Rental Terms This vessel is offered as a private bareboat charter. The charterer is responsible for complying with all booking terms, guest rules, safety requirements, and all instructions issued by the captain and crew. Participation in a charter constitutes acknowledgment and acceptance of these terms by the charterer and all guests. Rates, Duration & Booking Structure Hourly charters are offered at $650 per hour, with a 4-hour minimum and a 12-hour maximum in a single day. Multi-day charters are offered at $10,000 per day, with a 1-day minimum and a 3-day maximum, subject to vessel availability, itinerary approval, weather, captain approval, and advance planning. All pricing, payment processing, cancellation timing, service fees, security allowance handling, and booking administration are subject to the GetMyBoat platform’s booking system and policies. Cancellation Policy This listing offers a 100% refund when canceled at least 30 days before the rental date, subject to GetMyBoat’s cancellation and platform policies. Cancellations made inside the applicable cancellation window are non-refundable unless otherwise required by GetMyBoat policy, agreed to in writing, or caused by a qualifying company/captain-initiated cancellation as described below. Weather, Safety & Captain Authority The captain has final authority over all safety, navigation, route, anchoring, swimming, water activities, itinerary, and weather-related decisions. Charters may operate in normal coastal conditions, including light rain, mist, fog, wind, swell, and typical marine weather, unless the captain determines conditions are unsafe. Weather preference, lack of sunshine, marine layer, cooler temperatures, fog, light rain, wind, or choppy conditions do not automatically qualify for refund, credit, or cancellation. If unsafe weather, unsafe sea conditions, harbor restrictions, mechanical issues, crew limitations, or other operational safety concerns prevent the charter from proceeding, the owner/captain may cancel, reschedule, alter, shorten, or return the vessel to port. If a NOAA/NWS Small Craft Advisory or higher-level warning is active for the operating area at departure time, or if the captain otherwise determines conditions are unsafe, the charter may be canceled or modified for safety. If weather or sea conditions change after departure, the captain may alter course, change destination, remain in protected waters, shorten the trip, or return to port. Charters shortened or modified after departure for safety, weather, sea conditions, guest conduct, or captain discretion are not eligible for prorated refunds unless otherwise required by GetMyBoat policy. Arrival, Late Arrival & No-Shows Guests should arrive early enough to board, get settled, complete any required paperwork, and receive the safety briefing before the scheduled departure time. Charter time begins at the scheduled start time, not when the last guest arrives. Late arrival does not extend the charter end time. If the charter group does not arrive within one hour of the scheduled departure time and has not communicated with the owner/captain, the booking may be treated as a no-show and may be non-refundable. Capacity & Bareboat Guest Limit This is a bareboat charter with a maximum capacity of 12 charter guests, not including captain and crew. Every guest counts toward the guest limit, including infants, toddlers, children, photographers, vendors, service providers, and any additional attendees. If the number of guests exceeds the permitted charter capacity, boarding may be denied and the booking may be non-refundable. Children & Minors Guests under 18 must be accompanied and supervised by a parent or legal guardian for the full duration of the charter. Children may be required to wear a USCG-approved life jacket while on deck, while underway, or at any time required by law, the owner, or the captain. Failure or refusal by a child to wear a required life jacket, or refusal by a parent/guardian to enforce the requirement, may result in denied boarding, route modification, or early termination without refund. Security Allowance & Damage Responsibility This listing has a $50,000 security allowance. This is the maximum amount up to which a renter may be charged through the GetMyBoat platform for valid claims, including but not limited to vessel damage, missing property, excessive cleaning, late return, additional agreed charges, fuel charges, overtime, guest-caused damage, vendor-caused damage, or other costs permitted by GetMyBoat policy. The charterer is responsible for all damage caused by themselves, their guests, minors, invitees, vendors, service providers, or anyone in their party. This includes damage to the vessel, decks, teak, windows, rails, upholstery, flooring, counters, appliances, fixtures, electronics, tenders, water toys, safety equipment, mechanical systems, plumbing, marine toilets, and other onboard property. If damage, cleaning, loss, overtime, fuel, or other valid charges exceed the security allowance or are not fully recoverable through GetMyBoat, the charterer remains responsible for the unpaid balance to the extent permitted by law and applicable platform terms. Guest Conduct & Captain’s Right to Terminate All guests must treat the vessel, crew, equipment, and other guests with respect. Unsafe, reckless, aggressive, threatening, intoxicated, destructive, or non-compliant behavior may result in denied boarding, route modification, return to port, or immediate termination of the charter without refund. The captain has final authority