Staffing, weather, port, and mechanical conditions permitting], on the date and times stated above for up to 49 passengers with a crew as required by law on the following terms: - Charges and payment instructions: The charges for this charter are set out below. You agree to pay the charges in advance on booking. Until a contract is signed, a card is authorized, and those charges have cleared the bank, anyone else can book the boat for the date and time you are seeking. Once the card charges clear, that date and time are yours. Your exclusive use of the vessel is confirmed when the vessel charges have been paid and confirmed, usually by sending a copy of the receipt. A refund is issued only if we cancel the charter and we are unable to agree on another date for your charter. In the event you cancel, we will attempt to secure another charter to replace yours, in this same time frame, and a refund is only issued if we secure a replacement. - The captain has control of the vessel, course, and passengers' conduct as necessary for safety. In the event the captain determines safety to be an issue due to staffing, weather, conduct, conditions, or mechanical conditions to prevent the vessel from sailing, and you wish to exit the vessel, you will receive a full refund and nothing more. - Damage to the vessel, the vessel's furnishings, and/or equipment will be your financial responsibility. This includes any damage by your guests or those permitted on the vessel by you. - Time: If the vessel cannot or does not sail for any reasons other than you have declined the opportunity, you will have the option to select another date. If the vessel should be delayed due to our fault, we will extend your cruise time to compensate for the lost time. Should you, the customer, request a delay in departure, your cruise time will not be extended and we will return to port at the original time designated. - Insurance: We hold general liability insurance and have provided to South Beach Harbor, a certificate of liability insurance for the operation of the vessel. - Intoxication & alcohol possession: We reserve the right to refuse access to beverages to any guest who is under the age of 21 or who is apparently intoxicated. We hold an on-sale alcohol license issued by the California Alcohol Beverage Commission, which mandates that all alcohol be brought on and served by us. We cannot permit any alcohol to be brought onto the vessel except for those subject to corkage charges that have been approved prior to your charter. At all times, safety on the vessel and that of the passengers is first and foremost, hence we may decide to restrict movement and activities of any passenger who we are concerned for their safety. Additionally, the US Department of Transportation prohibits smoking on any vessel, which includes tobacco and/or vaping. - Excused non-performance: If for any reason beyond our control, including, but not limited to, weather, bay conditions, strikes, labor disputes, accidents, government requisitions, restriction or regulations on travel, vessel operation, vessel condition or equipment, commodities or supplies, acts of war, or acts of God, we are unable to perform our obligation under this agreement, such non-performance is excused and we may terminate this agreement without further liability of any nature. In no event will we be liable for consequential damages of any nature for any reason whatsoever. If, for any reason, the vessel reserved here is not available for the charter, we may, and are not required to, substitute another vessel capable of chartering for your passenger count and you agree to accept such substitution. - Unlawful activity: Gambling activities, the use of illegal drugs, disrobing, or any unlawful activity are prohibited. A violation of this provision by the charterer or its guests shall be grounds for immediate termination of the charter and return to the port with no refund. - Security & searches: The captain is responsible for the security of the vessel, crew, and passengers and has the right to inspect all persons, packages, and baggage brought on board the vessel with or without probable cause. The captain may require any passengers to leave any items at port until the completion of the charter if the captain deems it in the best interest for the security of the vessel, crew, passengers, and/or compliance with regulations. - Indemnification: To the extent permitted by law, you, the customer, agree to protect, indemnify, defend, and hold harmless and its respective directors, employees, and agents against any claims, losses, or damages to any persons or property, governmental charges or fines, and costs arising out of or connected with the charter. You agree to any charges, fees, or fines incurred by reason of your conduct or the conduct of your guests. Please note that jumping overboard by a passenger has historically secured a fine by the US Coast Guard of between $5,000 and $15,000, which the passenger and host have been charged. Please advise all of your guests of this fine. - The excursion: We will load passengers on the vessel one-half hour before leaving the dock and will use that time to perform our safety check and safety speech. We will then leave the designated dock at the appointed hour traveling around San Francisco Bay to see the sights, sunset, and sounds of SF Bay. We will return as agreed or sooner, if you so desire, for passengers to leave. Please tell each of your guests that in preparing for a charter, it is advisable to wear layered clothing and flat shoes without heels. Shoes with tall heels tend to cause injury, especially on a surface, such as a boat, where it is constantly in motion. Depending on weather, at one point in the excursion, you may have everything on, and later find it warms up on other points of the Bay. Being prepared for changing weather on the Bay is the responsibility of you and your guests.
