Rental Agreement The undersigned as Lessee of the Heyday WT-1 boat watercraft (Rental). The lessee hereby agrees to lease from The Company the Rental at the rate of $400.00 per day and upon the terms and conditions set forth herein. The rates are effective until the Rental is returned. Lessee expressly warrants and represents that it has examined the Equipment, and except as noted on check out form, said Rental is free from defect or damage. The lessee acknowledges and agrees that it will be solely responsible for any damage to the Rental while the Rental is in Lessee’s possession, whether such damage is caused by the Lessee or by any third party, ordinary wear and tear excepted. LESSEE AGREES THAT ITS USE OF THE RENTAL IS AT ITS OWN RISK. We assumes no responsibility for property damage or personal injury to the Lessee or others. Lessee has been informed and acknowledges that we do not make insurance available to the Lessee. The Lessee warrants and represents to us that it is familiar with and experienced in proper use and operation of the Rental. Lessee agrees and covenants that Lessee will assure that each person using the Rental has signed release form. Lessee agrees to indemnify and hold us harmless from and against all claims, damages, costs and expenses (including reasonable attorney’s fee and costs) which may incur as a result of the use, possession, or operation of the Rental by Lessee or its guests. Lessee agrees to return the Rental in the same condition as when leases, except for reasonable wear and tear: All repairs to damaged rental are subject to damage agreement as defined herein. Parts to be used in repairs are factory recommended for the rental unit. Labor costs will be billed at standard hourly rates of Germaine Marine, American Fork, UT. If damages are enduring and cause a loss of revenue on part of the company, Lessee will be responsible for lost revenue. We require that Lessee and its guests operate the Rental responsibly by maintaining controllable speeds, keeping a safe distance from other craft, swimmers, the shore, and marked and unmarked hazards. Deviation from this requirement may result in personal injury and property damage for which Lessee shall be liable. I HEREBY AGREE TO THE ABOVE TERMS: Lessee’s Signature_______________________________ Rental Equipment Damage Agreement- REQUIRED! The Lessee, by signing below, agrees that in the event of damage to any motorized watercraft rental leased from us, the Lessee will be responsible to pay the first $25,000 of damage to the watercraft. We require a $1500.00 damage deposit. We will be responsible for remaining damage costs to the Rental exceeding $25,000.00*. The cost of this damage agreement is not included in the price of the rental. Said payment ($1500.00) is due on or before the time when the Lessee takes possession of the Rental. In the event that the Rental covered hereunder is damaged, lessee shall be solely responsible for returning the damaged Rental to Surf This. Failure to return the Rental to the location (2968 N 1350 W Pleasant Grove, UT) will result in forfeiture of Lessee’s rights hereunder and Lessee shall be solely responsible for the loss of the non-returned rental, notwithstanding any provisions herein to the contrary. This Agreement is non-transferable. *If there is ANY damage done to equipment, we will take the full $1500 damage agreement before the Lessee leaves giving time to fully assess damage done to equipment. If damage and labor costs are less than $1,500, we will refund the difference back to the customer. We reserves the right to hold the $1,500 payment up to 3 weeks from the time of damage done to equipment. *The following actions on the part of the Lessee or any of it’s party will void the damage limits listed in this section and Lessee shall be responsible for 100% of all costs including labor, parts, and recovery costs of damaged boat: (1) damages in any way related to the violation of State’s laws and regulations; (2) operating while under the influence: (3) operating in a reckless manner: (4) operating in a manner that a reasonable and prudent person would not operate the rental. Any time there is a collision involved with another vehicle or person, the operator is in violation of State laws and regulations. In the event that the lessee fails to pay any amount due under this Agreement, the Lessee shall be liable for all collection costs and attorney fees incurred. The Lessee, by signing below, agrees that in the event of any damage other than normal wear and tear of any non motorized rental from us, the Lessee will be responsible for all repair costs. If Lessee does not return rental item(s) at end of rental period, due to any reason, Lessee will be responsible for 100% of new replacement. ABSOLUTELY NO SMOKING IN THE BOAT! Sorry, not pets allowed in the boat. I HEREBY AGREE TO THE ABOVE TERMS: Lessee’s Signature_______________________________ A late fee will be charged for late return unless prior arrangements are made in writing by management. If late return results in the next renter being unable to pick-up the boat for their previously purchased rental agreement, the entire cost of their rental agreement will be charged as the late fee. Initial___________ THE LESSEE CERTIFIES THAT HE/SHE HAS EXAMINED THE CRAFT AND EQUIPMENT AND FINDS IT ACCEPTABLE AND SUITABLE FOR THE PURPOSE FOR WHICH IT IS LEASED. THAT HE/SHE WILL OPERATE THE CRAFT IN ACCORDANCE WITH AND ADHERE TO ALL STATE LAWS, RULES, AND REGULATIONS. Initial___________ LESSEE AGREES TO REPORT ANY ACCIDENT, MALFUNCTION OR BREAKDOWN OF RENTAL CRAFT TO LESSOR IMMEDIATELY IN ACCORDANCE WITH THE MALFUNCTION/BREAKDOWN CLAUSE WHICH FOLLOWS. Initial___________ This certifies that I (We), the LESSEE (S) am/are experienced and capable in all aspects of the handling and operation of the craft such as the one rented above. LESSEE agrees said craft will not be occupied by a greater number of persons as is shown in said Rental. I, the LESSEE (S) am/are aware of the NO WAKE areas and am/are responsible for any damage caused by my wake. Initial___________ LESSEE authorizes and allows SURF THIS to charge LESSEE’s credit card for costs associated with damages in accordance with damage agreement terms in this rental agreement. In case of total loss of Rental due to theft, LESSEE will be responsible for 100% of the new replacement cost. Initial___________ LESSEE agrees not to use, nor permit the use: a. of the rental craft for any unlawful purpose; b. of the rental craft in a careless or negligent manner; c. of the rental craft while under the influence of liquor or narcotics; or any other drugs; d. by any other person not the signatory of the agreement, or not equally qualified to operate the rental craft after dark. Initial___________ LESSEE acknowledges his/her responsibility for the safe and proper operation of the craft; has read and agrees to abide by the rules of any applicable laws and regulations, and for the safety and welfare of other persons, and passengers. It is AGREED AND UNDERSTOOD BY LESSEE that the LESSOR shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunctions of the rental craft. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR and its agents, affiliates and personnel from, and against any and all claims for loss of or damage to property, injury to persons (including death) resulting through the use, operation, or possession of said rental craft. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any LESSEE’s personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft or any other causes whatsoever. Initial___________ In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft the LESSEE will immediately report it to LESSOR. Continued use of it shall be entirely at the LESSEE’s risk and thus LESSEE assumes all liability of injury and damage to all persons and property that may become involved by its continued use. Initial___________ Each rental day is 8 hours of use as logged on the boat’s hour meter. For multiple day rentals 8 hours are allotted per day. Overage use will be charged at $100 per hour. (e.g. 3 days of rental equals 24 hours of boating time.) Initial___________ If taking the boat to Lake Powell or Flaming Gorge there is a trip charge that will be discussed at time of booking. I understand I am paying a trip charge for using the boat on Lake Powell or Flaming Gorge. Initial___________ I also understand that if I do not clean the boat after use, I will be charged a minimum of $150 to a maximum of $300 depending on condition for cleaning fees. We reserves the right to use the damage deposit to charge for cleaning fees.
