You can choose anyone to captain the yacht including yourself. However, the designated captain must have appropriate certification, significant experience with boats of this size, and perform an on board proof of competency prior to your rental.

PART C: BOOKING NOTE TERMS  1. This charter is a bareboat charter of the BOAT exclusively for use as a pleasure craft. CHARTERER shall assume complete possession, control, management and operation of the BOAT during the CHARTER PERIOD.    2. OWNER and CHARTERER recognize GetMyBoat as CHARTERING AGENT   of OWNER in connection with this Agreement. 3. CHARTERER shall hold a Pleasure Craft Operators Card or equivalent, or hire at CHARTERERS own risk and expense, an individual operator qualified to operate the BOAT during the CHARTER PERIOD.   4. a) The Charter hire includes the charter of the BOAT with all its outfit and fuel present at delivery.  CHARTERER shall pay, at cost, for all other expenses incurred during the CHARTER PERIOD. These include, but are not limited to, fuel sufficient for the voyage and return to the place of redelivery, shoreside transport, hire of operators and crew, food, berthing dues and other harbor charges, lockage, docking fees, charges for water and electricity taken from shore, taxes, any insurance premiums for charterer’s account and rental or purchase costs of any permitted special equipment placed on board at the CHARTERER's request.  b) When making the booking, the CHARTERER shall pay the full reservation fee and any applicable taxes shall be paid by the CHARTERER to the CHARTERING AGENT prior to the beginning of the Charter Period and prior to embarking on the BOAT. Hire must be paid in full by e-transfer or credit card no tap available).  CHARTERER shall pay an additional Security Deposit of by 1500.00$ CAD credit card pre-authorization. If no additional charges apply, the security deposit will be automatically refunded within 24 hours of the Charter Period. All payments shall be made in Canadian Dollars (CAD).  c)  Obligations of payment and refund under this Agreement survive the termination of this Charter Agreement.   5. a) CHARTERER is responsible for redelivering BOAT in the same condition as delivered, fair wear and tear excepted. CHARTERER shall pay CHARTERING AGENT expenses of cleaning BOAT if redelivered in an unreasonably dirty condition and pay expenses of repairing any damage caused by CHARTERER and guests, including plumbing repair, BOAT equipment and CHARTEER and guest personal effects lost overboard and any damage caused by or to the BOAT. CHARTERING AGENT may charge a minimum 500.00$ CAD amount for cleaning and repair as liquidated damages and not as penalty based on historical average remediation expenses incurred by charter operators in the Montreal area.    b) CHARTERING AGENT may deduct and withhold from security deposit expenses of repairing damages caused by CHARTERER.  Expenses of repairing damages caused by CHARTERER and guests exceeding 1500.00$ CAD are payable by CHARTERER to CHARTERING AGENT. 6. Charter delivery and redelivery shall proceed regardless of weather conditions, cancellation and early redelivery under clause 7 excepted. If CHATERERS do not take delivery at the beginning of the CHARTER PERIOD, all hire is forfeited and becomes due and payable by CHARTERER to CHARTERING AGENT except if the charter is postponed under clause 7 of this Booking Note.   7.  a) The CHARTERING AGENT shall promptly notify the CHARTERER of any cancellation by CHARTERING AGENT. If the CHARTERING AGENT cancels the booking, the CHARTERER shall be entitled to a full refund, without interest, of all payments made to the CHARTERING AGENT within seven (7) business days of the cancellation. Refund of payments made by the CHARTERER shall be the exclusive remedy available to the CHARTERER in the event of cancellation by CHARTERING AGENT.  CHARTERING AGENT and OWNER shall not be liable for any consequential, indirect, or incidental damages, penalties, losses, costs, or expenses incurred by the CHARTERER due to the cancellation, including but not limited to travel, meals and accommodation expenses.  b) CHARTERER shall provide written notice to the OWNER of cancellation by CHARTERER as soon as possible. The cancellation notice shall state the reason for cancellation.  If CHARTERER cancels within 7 days of the Charter Period, the CHARTERING AGENT shall retain the deposit for the account of OWNER.  