vessel is not returned to the agreed port of destination, the client shall pay all costs incurred in transporting the vessel to the designated port of destination and the penalty imposed for any delay that may have occurred. Any delayed delivery of the vessel due to weather conditions is not recognized as it is necessary to keep the vessel during the last 24 hours of the charter period sufficiently distant from the base of the vessel. Any delay beyond 1 hour is charged at twice the daily charge and at any cost resulting from the failure to deliver the vessel on time to the following customer. Customer Responsibility The Customer must: • be able to sail the boat (Otherwise required to accept master). • have all original navigation permits. • not deliver the yacht to a third party. • not carry persons or goods for commercial purposes. • not accept more passengers on board than specified in the crew list. • The Client (Leaseholder) guarantees that he / she is jointly responsible for all crew members. • The customer maintains the crew list and charter during the charter period. • notify us of any changes in the number of crew members or passengers made during the charter period. • comply with the law of the host country. not participate in races without the prior written consent of our company. • Do not navigate the yacht from a human being under the influence of alcohol or drugs. • The customer immediately informs the our dealers according to their instructions in case of damage to the sea or serious damage. • The customer follows the mandatory times of the yacht’s engine during the charter period. • The customer receives the rescue fee before accepting assistance if a yacht tow service is required. • take all precautionary measures to keep the yacht in the same condition as the first delivery. • not leave the port if the expected wind energy is greater than 25 knots or the port authorities have already banned the exit from the port. • not sail at night without the prior written consent of our company. • in the event of adverse weather conditions, inform our representative of the exact location in order to obtain the necessary assistance or to avoid unnecessary and expensive pleasure boat search operations. • not engage in fishing and underwater activities without valid licenses. • Depending on the weather, avoid unnecessary stress on tissues, sails and ropes. • Do not board pets (dogs, cats, birds, etc.) without our company’s prior written consent. • Empty sewage tanks in the high seas, ie at a minimum distance of 1 NM from the nearest land. Our Responsibility We are required to deliver the vessel in good working order, clean and complete with fuel and water tanks. In the event of failure to deliver the yacht within the prescribed time, the Customer is entitled to claim refund for the maximum delay of 24 hours, equivalent to one charter day, but in the event of any delay exceeding 24 hours, sail equivalent or similar. features will be delivered to the Customer. We shall not be liable for any delay caused by force majeure or adverse weather conditions.
