A CHARTER AGREEMENT MUST BE SIGNED BEFORE BOARDING. 1. CAPTAIN’S AUTHORITY & USCG COMPLIANCE All charters are operated under the sole authority of the Captain, a credentialed operator under applicable U.S. Coast Guard (“USCG”) regulations. The Captain retains absolute discretion regarding navigation, safety, weather, passenger conduct, and termination or modification of any voyage. The passenger agrees to comply immediately with all instructions from the Captain and Crew. Failure to comply may result in termination of the charter without refund. 2. SEAWORTHINESS & OPERATIONS Passenger acknowledges the vessel is maintained and operated in accordance with applicable federal and state regulations. The Company makes no guarantee of uninterrupted or incident-free conditions due to the dynamic marine environment. 3. ASSUMPTION OF RISK Passenger acknowledges that participation involves inherent risks, known and unknown, including but not limited to: vessel motion, wakes, rough seas, boarding/disembarking, slips and falls, weather changes, equipment failure, wildlife encounters, and acts of other passengers. Passenger knowingly and voluntarily assumes all such risks, including risks arising from the ordinary negligence of the Company to the fullest extent permitted by law. 4. RELEASE, WAIVER & COVENANT NOT TO SUE To the fullest extent permitted by law, Passenger, on behalf of themselves and their heirs, assigns, and representatives, hereby releases, waives, and forever discharges our company, its owners, officers, employees, Captain, crew, agents, and affiliates from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether in law or equity, arising out of or related to participation in the charter, including those based on alleged negligence. Passenger further agrees not to sue or bring any claim against the Company for any such matters. 5. INDEMNIFICATION Passenger agrees to defend, indemnify, and hold harmless the Company from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from Passenger’s conduct, negligence, or breach of this Agreement. 6. BYOB & CONDUCT POLICY - BYOB permitted - Alcohol consumption limited to guests 21+ - No illegal drugs or weapons onboard - The Captain may refuse boarding or terminate the charter without refund for intoxication, unsafe, or unlawful behavior 7. CHARTER TIME, DELAYS & CANCELLATION - Charter time begins at scheduled departure - Late arrivals do not extend charter time - The Captain has sole authority to delay, modify, or cancel due to weather, safety, or mechanical concerns - Weather/safety cancellations will be rescheduled or refunded at Company discretion based on availability 8. DAMAGE & LIABILITY FOR PROPERTY Passenger is financially responsible for any damage to the vessel or its equipment caused by negligent or intentional acts. The Company is not responsible for loss or damage to personal belongings. 9. MEDICAL FITNESS Passengers affirm they are physically and medically able to participate and have disclosed any conditions that may affect safety. Passenger accepts full responsibility for any medical issues arising during the charter.
