1. Cancellations made within two weeks of the start of the Charter will receive a full refund, less a $250 cancellation fee. Cancellations made within two weeks of the start of the Charter will forfeit the deposit. Cancellations made within 2 days of the charter date will not receive any refund. If feasible, cancelled charters may be rescheduled for another date, subject to availability and a $250 cancellation/rebooking fee. 2. The Captain may cancel or reschedule the Charter due to unsuitable weather or mechanical problems. In such circumstances, every effort will be made to reschedule the Charter for another date. In the event the Charter cannot be rescheduled, the Charterer will receive a refund less a $250 booking fee. 3. The Charter includes use of the deck, cockpit, main cabin, and guest head of the Beneteau Sense 55 sailboat. The owner’s and guest quarters are not accessible to the Charter Party. 4. The Charter operates under the authority of the captain who has the authority to terminate the Charter in the event of unacceptable conduct by the Charter party. 5. No illegal substances or firearms are permitted onboard. Discovery of the presence and use of illicit substances and firearms will immediately terminate the Charter without refund, and the vessel will return to its homeport. 6. Smoking is NOT permitted on or in the vessel. 7. The Captain and crew shall not be held liable for any injury or fatality caused by either direct or indirect action of any crew of the boat or members of the Charter Party. 8. No trash, garbage, or other materials are to be thrown overboard. 9. Charterer agrees to pay the owner for any damage that any member of the Charter Party causes to the boat or for any lost equipment. 10. Charterer agrees to indemnify, pay the defense costs of, and hold harmless the Owner and Crew of the yacht from any claims, damages, expenses or liabilities (including without limitation reasonable attorney’s fees) arising out of the performance of this Agreement or the use of said Boat including without limitation, claims, damages, expenses or liabilities for loss or damage to any property, or from death or injury to any person or persons, in proportion to and to the extent such claims, damages, expenses or liabilities arise from the negligence or willful misconduct of Charterer, its officers, agents, or employees. 11. Charterers and guests agree to conduct themselves appropriately on the water taxi and marina property by respecting the privacy of other boats at the dock and maintaining safe and appropriate
