The charterer becomes the owner for most legal purposes, such as the vessel's seaworthiness. 2. Charterer assumes total liability for the vessel's operation.    3. Charterer must provide a qualified Captain/Crew. We provide you with a choice of Captains and you must select one:          A. Choice 1: Patricia Bockh.                    D. Choice 6: Norm Russick 4. Charterer is responsibility for pollution cleanup, and any other liability normally flowing to a vessel owner. 5. Charterer shall be solely responsible for loss, detention, or damage to vessel during the term of charter, or resulting therefrom, whether such loss, detention or damage be latent or patent defects of condition(s). 6. You have complete control over the Captain and the Crew, except as to the safe navigation and safety of the vessel. 7. You are contracting to pay for all the fuel used, as determined by the fuel use gauge on the boat at the rate of           $ _________ per gallon used. 8. Charterer agrees that all pictures taken by the crew will be allowed to be used for publicity purposes without any additional commitments, restrictions, or fees. 9. PAYMENT NOTES. - CANCELLATIONS. If you cancel for any reason up to 7 days before the charter start date, we will refund your payments minus a 10% charge. If you cancel for any reason except as stated in 9.b. within 7 days of the charter start date, there is no refund. If the CHARTERER does not show up for the charter start time within an hour after the start time, there will be no refund and it will be considered as a late cancellation. - REFUNDS. a) Weather. Full refund or we agree on a new date for the charter. Weather cancellation is only at the discretion of the captain. b) If the charter is cancelled by the OWNER, full refund. c) Medical or similar. Death in a close family, or a major unpredictable medical issue is a full refund, after evidence to the facts is received.        The Captain/Crew shall perform assigned duties on the vessel as a crew member in a timely, neat, first class, good and workmanlike manner, in strict compliance with the laws of the United States of America and in accordance with all rules and regulations that may be applicable to this agreement and the performance of said duties. The Captain will have the final decision on the safe operation of vessel. The Captain/Crew has the power and responsibility to report any illegal drugs or drug use on board to the proper authorities and make arrangements for the vessel to be met at a dock. Said crew also has the right to terminate the charter at any time for improper, abusive or dangerous behavior on board, without any refunds.   For and In consideration of the agreement herein, Charterer agrees to pay and OWNER agrees to accept as payment in full of the contract the sum of $ ______/hr payable in advance or as agreed upon in advance. Name: Patricia Bockh Title: Manager                              Signature: _________________________________________   SNORKELING AND RIDER ASSUMPTION OF RISK AND COMPLETE RELEASE OF LIABILITY   I UNDERSTAND THE PURPOSE OF SIGNING THIS DOCUMENT IS TO EXEMPT AND RELEASE Mat Bockh, THEIR OWNERS, EMPLOYEES, AGENTS, AND ASSOCIATED PERSONNEL, AND THEIR BOAT(S) AND/OR EQUIPMENT (WHETHER OWNED, OPERATED, LEASED OR CHARTERED), HEREINAFTER REFERRED TO AS “RELEASED PARTIES”, AND TO HOLD THESE ENTITIES HARMLESS FROM ANY AND ALL LIABILITIES ARISING AS A CONSEQUENCE OF THE FOLLOWING, OR ANY OTHER ACTS OR OMISSIONS ON THEIR PART, INCLUDING BUT NOT LIMITED TO NEGLIGENCE OF ANY TYPE. - I UNDERSTAND THERE ARE INHERENT RISKS INVOLVED WITH SWIMMING, SNORKELING, DIVING, BOATING, WATERSPORTS AND OTHER AQUATIC-BASED ACTIVITIES included but not limited to equipment failure, perils of the sea, action of the sea, wind, waves and boat wake, harm caused by marine creatures (including bites and/or attacks), acts of fellow participants or guests, entering and exiting the water, transferring between boats, aquatic-based activities, boarding or disembarking boats, and activities on the docks and approaches and I HEREBY ASSUME SUCH RISKS. - I UNDERSTAND I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.- I assert I am physically fit to swim, snorkel and participate in aquatic-based activities and ride on a boat and/or equipment and I will not hold the RELEASED PARTIES responsible if I am injured as a result of ANY problems (medical, accidental, or otherwise) which occur while swimming, snorkeling, riding on the boat or equipment, or otherwise participating in the trip or activities. - If I become distressed during the trip or whilst otherwise participating in activities, I will immediately notify the crew and ask for assistance.- I fully understand the involved boat and/or equipment has limited medical facilities and in the event of illness or injury appropriate medical care must be summoned by radio or telephone and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions. - The RELEASED PARTIES have made no representation to me implied or otherwise they or their crew can or will perform safe rescues or render first aid. If I show signs of distress or call for aid, I would like assistance and will not hold the RELEASED PARTIES, their crew, boats, equipment or passengers responsible for their actions in attempting the performance or rescue or first aid. - IT IS MY INTENTION BY THIS INSTRUMENT TO GIVE UP MY RIGHT TO SUE ALL PERSONS OR ENTITIES REFERRED TO HEREIN, WHETHER SPECIFICALLY NAMED OR NOT, AND IT IS ALSO MY INTENTION TO EXEMPT AND RELEASE ALL RELEASED PARTIES AND TO HOLD THESE ENTITIES HARMLESS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE AND I ASSUME ALL RISK IN CONNECTION WITH SWIMMING, SNORKELING, BOATING AND AQUATIC ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE MAINTENANCE OF THE EQUIPMENT OR ORGANIZATION OF THIS ACTIVITY. - I have carefully read this contract in its entirety, fully understand its contents, and agree to the terms and conditions of this contract on behalf of myself, my heirs, and my personal representatives. There are NO WARRANTIES expressed or implied, which extend beyond the description of the activity listed on this form.
