In the event of WITHDRAWAL by the RENTER, due to reasons of force majeure or other strictly personal, unforeseeable, unpostponable reasons (e.g. health problems), the Renter will immediately notify the RENTER and will, where possible, propose an alternative to the Customers such as to do not change, or keep the change to a minimum, the means of transport used to reach embarkation (and leave upon disembarkation) - The cruise program may vary daily at the Skipper's discretion based on weather conditions or other navigation or mooring needs. We will not be in any way responsible for program changes, stops, waste of time and/or interruptions resulting from initiatives or decisions taken by the Skipper to protect navigation safety, in particular due to unfavorable weather conditions or other objective reasons. - If due to factors not dependent on the Skipper's will (for example unfavorable weather conditions) the scheduled embarkation and disembarkation ports are unreachable or impracticable, the Skipper himself will be able to decide on the most appropriate alternatives and will communicate this to time for guests on board. No damage or compensation can be requested for any such unforeseen events and consequent inconveniences. - The Company undertakes to make the vessel available to Guests in perfect clean and efficient conditions, in compliance with current regulations and complete with all the safety equipment required for the type of navigation that will be carried out. - In the event of unexpected breakdowns or breakdowns that require a stop for repairs, the Renter undertakes to make this period as short as possible. If the period does not exceed 48 continuous hours, the Customer will not be able to request any refund. Otherwise, the Renter will reimburse each day not used beyond the aforementioned 48 continuous hours, or, where possible, may grant an extension to the expiry of the contract equal to the period of non-use (beyond the 48 hours of downtime). - The Company will not be liable for failures or delays in the execution of the Service, nor for direct or indirect damages that may arise to the Customer, if such failures, delays or damages are caused by force majeure events or unforeseeable circumstances, such as, by way of example and not limited to: natural disasters, adverse weather conditions as defined in art. 3, strikes, provisions of public authorities, accidents or other unforeseeable and extraordinary events that prevent or make objectively dangerous the execution of the Service. - The Company declares to have subscribed to the insurance required by law. - The Customer embarks with full awareness of the risks and dangers that a boat cruise may entail. In the event of an accident not resulting from the responsibility or fault of the Skipper, he will not be able to claim compensation or request compensation either from the Skipper or from The Company. The Customer is recommended to obtain personal accident insurance. - The Guest is committed to informing the Skipper, before boarding, on a strictly personal basis, of any health problems, allergies to drugs or foods or other specific personal needs or particular requirements. - If the Guest is unable to swim or has other personal impediments, he undertakes to inform the Skipper and to accept any precaution that the Skipper decides to implement to protect the safety and security of the Guest. - The Guest declares to have been informed and to be well aware of the characteristics of the Cruise, those of the vessel and the related conditions and living spaces and the number of people who may be on board the same cruise. - The Skipper has the right, for the protection of cruise passengers and for the safety of the trip, to disembark anyone who behaves incorrectly, not in keeping with the orderly running of the cruise or a peaceful and disciplined coexistence, causes damage or harassment to other Guests or, in any way, endangers their safety and tranquility. - The baggage brought on board must be limited and essential, contained in SMALL BULKY, SOFT, FULLY FOLDABLE BAGS such as to allow it to be stowed. - Each Participant is the exclusive custodian of their personal objects and effects and is personally liable in the event of theft, loss or damage. He is also responsible for damage caused to the vessel by malicious, negligent behavior or behavior in conflict with the provisions and instructions given by the Skipper. - For everything not regulated by this document, reference is made to the applicable Italian laws. - Privacy: the data provided under this contract will be stored and processed by The Company (as data controller) exclusively for contractual and accounting purposes, in full compliance with EU Regulation 679/2016 and Legislative Decree no.. 196/2003, as amended by Legislative Decree 101/2018. The signing of this contract constitutes consent on the part of the Renter, also in the name and on behalf of the Guests, pursuant to art. 26 of the aforementioned Legislative Decree, to the aforementioned data processing, declaring that they have been fully informed of their rights pursuant to the aforementioned privacy regulations. - This document governs the terms and conditions according to which the Customer, when renting one of the boats of The Company, gives his consent to the shooting, use and publication of images and videos that portray him, in compliance with the regulations in force regarding the protection of personal data and the right to image. - Consent to the use of the image: by signing the rental contract, the Customer expressly authorizes The Company, as well as any of its representatives or collaborators, to take photographs and/or video recordings during the performance of the activity on board the boat. - Purpose of publication: The Customer agrees that the aforementioned images and videos may be used by The Company for promotional and commercial purposes, through publication: on the official website of the company; on social platforms and profiles (including, for example, Instagram, Facebook, TikTok); on digital or paper advertising materials; in presentations and other corporate communication tools. - Nature of consent: The consent is given free of charge, is unlimited in time and without geographical restrictions. The Customer waives any economic claim in relation to the use of images and videos, and declares that he has no claim whatsoever from The Company and from the subjects authorized by it to use the contents. - Exclusion of the obligation to publish: The Company reserves the right not to publish the materials collected, in whole or in part, according to its own editorial or marketing assessments. - Processing of personal data: The processing of images and videos will take place in full compliance with Regulation (EU) 2016/679 (GDPR) and the current Italian legislation on privacy.
