Ghimar is a Grand Banks 50 built in 1972 by American Marine shipyards, one of the last units of this generation built of wood before production switched to polyester. A boat of character, rare, with an immediately recognizable silhouette, fully re-engined in 2021 with two Caterpillar C7.1 of 350 hp each. Ghimar is available both for a day charter (day charter) at the price of 2250€ per outing and for cruises over several days (long charter). Indeed, beyond day trips departing from Marseille, it is also possible to organize sea trips with navigation over several days and nights on board, for up to 6 people, in the Mediterranean. These cruises allow you to take full advantage of the boat, with stops and anchorages adapted to the program and conditions. Long-stay projects are studied on request, with a personalized price proposal according to the duration, the itinerary and the desired level of service. On board, you have four distinct areas: the aft cockpit, the interior lounge, the foredeck and the fly. Enough to comfortably accommodate up to 24 people without anyone getting in the way — this is what our customers always remember at the end of their day. The boat is under exclusive privatization for your group. Departure, sailing and anchoring times are entirely organized according to your desires — you do not share the boat with anyone else. The trip takes place over a period of up to 6 hours, departing from the Old Port. The skipper is bilingual French-English and knows the corners that the maps do not show. GENERAL TERMS AND CONDITIONS OF CHARTER Article 1 – Use of the Vessel The use of the Vessel is geographically limited to the Mediterranean coastal navigation area. The full charter fee shall remain payable to the Owner, regardless of whether the Charterer makes use of the Vessel during the charter period, whatever the reason for such non-use. Should the Charterer fail to make any payment by the due dates specified in the contract, this agreement shall automatically terminate without prior notice from the Owner. Any sums already paid shall be retained by the Owner as compensation. Article 2 – Cancellation by the Charterer If the Charterer cancels the charter and terminates this agreement, all deposits paid or due shall be retained by the Owner as compensation. The Owner may postpone or cancel the charter only if a specific weather warning has been issued by the relevant maritime authorities or if the skipper, who is the sole master of the Vessel, determines that safe navigation cannot be undertaken. In such circumstances, the charter may be rescheduled, and any sums already paid by the Charterer may be credited towards a future charter, subject to the Owner's availability, provided that the new charter takes place within one month of the original charter date. Article 3 – Cancellation by the Owner If, due to damage to the Vessel or any circumstance beyond the Owner's reasonable control, the Owner is unable to make the designated Vessel available, all sums paid by the Charterer shall be refunded. The Charterer shall not be entitled to any further compensation or damages. If delivery of the Vessel is delayed, the charter fee shall be recalculated in proportion to the actual period during which the Vessel was available. The Charterer shall not be entitled to claim any additional compensation or damages. Article 4 – Delivery of the Vessel The Owner undertakes to deliver the Vessel fully equipped and compliant with all applicable laws and regulations governing the intended category of navigation. The Vessel shall be delivered in good working order, clean, and in a seaworthy condition. Article 5 – Obligations of the Charterer The Charterer acknowledges that the qualified skipper on board possesses the necessary skills and qualifications to assume responsibility for the Vessel and to undertake the intended voyage, in accordance with Article 4 above. The Charterer agrees not to embark more passengers than the number specified in the signed quotation and permitted under applicable regulations. The Charterer undertakes to use the Vessel solely for recreational navigation, in compliance with all applicable maritime and customs laws and regulations, and only within the operational category for which the Vessel is equipped. The Vessel may not be used for commercial activities, professional fishing, passenger transport, freight transport, or any other commercial purpose. The Charterer expressly releases the Owner from any liability, whether as shipowner or otherwise, arising from any breach of these prohibitions. The Charterer shall be solely responsible before the maritime and customs authorities for any legal proceedings, fines, penalties, confiscations, or other sanctions resulting from such breaches, including where committed unintentionally. Sub-chartering, lending, or transferring the use of the Vessel to any