Article 1st. RENTER'S RESPONSABILITY The renter declares that he/she temporarily received the unit described in this contract for rental/testing. Since this unit is not registered under the renter´s name, he/she agrees to take full responsibility for the losses, regardless of their cause, that the unit may suffer or cause to a third party during the rental/testing period. He/she is also responsible for communicating the terms and conditions to all other participants and for complying with all these terms, as well as for the payment of any fine that, during the rental period may, for any reason, be applied to that unit. Renter will not allow any other person to operate the rented boat/jet ski.  Article 2nd. CONDITIONS APPLIED TO BAREBOAT RENTAL / CHARTER Articles in bold apply only to rental contracts without crew and not to charter (with skipper/driver).  Article 3rd. NAVIGATION CERTIFICATE The client must have a valid boat license to rent a jet ski/boat. The copy of the document must be e-mailed to us and the original document must be presented during check-in and whenever requested by any authority.  Article 4th. NAVIGATION AND SAFETY Our company does not take any responsibility for possible violations of navigation rules that occur during the rental period. The renter agrees to respect all navigation and safety rules during the rental period and accepts full responsibility for the consequences of any violation. By signing this contract, the renter declares that he/she has been informed of the local navigation rules, including but not limited to: - Maximum speed in the Arade River and all ports: 5 knots; - It is forbidden to go to the caves; - It is mandatory to keep a distance of at least 300 meters from the coast.  Article 5th. SAFETY EQUIPMENT The boat/jet ski is equipped with all the safety equipment required by law and all this equipment is checked before and after the rental. On boats, inflatable life jackets should only be used in case of emergency. Servicing a life jacket has a cost of 30€ + VAT, which will be charged to the renter in case of misuse.  Our company provides life jackets for children, which must be requested until 9:00 am of the rental day, indicating the children's weight and age.  Article 6th. CONFIRMATION OF RESERVATION The reservation is only considered completed with full payment of the amount listed in the price list or online booking system.  Article 7th. RENTAL SCHEDULE AND DELAYS The half-day rental takes 3 hours and the full day rental takes 7 hours. Should the boat be returned more than 15 minutes after the scheduled time, our company reserves the right to charge an extra cost, according to the price list, regardless of the reason for the delay.  Article 8th. FUEL The boat/jet ski will be delivered to the renter with a full fuel tank and must be returned in the same condition. In cases where this does not occur, an amount of 2,5€ + VAT per litre will be charged. This extra price includes the refuelling service fee.  Article 9th. CANCELLATION POLICY The reservations can be cancelled up to 72 hours before the rental by sending a cancellation request to the us.  In this case, a reservation fee of 50€ + VAT will be charged to the renter. When valid justification, such as cancellation of flights or illness (with official written evidence from the relevant authorities) for the cancellation is presented, this amount will not be charged. The rental is only considered cancelled after the renter receives an e-mail with the cancellation confirmation. If the cancellation is made with less than 72 hours of advance, the rental can be cancelled, however, the paid amount will not be refunded in whole or in part.  Article 10th. CANCELLATION FOR REASONS OF FORCE MAJEURE Our company reserves the right to cancel any rental for reasons of force majeure, including but not limited to adverse weather conditions or unexpected and serious breakdowns that cannot be repaired on time. In that case, the rental may be rescheduled, or the amount will be returned in full, without any consequence to our company.  Article 11th. LOSS, THEFT OR DAMAGE The renter and all passengers are fully responsible for their own personal belongings - please make sure they are kept safe during the entire rental period. Our company does not accept any responsibility for loss, theft or damage to the referred belongings.  Article 12th. PHYSICAL AND MATERIAL DAMAGE Our company does not accept any responsibility for physical damages, fatal accidents, or injuries to any of those on board.  Article 13th. SPORTS EQUIPMENT / TOWABLES Regarding the rental of sports equipment / towables: - The boat must have at least one person on board who is familiarized with the use of nautical sports equipment and towables; - During the practice of water sports, it is necessary to have at least 2 people on board: the captain and an assistant; - The renter commits to respect the regulations regarding the use of sports equipment; - The renter commits NOT to practice water sports inside the ports; - The sports equipment is always checked before and after the rental. In case of any damage after the rental, the customer will be charged the full amount of the equipment.  Article 14th. CHECK-IN In cases of long delay for check-in (more than 20 min), our company reserves the right to cancel or delay the rental for up to 2 hours, depending on other reservations. In such cases, the rental will NOT be extended, and the renter will not receive any refund for the delay or cancellation. Notwithstanding the above provisions, in case of delay, the customer must inform our company. Article 15th. CLEANING Cleaning is included, except in cases of extreme dirtiness, including but not limited to sand, seaweed or garbage, in which case an additional fee of 75€ + VAT will be charged.  Article 16th. PHOTO/VIDEO RELEASE By signing this contract, the renter hereby grants the our company, on behalf of himself/herself and all passengers on board the boat/jet ski, permission to take photographs and videos of all of them and use such photographs and videos for any marketing purpose, without payment or any other consideration. The renter, on behalf of himself/herself and all the passengers, waives any right to royalties or other compensation arising from or related to the use of the photographs/videos. He/she hereby holds harmless, our company from all claims, demands and causes of action which he/she, his/her heirs, representatives, executors, administrators or any other persons acting on his/her behalf or on behalf of his/her estate have or may have by reason of this authorization.  If you don’t agree, mark this box with an X.   Article 17th. INSURANCE POLICY The boat/jet ski is covered under a mandatory third-party liability insurance. The customer can purchase a full coverage insurance extension for an extra cost, with a variable excess. The amounts of the insurance extension and excess vary and can be found in the online reservation system. When purchasing the insurance extension, the renter will deposit an amount equivalent to the insurance excess and, in the event of any damage to the boat, the client will never pay more than the amount of the excess. The insurance is subject to variable conditions. The customer can have access to the insurance conditions, if requested. The insurance is not valid in case of abnormal use: non-compliance with navigation laws and terms of this agreement.  Article 18th. SECURITY DEPOSIT The renter will be required to provide a security deposit for the rental. The deposit amount is stated on the rental agreement and will be blocked (not debited) on the renter’s payment card. This amount will be used to defray the costs of necessary repairs or replacement, as well as all related expenses, in the event of loss or damage to the boat/jet ski during the rental period. If the cost for repair or replacement of damage to the boat/jet ski and related expenses exceeds the amount of the security deposit, the renter will be responsible for payment to our company of the balance of this cost.  Article 19th. USE OF GPS TRACKING DEVICES Our company uses GPS tracking devices to track or locate boats/jet skis which may be late for their scheduled return, reported stolen, suspected of being lost, stolen, or abandoned or as may be required by law enforcement, or to identify boats/jet skis which have been damaged and may require assistance, when there is a good faith belief that there is an emergency that poses a threat to the renter or any other person’s safety, or as necessary to defend, protect or enforce their rights in connection with the use of Pro Rent’s products and/or services. The renter should have no expectation of privacy or confidentiality as to the places where the boat is sailing.  Article 20th. INVENTORY The inventory attached to the rental agreement is incorporated herein and shall be considered a part of the agreement. By signing the inventory, the renter declares that he/she has looked carefully at the boat/jet ski in a place with enough light and attests that the boat/jet ski conditions were correctly described on such document.  Article 21st. JURISDICTION In the event of any dispute over the rental agreement, the agreement will be interpreted by the laws of the State of Portugal, and any lawsuit or arbitration must be brought in Tribunal de Comarca de Portimão, in Portugal.  If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.
