BAREBOAT CHARTER & OVERNIGHT LEASE AGREEMENT Clearwater Marina – Clearwater, Florida This Agreement is established between the Vessel Owner and the Charterer in accordance with U.S. Coast Guard (USCG) regulations, Federal Maritime Law, and the laws of the State of Florida. 1. Nature of the Charter (Demise Charter) This is a bona fide Bareboat Charter. The Charterer acknowledges: - Command & Control: You assume full possession and operational control of the vessel for the duration of the term. - Captain Selection: For navigated trips, you may select a captain from our pre-approved list. The captain is an independent contractor paid directly by you and is not an employee of the Vessel Owner. - Stationary Stays: For "Boat B&B" bookings, the vessel serves as floating accommodation and must remain moored at its designated slip unless a licensed Captain is engaged for transit. 2. Charter Term & Arrival - Day Charters: Times are strictly as confirmed in your booking. Please arrive 15 minutes early for safety briefings. Arrivals more than 30 minutes late may result in cancellation without refund. - Overnight Stays: Check-in is at 4:00 PM; Check-out is at 10:00 AM. Late check-outs will incur a $100/hour fee to accommodate incoming charters. 3. Vessel Use & Operational Restrictions - Legal Conduct: No illegal drugs, weapons, or unlawful activity. - Sobriety: No operating the vessel (or directing its operation) while under the influence of alcohol or controlled substances. - Stationary Rule: If booked as "Dockside/Stationary," the Charterer shall not start the engine or untie the vessel. - Capacity: Overnight occupancy is strictly limited to [4] persons. Exceeding this limit is grounds for immediate eviction without refund. 4. Onboard Policies & "The Head" (Toilet) - Marine Toilet (CRITICAL): Marine plumbing is extremely sensitive. Nothing may be flushed except natural waste and small amounts of marine-grade toilet paper. No wipes, paper towels, or feminine products. - - Penalty: A $300.00 Clog/Repair Fee applies to any malfunction caused by foreign objects. - Prohibited Items: No red wine, dark juices, staining liquids, aerosol sunscreens, or spray tans. - Clean Air & Pets: This is a non-smoking/non-vaping vessel. Pets must be pre-approved in writing. 5. Weather & Safety The Captain/Owner monitors conditions 24/7. If conditions are deemed unsafe (Small Craft Advisories or Hurricane warnings), you will receive a full refund or a complimentary reschedule. Passing rain showers are not grounds for a refund once a charter has commenced. 6. RELEASE OF LIABILITY & ASSUMPTION OF RISK PLEASE READ: Boating and dockside stays involve inherent risks (slips, falls, motion, and water hazards). - Assumption of Risk: You voluntarily assume all risks for yourself and your guests. - Release: You agree to release and hold harmless the Vessel Owner, its members, and agents from any claims for injury, property damage, or loss, except in cases of gross negligence. - Supervision: You are responsible for all guests and must ensure minors are supervised at all times. 7. Fuel Policy (Navigated Charters Only) - Allowance: The first $50.00 of fuel is included in your rate. - Overage: You are responsible for all fuel exceeding $50.00, estimated at $5.30/gal (90-Octane Non-Ethanol). - Payment: Fuel summaries are provided at the end of the trip. Balances must be settled or the card on file prior to disembarkation. 8. Overnight Stay Specifics - Shore Power: Charterer must ensure the 30-amp power cable remains connected to maintain AC and refrigeration. - Quiet Hours: Per Marina rules, quiet hours are 10:00 PM to 8:00 AM. Excessive noise may result in removal by security. - Galley Use: Microwave and sink are for light use only. No heavy cooking that produces grease or smoke is permitted in the cabin. 9. Damage, Gratuity & Legal Venue - Damage: Charterer is liable for all damages beyond normal wear and tear. A security hold may be placed on your account. - Gratuity: A 15–20% gratuity is customary for Captained services. For stationary stays, a cleaning tip for the crew is appreciated. - Legal: This Agreement is governed by Federal Maritime Law and Florida law. Venue: Pinellas County, FL.
