Charter Terms and Conditions - Fox-Sea Roxy The following terms and conditions govern your charter of the 38' Chris Craft sports cruiser, Fox-Sea Roxy. By booking a charter, you agree to these terms. 1. Weather Cancellation Policy: - Charters may be canceled by the owner/captain due to unsafe weather conditions, including but not limited to small craft warnings issued by Environment Canada, high winds exceeding 21 knots (i.e. strong wind warning), heavy rain that significantly impacts visibility or safety, or the presence of thunderstorms in the vicinity of the planned route. - The decision to cancel due to weather will be made by the captain, typically no later than 2 hours prior to the scheduled departure time. However, the captain reserves the right to cancel at any time if conditions become unsafe. - In the event of a weather-related cancellation initiated by the owner/captain, you will be offered the option of a full refund or the opportunity to reschedule your charter for a mutually agreed-upon date within the current boating season (typically May to October). Rescheduling is subject to availability. - Light rain or overcast conditions will not necessarily result in a cancellation. The determination of unsafe conditions rests solely with the captain. 2. Late or No-Show Policy: - A grace period of 15 minutes will be provided for late arrivals from the scheduled departure time. - If the charterer has not arrived within the grace period and has not provided prior notification, it will be considered a no-show. In the event of a no-show, the booking fee is non-refundable. - If you anticipate being late, please notify us as soon as possible by messaging the captain on WhatsApp. - If you arrive late but within a reasonable timeframe (as determined by the captain), the charter duration will not be extended beyond the originally scheduled end time unless explicitly agreed upon, subject to availability and potential additional charges. 3. Safety Considerations and Boat Rules: - The captain has the ultimate authority on all matters concerning the safety of the Fox-Sea Roxy and its passengers. All instructions from the captain and crew must be followed without question. - The following activities are strictly prohibited onboard: - - Illegal drug use. - Excessive alcohol consumption leading to unsafe behaviour. - Standing on seats, the gunwales, or any area not designed for standing. - Tampering with or damaging any of the vessel's equipment. - Discharging any items into the water, except as permitted by law (e.g., biodegradable waste in certain areas). - Life jackets are provided for all passengers. Children under the age of 12 years are required to wear a life jacket at all times when the vessel is underway. Passengers are encouraged to wear life jackets at any time they feel necessary. - The maximum number of passengers permitted on the Fox-Sea Roxy is 12. This limit must be strictly adhered to. - The charterer is responsible for any damages to the Fox-Sea Roxy or its equipment caused by negligence or intentional misuse by the charterer or their guests, beyond normal wear and tear. The cost of repairs will be the responsibility of the charterer. A security deposit of [Specify Amount, if applicable] may be required prior to the charter to cover potential damages. - Swimming from the Fox-Sea Roxy is permitted at the captain's discretion and only when the engine is completely off and in a designated safe area. Passengers entering the water do so at their own risk. Climbing on the swim grid while the engine is running is strictly prohibited. 4. Other Terms: - Charterer is welcome to bring their own food and non-red wine beverages. Please no glass bottles. - Pets are permitted onboard. - Gratuity for the captain and crew is appreciated but not required. - The planned itinerary is subject to change at the captain's discretion due to weather conditions, safety concerns, mechanical issues, or other unforeseen circumstances. - All charter guests will be required to sign a liability waiver before the start of the charter. - This agreement shall be governed by the laws of the Province of British Columbia, Canada. Any disputes arising under this agreement shall be resolved in the courts of British Columbia.
