TERMS & CONDITIONS — BOAT RENTAL AGREEMENT Follow The Fun Boating — Renter Terms 1. Agreement to Terms By booking, paying for, or boarding any vessel operated or brokered by Follow The Fun Boating, the Renter agrees to comply with these Terms & Conditions and all instructions provided by the Captain and crew. 2. Eligibility Requirements - Maximum passenger count must comply with U.S. Coast Guard capacity limits 3. Rental Period - Rental begins and ends at the scheduled times agreed upon - Late arrival by renter does not extend rental time - Additional time may be granted only if available and will be billed at the hourly rate 4. Payment Terms - Full payment or is required to confirm booking. App policy and payment is directly through the app. 5. Security Deposit - A refundable security deposit (typically $500–$1,000) may be required - Deposit covers damages, excessive cleaning, or violations - Refund issued within 3–5 business days after inspection 6. Cancellation Policy Renter Cancellation - 7+ days before trip: Full refund - 3–6 days: 50% refund - Less than 72 hours: No refund 4th of July weekend 30 days window to cancel free or charge or NO refund. Weather Cancellation - Captain may cancel due to unsafe conditions (high winds, storms, etc.) - In such case, renter may: - - Reschedule, or - Receive full refund Light rain or cloudy weather is not grounds for cancellation. 4th of July : Rain or shine event. 7. Captain Authority The Captain has full authority regarding safety and operation of the vessel. The Captain may terminate the trip without refund if: - Safety rules are violated - Excessive intoxication occurs - Illegal activity occurs - Behavior endangers passengers or vessel 8. Safety Rules Renter and guests must: - Follow all safety instructions - Remain seated when instructed - Wear life jackets when required - Avoid unsafe behavior (diving, standing on rails, etc.) 9. Alcohol, Drugs, and Conduct - Responsible alcohol consumption allowed for passengers only - Illegal drugs are strictly prohibited - No smoking in restricted areas - Disorderly conduct may result in trip termination without refund 10. Damage Liability Renter is financially responsible for: - Damage caused by renter or guests - Lost equipment - Cleaning due to spills, vomiting, or excessive mess Repair or replacement costs exceeding deposit will be charged. 11. Personal Property Follow The Fun Boating is not responsible for lost, stolen, or damaged personal items. 12. Assumption of Risk Boating involves inherent risks including injury, drowning, or accidents. By participating, renter and guests voluntarily assume all risks associated with boating activities. 13. Release of Liability Renter agrees to release and hold harmless Follow The Fun Boating, its owners, captains, crew, and affiliates from liability for injury, loss, or damage except in cases of gross negligence. 14. Indemnification Renter agrees to indemnify and defend Follow The Fun Boating against claims arising from renter’s actions or violations of this agreement.
