BAREBOAT CHARTER AGREEMENT AND LIABILITY RELEASE Binding Upon Booking via GetMyBoat — No Signature Required This rental is a bareboat charter, meaning the Renter assumes full possession, control, and liability for the vessel during the rental period. The Boat Owner provides no captain or crew. If the Renter hires a captain through GetMyBoat or any third party, that captain is not an agent of the Boat Owner. The Renter is fully and solely responsible for the actions of any hired captain or crew, including all damages, violations, or incidents. The Renter voluntarily releases and waives all claims against the Boat Owner, its agents, heirs, successors, and assigns, for any injury, damage, loss, or death arising from the use or operation of the boat — including claims caused by negligence. The Renter agrees to fully indemnify and hold harmless the Boat Owner from any claim, lawsuit, damage, or cost including attorneys’ fees resulting from the Renter’s use, misuse, or abuse of the boat, the actions of passengers or a hired captain, or any personal injury, property damage, or violation of law. The Renter acknowledges that boating involves inherent risks, including the risk of serious injury or death, and voluntarily assumes full responsibility for all risks. The Renter agrees to operate the vessel safely, lawfully, and respectfully, remain responsible for all passengers aboard, and comply with all applicable maritime laws and posted rules. Smoking, pets (unless pre-approved), alcohol while operating the boat, and docking at unapproved locations except in emergencies are strictly prohibited. All children under 12 must wear U.S. Coast Guard-approved life jackets at all times while on board. If the Boat Owner determines the Renter has engaged in unsafe or reckless behavior, the rental will be terminated immediately without refund, and the entire security deposit will be forfeited. The Owner’s determination of unsafe use is final and non-negotiable. The vessel must be returned clean and free of personal belongings or trash, and in the same condition as delivered. The Renter is financially liable for any damage or excessive cleaning. The Owner may withhold part or all of the security deposit and/or bill the Renter directly for additional costs. Returning the vessel more than 20 minutes late will result in forfeiture of the entire security deposit, and additional hourly charges may apply. If the Boat Owner prevails in any legal action to enforce this agreement or recover damages, the Renter agrees to pay all legal fees, court costs, and collection expenses incurred by the Owner. This agreement is governed by the laws of the Commonwealth of Virginia. Any legal action or dispute must be filed exclusively in the state or federal courts of Alexandria, Virginia. The Renter consents to jurisdiction and waives any objection to venue. The Boat Owner is not liable for cancellations or delays caused by weather, natural disasters, mechanical failures, or other force majeure events beyond their control. Insurance, if available, does not limit the Renter’s liability. The Renter remains responsible for the full cost of repair or replacement, whether or not insurance coverage applies. The Renter agrees that the Boat Owner’s pre- and post-charter photos or videos will serve as the official record of the vessel’s condition. Disputes regarding damage will defer to this documentation. By booking this vessel through GetMyBoat, the Renter agrees to all terms in this agreement. No separate signature is required. This charter agreement is fully binding and enforceable under GetMyBoat’s terms of use. By proceeding with this booking, the Renter confirms that they are at least 25 years old, legally qualified to operate or hire a captain for this vessel, have read and agreed to all terms above, and accept full responsibility for the vessel, passengers, and captain(s) during the rental.1. The maximum occupancy of your yacht is _12___ persons and will not be exceeded. 2. Yachts may never be motored or sailed after dark. In fact, all yachts are to be at a mooring/marina or anchored one full hour before dusk. 3. Any yacht wishing to dock at a dock  may do so on a space available basis alone. We ask that you call ahead on your cell phone to the dock. to confirm that we do have space, and that we can allocate it to you. 4. You must vacate your yacht back at the base at 5p.m. on all days, and you must be at the dock or on a mooring ball in our bay ready for check out procedures. Late fees will be assessed at a rate of $1100 per hour, 5. The Captain  are the only, members of the crew authorized and allowed to operate the yacht. Anyone else must be under the direct supervision of one of the Captain. 6. The Captains are the "designated drivers"; and as such should not operate the yacht while consuming alcohol. 7. Instructions have been given on the cruising limits of the area. This Includes unauthorized /off limits areas, navigational, and docking locations, and the Charters agree to abide by these instructions. 8. The rafting of yachts Is strictly prohibited. 9. All charterers are required to return the yacht in a reasonably clean condition. Returning the yacht in any condition other than those listed below will result in additional charges: a) All dishes, silverware, utensils, pots and pans must be washed dried and put backing their proper places. b) Ali open food items must be removed, taken with you or thrown away in the dumpster. All other food if being left behind must be left on the saloon table. c) All trash must be bagged and placed in the dumpster. d) All linens should be placed in pillowcases and left in the aft head. e) Sail cover, if applicable, must be replaced on a neatly flaked sail. f) Yacht should be left in a neat and tidy manner with all items replaced in their proper places, As Charters, we understand that any violation of any rule may result in the forfeiture of our security deposit or the termination of our charter with no refund of fees or both.
