Boat Rental Agreement & Liability Release (Lake Use Only)  1. Cancellation Policy  - Full refund if canceled ≥5 days before rental start time.   - No refunds for no-shows or cancellations within 5 days.   Weather Policy: No weather refunds within 5 days. Renters assume all weather risks.   Owner-initiated cancellations:Full refund if Owner cancels due to:      - NOAA Small Craft Advisory/Warnings      - Sustained winds >20 mph    - Lightning/thunderstorms     - Visibility <1 mile   Renter may reschedule (within 12 months) if:     - Precipitation >50% forecasted AND wave height >1 ft at rental start time   - Requires proof via [NOAA Lake Forecast.(https://www.weather.gov/afg/). $200 rescheduling fee applies. 2. Assumption of Risk Renter acknowledges and accepts inherent risks of boating, including:   Changing weather, submerged hazards, wildlife encounters, equipment failure, and drowning.   Mandatory Pre-Departure Check: Verify weather conditions and lake-specific hazards.   3. Release of Liability Renter WAIVES AND RELEASES Owner from ALL claims for:   Injury, death, property damage, or losses arising from rental use.   Claims involving Owner’s ordinary negligence (*does not cover gross negligence/willful misconduct*).   4. Strict Usage Rules  LAKE USE ONLY: Boat must remain on Big Lake. Off-lake use voids all coverage.   ALCOHOL/DRUGS: Zero tolerance. Operation under influence voids insurance.   No Glass containers,  No Diving  No Pets No Beaching(except at designated sandy areas)   5. Damage Responsibility Renter is 100% liable for: All damage to boat/equipment (including upholstery tears, stains, or burns)   Third-party property damage   Security Deposit:$450 held for:    Repair costs (minimum $450 for upholstery damage)   Cleaning fees ($250 if returned excessively dirty)   Owner may charge beyond deposit for damages exceeding held amount using card on file.   6. Renter Must: Wear USCG life jackets while underway (<13 yrs mandatory)   Never exceed passenger/weight capacity   Return boat on time, in original condition (minus normal wear)   Report accidents immediately to local authorities   7. Safety & Compliance   Required Gear: Life jackets, fire extinguisher, throwable flotation device   Operator Age: ≥16 years for motors >10HP   No operation 30 minutes post-sunset   8. Emergencies Breakdown:  1. Shut off engine    2. Message Owner IMMEDIATELY and or the Burkeshore Marina     3. Do not attempt repairs 9. Financial Terms Renter authorizes charges for:    Damage repairs (at shop rates + 20% admin fee)   Loss-of-use fees ($950/day during repairs)   Missing equipment (replacement cost + 25%)   10. Legal Provisions Governing Law: Alaska Statutes   Dispute Venue: Wasilla Alaska   Severability: Invalid clauses don't void remaining terms   RENTER CERTIFIES: I accept full financial responsibility for all damages (including upholstery)   I will only operate this boat on Big Lake I will inspect the boat and note pre-existing damage by messaging in the app.  I agree to charges beyond deposit for repair costs
