Delivery: We offer delivery from Maximo Boat Ramp to Clearwater, coordinating with the renter’s location for convenience. Hours: Flexible rental times available during daylight hours only. Capacity: Maximum capacity is 8 people. If you hire a captain, the group size is limited to 6 renters + 1 captain.

Waiver and Release: I acknowledge that all participants, including myself and any minors under my supervision, must complete and sign this waiver prior to boarding. This form can be completed online or at the dock before departure. Age Requirements and Rental Agreement: To operate any rental vessel, the driver must have a valid driver’s license and a minimum of two years of recent experience operating a boat of similar type and size (within ten feet of the rented vessel). The person renting the boat and the person operating it must be at least 21 years old. Anyone born on or after January 1, 1988, is required by Florida law to either hold a valid boater’s license or complete a boating safety course. If you do not currently have a license, you may take a free online course at https://www.boatus.org/florida/. Additionally, renters must have no history of marine losses in the past ten years and no violations, suspensions (including auto-related), or criminal convictions or pleas within the past five years. Both the renter—who must provide the credit card on file—and the designated boat operator must sign a separate rental agreement. These documents will be emailed to you upon confirmation of your reservation.  Cancellation Policy - Full Refund: Cancellations made at least 48 hours prior to the scheduled rental time. - No Refund: Cancellations made within 48 hours of the rental time, except in cases of inclement weather as determined solely by our company Permitted Rental Area I understand that rental boats are permitted in the Gulf of America, but must remain within 1 mile of shore at all times. Disclaimer and Legal Responsibility By signing this agreement, you acknowledge that you fully understand and voluntarily accept all risks associated with the use of any equipment or vessels provided by our company. This waiver applies to all renters, operators, and passengers using equipment supplied by our company. You agree that our company—including its affiliates, employees, officers, agents, insurers, and any associated individuals or companies—shall not be held liable for any injuries, damages, losses, or claims you or others may experience, even if caused by their negligence. You also agree to notify our company of all individuals who may operate the vessel or use the equipment. Failure to disclose any such individuals will result in you, the renter, assuming full responsibility and liability for any resulting injuries, damages, losses, or legal claims caused by or involving those undisclosed operators or passengers. By signing below, you confirm that you are accepting these terms on behalf of yourself and any minors in your care or under your supervision, including those who have not signed this agreement. You agree to assume full responsibility for their safety and actions. In the event of any conflict between this waiver and the terms of your rental agreement, the terms of this waiver shall prevail. Assumption of Risk and Liability By entering into this agreement, you fully accept and assume all responsibility for the risks associated with participating in boating activities, whether or not those risks are known or foreseeable, and whether or not they arise from negligence. This includes responsibility for injuries, accidents, illnesses, loss of personal property, or death. Your participation is entirely voluntary, and you agree to accept all consequences and expenses that may arise, both for yourself and for any minor children or guests for whom you are legally responsible. Legal Jurisdiction This agreement is governed by the laws of the United States. Any disputes or legal actions related to this agreement must be brought exclusively in the United States. You agree to reimburse by our company for any attorney’s fees incurred in the event the company must defend itself as a result of your actions or breach of this agreement. Release of Claims By signing below, you waive all rights to bring claims against our company and its affiliates for any injury, loss, or damage that may occur, even if caused by their negligence. This includes waiving claims on behalf of yourself, your estate, your minor children, and any other individuals for whom you are legally responsible. You further agree to indemnify and hold harmless the company, its operators, employees, and agents from any such claims. By signing this agreement, the renter affirms that they have received proper instruction and orientation on the safe operation of the equipment or vessel provided. The renter further confirms that they are mentally and physically capable of safely operating the equipment and participating in the activity without impairment. The renter also certifies that they do not have any medical conditions—whether physical, mental, or emotional—that could interfere with their ability to safely operate the equipment or participate in the activity. If the renter does have a medical condition that could pose a risk, they agree to disclose it to our company prior to participation. General Use and Operation The renter and any designated driver agree that the watercraft will only be operated by those listed on the rental agreement. No additional passengers are permitted unless approved in writing by our company, and any additional users must also sign the rental forms. The watercraft may not be trailered or removed from the water, nor used to carry passengers for hire. It is strictly intended for recreational use. All boating safety laws must be followed. The designated operator must wear the safety kill switch lanyard while operating the watercraft, as required by state law. Operation of the vessel under the influence of drugs or alcohol is strictly prohibited. Only individuals who have signed the rental documents and completed the orientation are authorized to use the boat. The renter is fully responsible for all equipment and items provided with the watercraft. Any items lost, damaged, or not returned will be charged to the renter’s credit card. The renter acknowledges that the watercraft may not be used at night, in race events, or to tow tubes, skiers, or other vessels. The maximum operating speed is 35 mph. Mooring must be done properly while the watercraft is not in motion. If the watercraft is beached or run aground, whether intentionally or accidentally, a minimum fee of $150 will be charged, and GPS tracking will verify location. Shallow Water Procedures In the event the boat enters shallow water, renters must: 1. Immediately raise the motor 2. Turn off the engine 3. Anchor the boat 4. Call Seth Miller at (941) - 812 - 6545 for instructions. Failure to follow these steps could result in additional damage fees. Damage Liability and Security Deposit A $500 hold will be placed on the renter’s credit card at check-in. This amount will be released 3–5 business days after the watercraft is returned in the same condition it was rented. The renter is financially responsible for all damage to the vessel, regardless of fault, and our company reserves the right to charge the renter’s card on file for any such damages. Damage estimates include propeller issues ($75–$200), motor lower unit damage ($75–$1500), dock rope replacement ($20 each), bumpers ($30 each), seats or upholstery ($175 per section), bimini top ($100–$1200), railing or floor damage ($150 per inch), punctured or fractured fiberglass ($150+), fiberglass hull damage ($150 per every 6 inches), helm controls (cost determined per incident), and ladder damage or replacement ($50–$300). Additional Terms and Responsibilities The renter assumes all liability for injuries to themselves, passengers, or third parties during the rental period, regardless of fault. Our company is not liable for any claims that arise from watercraft use. Only marine fuel purchased from our company may be used, and regular gasoline is prohibited. If the watercraft runs out of gas and fuel must be delivered, a $125 fee plus the cost of fuel will be charged. Returning the watercraft late without prior approval will result in a $100/hour fee. Arriving more than 30 minutes late may result in cancellation without a refund. It is the renter’s responsibility to watch the tides and be mindful of where the boat is anchored. If our company must come out to retrieve or tow the watercraft, a fee between $250 and $500 will be charged, depending on the distance from the boat ramp. In case of any issues with the watercraft, renters must contact us immediately. By signing this agreement, the renter confirms that the watercraft is being rented in good faith, agrees to return it in the same condition it was received, and acknowledges the policies outlined above.