If CHARTERER cancels the BOOKING more than seven (7) days before the Charter Period, CHARTERING AGENT shall refund the deposit less a 189.99$ administration fee.  CHARTERING AGENT and OWNER shall not be liable for any direct or consequential damages, losses, costs, or expenses incurred by the CHARTERER due to the cancellation, including but not limited to travel, meals and accommodation expenses.  c) CHARTERING AGENT at its sole discretion may cancel the Charter due to weather conditions based on Environment Canada forecasts and weather warnings for the Charter Period. The CHARTERING AGENT reserves the right to cancel or reschedule the charter under this clause within 24 hours of the beginning of the CHARTER PERIOD. The CHARTERING AGENT shall promptly notify the CHARTERER of any weather-related cancellations. The following weather conditions shall be considered unsuitable for operation under charter.  i)    Consistent wind speeds exceeding 30 knots. ii)   Persistent wave heights exceeding 2 meters. iii)  Persistent heavy rainfall with reduced visibility or safety concerns. iv)  Presence of thunderstorms, lightning, or severe weather warnings in the vicinity.   d)   In case of the sudden occurrence of unsuitable weather conditions not forecast, CHARTERER shall immediately redeliver the BOAT at its location of redelivery and CHARTERING AGENT shall refund hire to CHARTERER from the time of redelivery pro rata over the unused CHARTER PERIOD.  e) In cases of forecast weather conditions unsuitable for charter operation, the CHARTERING AGENT may at its sole discretion: i)    reschedule delivery under the charter to a date before September 30 of the year of charter; or  ii)   refund the total amount of monies paid by the CHARTERER prior to cancellation.  f) CHARTERER may, with approval from the CHARTERING AGENT, choose to proceed with the Charter regardless of weather conditions if the safety of the BOAT and guests is not compromised. If the CHARTERER exercises this option, no refund shall be issued by the CHARTERING AGENT to the CHARTERER regardless of any eventual shortening of the voyage. 8. Before embarkation CHARTERER shall show CHARTERING AGENT physical government-issued photo identification matching the CHARTERER INFORMATION in Part A.  9. Use of drones and robotic or remote-controlled surface or underwater vehicles from the BOAT is not permitted. 10.  Taking or use of pyrotechnics on board the BOAT is prohibited.  11.  Pets or animals are not permitted on board the BOAT except for certified guide or service dogs.  12. Use of jet skis, canoes, kayaks, water-skis, waterboards, paddleboards, scuba diving gear and human carrying inflatable craft (personal safety floatation devices excepted) from the BOAT is not permitted.  13.  Individual CHARTERERS and guests are not permitted to bring street footwear on board the BOAT. CHARTERING AGENT will store street footwear during the voyage and return footwear after redelivery.  14.   a)   CHARTERER, crew and guests have liberty to bring and consume prescription medicines on board the BOAT during the CHARTER PERIOD as long as a copy of the prescription is in such individual’s possession.   b) CHARTERING AGENT reserves the right to forbid and prevent embarkation by CHARTERER or any of their crew or guests if any such individual reasonably appears to be intoxicated.  c) Possession and use of all illicit drugs or controlled substances, as may be defined from time to time by law, on board the BOAT and operation of the BOAT while intoxicated, is strictly prohibited and shall result in the immediate termination of the charter with the forfeiture of all monies paid. CHARTERING AGENT reserves the right to demand and cause immediate redelivery of the BOAT at the place of delivery or redelivery or at the first available port, with all of the individual CHARTERER, crew and guests being put ashore, and any expenses resulting from travel from a place other than the place of delivery or redelivery to be borne solely by CHARTERER, crew, and guests.    d) CHARTERING AGENT reserves the right to arrange alternate transportation from the BOAT at its place of redelivery of any individual CHARTERER, crew or guest if such individual reasonably appears intoxicated, at such person’s own expense.   15.  CHARTERERS on their own behalf and on behalf of their guests, give CHARTERING AGENT and its  employees and contractors the irrevocable and unrestricted permission without compensation to take, publish and transfer photographs and video images of individuals on board the BOAT for advertising and trade purposes.
