Terms and Conditions  Booking Terms & Conditions These Terms & Conditions govern all bookings made with our company. Please read them carefully before confirming your booking. By proceeding with a reservation, you acknowledge that you understand and accept the terms outlined below. 1. Booking & Eligibility - All bookings must be made by individuals aged 18 years or older. By booking on behalf of a group, the lead participant confirms that all members agree to these Terms & Conditions. - Minors under the age of 18 must be accompanied by a parent or legal guardian throughout the trip. 2. Payment Terms - A 30% deposit is required upon booking confirmation, unless stated otherwise. Deposits are refundable until 10 days prior to the departure date (excluding transaction fees). - The remaining balance is due 7 days before departure. - For late bookings made within 7 days of the trip, full payment is required immediately. - Payments must be made in Euros (€) and net of transfer fees or exchange rate differences. 3. Cancellations & Refunds By You (the client): All cancellations must be made in writing. Contact us for more info. Cancellation Notice Refund Amount 10+ days before departure 100% refund 5–9 days before departure 50% refund Less than 5 days No refund Note: Bank charges are non-refundable. We reserve the right to cancel or reschedule trips due to: - Unsafe weather conditions - Illness or injury of staff - Force majeure (e.g., natural disasters) - Low participation numbers (minimum not met 3 days prior) In such cases, you will be offered: - A full refund (excluding any non-refundable external costs), or - Alternative dates for the trip 4. Personal Responsibility & Risk Acknowledgment Adventure activities inherently carry risks, including but not limited to personal injury, property loss, or even death. By booking with us, you acknowledge and accept these risks. You participate at your own risk and agree to act responsibly at all times. We strongly recommend that all participants obtain comprehensive personal travel insurance, including: - Medical coverage - Trip cancellation - Emergency evacuation - Repatriation 5. Health & Fitness Participants must be in average physical condition and capable of participating in the selected activities. You are responsible for: - Assessing your fitness and readiness - Consulting with a doctor if uncertain - Informing us of any medical conditions, allergies, or special requirements at the time of booking 6. Conduct & Compliance To ensure a safe, respectful, and enjoyable experience for everyone: - You must comply with all instructions from our staff and guides. - We reserve the right to remove any participant whose behavior endangers others, violates laws, or disrupts the group. - Disruptive behavior may result in trip termination without refund. 7. Punctuality - All participants must arrive on time at the specified meeting point. - Activities run on local time, and delayed arrivals will forfeit the booking without refund or rescheduling. 8. Equipment Requirements - Participants are responsible for bringing all mandatory equipment as advised in the pre-trip guide. - Our guides reserve the right to exclude any individual lacking essential equipment or wearing unsafe attire. 9. Intellectual Property & Media Use Ownership Photos, videos, and testimonials taken during your trip may be created by our team or shared by participants. All such content is considered the intellectual property of Heliophilia. Promotional Use By participating, you grant us permission to use this content for promotional purposes across: - Website - Social media - Print brochures - Online advertisements Opt-Out Option If you do not wish for your likeness to be used for marketing, please send a written request prior to or during your trip using the following format: Subject: Media Use Opt-Out Request [Your Full Name] [Booking Reference Number] I hereby request that any content featuring me captured during the trip not be used by us for advertising or promotional purposes. Civil Liability Insurance All participants are covered under our company's Civil Liability Insurance, which provides protection in the event of an incident arising from our operations or negligence. However, this does not replace personal travel insurance. You remain responsible for insuring your own medical, travel, and property risks. 11. Safety Guidelines General Safety - Inform guides of medical conditions or allergies - Wear appropriate gear - Stay hydrated - Avoid carrying unnecessary valuables Activity-Specific Rules Spearfishing: Dive with a buddy, obey marine regulations Boat Cruises: Wear life jackets, stay seated Jeep Tours: Buckle seat belts, no standing in motion Beach Excursions: Swim only in designated areas, watch for currents Horse Riding: Helmets required, follow guide instructions Wine & Olive Oil Tasting: Drink responsibly, disclose allergies 12. Dispute Resolution We aim to resolve all disputes amicably and in good faith. If legal action is required, it will fall under the exclusive jurisdiction of the courts of Crete, Greece. 13.