over all safety and conduct decisions. Guests must follow all instructions from the captain and crew at all times. Prohibited Items & Conduct The following are prohibited unless expressly approved in writing before departure: - Illegal drugs, cannabis, and controlled substances - Weapons, firearms, fireworks, explosives, open flames, or hazardous materials - Smoking except in areas specifically approved by the captain - Vaping except in areas specifically approved by the captain - Hard-soled shoes, high heels, or footwear that may damage decks - Drones without prior written approval - Animals, except legally recognized service animals disclosed in advance - Entering engine rooms, mechanical spaces, tuna tower, lazarettes, crew-only areas, or restricted areas - Throwing trash, food, drinks, or any material overboard Overly intoxicated guests may be denied boarding or may cause the charter to be terminated without refund. Food, Beverage & Allergies Food, beverage, catering, provisioning, and service arrangements must be coordinated and approved in advance. Guests must disclose any food allergies, medical restrictions, dietary needs, or relevant health concerns before departure. Failure to provide advance notice may limit the ability to accommodate those needs. Outside food or beverages may be restricted or require prior approval depending on the charter plan, itinerary, staffing, cleaning requirements, and vessel rules. Marine Toilets Marine toilets are sensitive and easily damaged. Only human waste and approved marine-safe toilet paper may be flushed. Do not flush wipes, “flushable” wipes, feminine products, paper towels, napkins, trash, food, or any other items. Damage, clogs, plumbing repairs, cleaning, or service calls caused by improper toilet use are the charterer’s responsibility and may be charged against the security allowance. Water Activities Swimming, paddleboarding, tender use, fishing, diving, snorkeling, inflatable use, and all off-vessel activities are subject to captain approval, weather, sea conditions, guest ability, safety requirements, and advance planning. Participation in water activities is at the guest’s own risk. The captain may restrict, delay, modify, or prohibit any water activity for safety reasons. Vendors, Photographers & Special Services Outside vendors, including photographers, videographers, caterers, chefs, bartenders, entertainers, decorators, DJs, musicians, or other service providers, require advance approval before departure. Vendors may be required to provide proof of insurance, including general liability coverage and any additional insurance requested by the owner/operator. The charterer is responsible for all vendor conduct, vendor damage, vendor equipment, cleanup, and compliance with vessel rules. Electrical equipment, decorations, drones, cooking equipment, flames, balloons, adhesive materials, confetti, glitter, or other event materials must be approved in advance. Photography, Video & Marketing Guests are encouraged to take photos and videos for personal use. Commercial photography, professional production, drone use, promotional filming, influencer shoots, brand shoots, or paid content creation must be disclosed and approved in advance. By participating in the charter, guests acknowledge that incidental photography or video may occur for safety, operational, or promotional purposes unless otherwise agreed in writing before departure. Personal Property The owner, captain, and crew are not responsible for lost, stolen, wet, dropped, broken, or damaged personal property. Boats are moving, wet environments. Guests should secure valuables and avoid bringing unnecessary valuables onboard. Medical Conditions & Mobility Guests must disclose any medical condition, pregnancy, mobility limitation, severe motion sickness, heart condition, respiratory issue, recent surgery, injury, disability, or other condition that may be affected by boating at least 72 hours before departure. Guests should consult a physician before participating if they have any medical concern that could be affected by boating, vessel motion, sun exposure, water activities, or limited emergency access while underway. Force Majeure The owner/operator is not responsible for cancellations, delays, route changes, shortened trips, or operational limitations caused by circumstances outside reasonable control, including but not limited to weather, sea conditions, wildfires, earthquakes, flooding, harbor closures, Coast Guard restrictions, government orders, public health emergencies, mechanical issues, fuel shortages, labor shortages, acts of God, civil unrest, or other force majeure events. In such situations, remedies, if any, will be handled according to GetMyBoat policy and any written agreement between the parties. Waivers & Assumption of Risk Boating, coastal cruising, swimming, diving, paddleboarding, tender use, and other marine activities involve inherent risks, including vessel motion, slippery surfaces, changing weather, wakes, currents, cold water, sun exposure, limited emergency access, and other hazards. All guests may be required to sign liability waivers before boarding. Refusal to complete required waivers may result in denied boarding without refund. Final Authority The captain’s decisions are final regarding safety, navigation, guest conduct, weather, water activities, anchoring, itinerary, and vessel operation. Failure to comply with captain or crew instructions may result in denied boarding, route modification, early return, or termination of the charter without refund.
