DISCLAIMER DISCLAIMER WHEN CHARTERING THE CATAMARAN, WAIVER OF CLAIMS, EXPRESS ACCEPTANCE OF RISKS, AND INDEMNITY AGREEMENT By signing this document, you waive certain legal rights, including the right to sue. By signing this document, you accept certain risks. Please read carefully. EXPRESS ACCEPTANCE OF RISKS ASSOCIATED WITH THE USE OF THE CHARTERED CATAMARAN (HEREINAFTER "THE CATAMARAN") AND ALL RELATED ACTIVITIES DURING YOUR STAY ON THE CATAMARAN I wish to participate as a passenger in the catamaran voyage operated by 15144680 Canada Inc. (Vessel M Legacy), and I acknowledge that my participation in the catamaran voyage is entirely voluntary. I expressly affirm and acknowledge that I have been fully informed of the inherent risks associated with activities conducted on or off the catamaran, the use of other motorized equipment, which may or may not belong to the owner, provided or not by the owner of the catamaran, including, but not limited to, jet skis, wakeboards, personal watercraft, etc. I expressly affirm and acknowledge that I have been fully informed of the inherent risks associated with the use of non-motorized equipment, owned or not by the owner, provided or not by the owner of the catamaran, including, but not limited to, kayaks, canoes, paddleboards, surfboards. The inherent risks of the activities mentioned above include, but are not limited to: • Changes in the flow of water, tides, currents, waves, and the boat's wake. • Wind shear, inclement weather, lightning, extreme weather conditions, and temperatures. • Collision, capsizing, sinking, or other dangers or events that may affect the well-being of passengers, injuries, exposure to the elements, hypothermia, impact of the body on the water, entry of water into bodily orifices, drowning. • Insects, all forms of marine life, injuries caused by marine creatures (including bites). • Failure of any equipment, motorized or not, failure of the catamaran, error in maneuvering by the captain. • Heat or sun-related injuries or illnesses, including, but not limited to, sunburn or dehydration. • Boarding and disembarking from boats or other vessels, entering and exiting the water, and activity on or near the dock.SAFETY RULES ON AND OFF THE CATAMARAN I expressly commit to following the operational and safety instructions of the captain at all times. I understand that these rules have been established for my own safety, the safety of other passengers on the catamaran, as well as that of the crew members. I acknowledge, understand, and expressly accept that if I do not comply with the safety rules and behave irresponsibly, the captain may ask me to leave the catamaran immediately and without further notice. UNSUPERVISED ACTIVITIES ON OR OFF THE CATAMARAN All activities conducted on or off the catamaran will be done without supervision. The captain or any other crew member are not qualified to oversee activities practiced on or off the catamaran. PERSONAL PROPERTY OF PASSENGERS I expressly acknowledge and agree that 15144680 Canada Inc. (Vessel M Legacy) is not responsible for the loss, theft, or damage of my personal belongings brought aboard the catamaran. I hereby expressly release 15144680 Canada Inc. (Vessel M Legacy) from any liability regarding my personal belongings. JURISDICTION This agreement is governed by the laws in force in Quebec. The parties agree to elect domicile in the judicial district of Joliette in Quebec. DISCLAIMER OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT I expressly consent as follows: To waive and release any claims that I may have in the future against 15144680 Canada Inc. (Vessel M Legacy), its officers, directors, employees, representatives, agents, volunteers, and vessels (hereinafter the "Releasees") from any liability, all claims or causes of action that I, my estate, my heirs, my executors or beneficiaries may have for bodily injury, property damage, or accidental death resulting from the activities, and risks mentioned above or from any other event related to the charter or participation in activities related to the catamaran, whether caused by the active or passive negligence of the Releasees or otherwise, except for gross negligence. 1. By signing this waiver, I am not relying on any oral or written representations or promises made by the Releasees, other than what is stated in this agreement. 2. I hereby declare that I am of legal age and am competent to sign this agreement or, if not, that a parent or legal guardian will sign on behalf of the minor child. The parent or legal guardian declares themselves fully 3. I take full responsibility for my own safety, including, but not limited to, following all instructions from the captain and crew during my stay on the catamaran.4. I affirm that I am physically fit to participate in my stay on the catamaran. I understand and acknowledge that the catamaran has limited medical facilities, and in the event of illness or injury, appropriate medical care must be requested by radio, and treatment may be delayed until I can be transported to a suitable medical facility. I accept these conditions. I have read this waiver and accept the risks associated with my stay on the catamaran. I fully understand the terms of this document and acknowledge that I am waiving certain rights by signing it. 5. I have signed this waiver freely and voluntarily, without any promise, threat, or coercion. My signature constitutes an absolute and unconditional release of all liability to the fullest extent permitted by law.
