TERMS AND CONDITIONS Water Activities Risks. Renter Acknowledgements and The Owner. Renter acknowledges that participation in kayaking activities involves known and unanticipated risks, including physical or emotional injury, drowning, or damage to property. Renter understands that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. General Rules. In addition to the terms set forth in the Agreement and other provisions of these Terms, the Rental is conditioned on and shall be governed by the following rules: - Operate the Kayak with both hands on the paddle and remain seated. Passengers shall maintain both feet on the Kayak and remain seated. -The Kayak has a weight limit of 375 lbs, and Renter shall not exceed this limit. The Kayak has two seats, and Renter shall not allow more than two riders at a time. - Renter is advised to operate the Kayak at their current skill level. - Do not attempt to splash or spray any other person or vessel. - Inform The Owner of any damage during the Kayak's check-in. - No wake creation within marina or beach areas. - No towing of other watercraft, vessels, persons, or objects. - Do not leave the Kayak, or its equipment unattended. - Follow posted directions and safety rules on the Kayak. - Do not attempt repairs to the Kayak without prior consent - No refunds for early returns. - Renter is responsible for any damage to the Kayak or other property. Required Age. The Renter shall be at least 18 years of age. If the Renter is under 18, a parent or guardian must also execute the Agreement. Authorized User. Subject to The Owners discretion, the Renter may permit one Authorized User to operate the Kayak, designated at or before the Rental. Banned Substances. Usage or possession of narcotics, marijuana, alcohol, or illegal substances will terminate the Rental with forfeiture of all amounts paid. Weather. Owner is not responsible for inclement weather, and no refunds will be provided for early returns due to weather. Release and Hold Harmless. Renter agrees to release, forever discharge, and hold harmless The Owner from any liabilities, claims, damages, or expenses related to the Kayak rental. Default. Violations of laws, regulations, or rental terms will result in forfeiture of the rental payment and deposit, with Renter responsible for any damage. Renter’s Representations, Acknowledgments, and Warranties. Renter acknowledges adequate insurance coverage, assumes the risk of any medical conditions, and certifies the Kayak's condition. Included Items. The Kayak comes with life vest flotation devices. Flotation Devices. Life vests must be worn at all times. Renter is responsible for obtaining and using compliant life vests. Grant of Access. Renter grants us the right to enter the property for Kayak delivery, pick-up, or repossession. Emergencies and Functional Issues. In emergencies, call 911. Use of Materials. The Rentee has permission to use pictures for references and advertisement. Unenforceability. If any provision is unenforceable, it shall not affect the validity of the remaining provisions. Heirs and Successors. These Terms and the Agreement are binding on heirs, successors, and assigns. Opportunity to Review. Renter had sufficient time to read and understand the Agreement and these Terms, executing them freely. Governing Law; Forum. This Agreement is governed by the laws of California, with any disputes heard exclusively in a California court.