third party is strictly prohibited and may result in legal proceedings. Any costs arising therefrom shall be borne exclusively by the Charterer. Article 6 – Consumables Fuel is not included in the charter price unless otherwise expressly stated in the quotation or charter agreement. Article 7 – Security Deposit The security deposit, provided either by credit card pre-authorisation or by cheque, serves as security against any damage to the Vessel or partial loss of equipment attributable to the Charterer and not covered by the insurance policy. The amount of the security deposit shall not constitute a limitation of the Charterer's liability. The Owner expressly reserves the right to recover the full amount of any loss or damage suffered. Any cheque provided as a security deposit must remain fully funded until it has been returned by the Owner. In the event of damage to the Vessel or loss not covered by the insurance policy, or where the extent of insurance coverage remains uncertain, reimbursement of the security deposit may be delayed until all related costs have been settled by the Charterer. Should the insurance company subsequently reimburse the Owner for the relevant damage, any amount previously recovered from the Charterer in respect of such damage shall be refunded accordingly. Article 8 – Insurance and Insurance Excess The Vessel is covered by a comprehensive ("all risks") insurance policy. A copy of the insurance policy is available upon request. The Charterer is deemed to have read and accepted its terms. In the event of any claim, the Charterer shall remain liable up to the amount of the insurance excess (deductible) specified in the insurance policy. If desired, the Charterer may purchase optional cancellation insurance and/or security deposit insurance in addition to the charter agreement. These policies may reduce or eliminate the insurance excess in the event of damage to the Vessel and may also provide reimbursement in the event of cancellation. For further information or to subscribe to this optional insurance, please use the following link: https://acces.ouest-assurances.fr/souscription-force9.php Article 9 – Damage During the Charter In the event of damage to the Vessel or loss of equipment during the charter period, the Charterer must contact the Owner before undertaking any repairs. In the event of any accident, incident, or occurrence giving rise to an insurance claim, the Charterer must immediately notify the Owner and complete a written accident report, which shall be provided to the Owner as soon as possible. Should the Charterer fail to comply with these requirements or neglect to take any necessary measures to safeguard the Vessel, the Charterer may be held liable for the full cost of the resulting damage. Under no circumstances shall any loss of use of the Vessel resulting from damage or mechanical failure give rise to compensation or reimbursement. Article 10 – Cancellation Policy Right to Cancel The Charterer may cancel the charter agreement by notifying the Owner in writing (by email or registered mail) no later than ten (10) days before the scheduled start of the charter. Cancellation Fees - Cancellation more than 10 days before the charter date: 70% of the total charter price will be refunded. - Cancellation less than 10 days before the charter date: no refund will be issued. Changes to the Booking Any request to amend the booking must be submitted in writing and is subject to the Owner's approval. Additional charges may apply. Failure to Attend If the Charterer fails to attend on the scheduled charter date without prior notice, the booking shall be deemed cancelled and no refund shall be payable. The Owner also offers optional cancellation insurance. Please refer to Article 8 – Insurance and Insurance Excess. Article 11 – Return of the Vessel At the end of the charter period, the Charterer shall return the Vessel to the Owner for inspection and inventory. The Vessel must be vacated by all passengers, free of all personal belongings, and returned in a clean, tidy, and orderly condition. A joint inspection and inventory shall be carried out upon redelivery. If any damage to the Vessel or any of its equipment is identified, or if any equipment is missing, the Charterer shall be responsible for the cost of repair or replacement. Where the damage is covered by the insurance policy, reimbursement shall be subject to deduction of the applicable insurance excess together with any associated costs arising from the damage. The Charterer shall return the Vessel on the agreed date, at the agreed time, and to the agreed location. If the Vessel is returned to a different port, all related costs shall be borne by the Charterer, with a minimum charge of €150 (excluding VAT). Any delay in returning the Vessel shall incur a penalty of €200 per hour, irrespective of the reason for the delay.
