BOAT RENTAL AGREEEMENT I am aware that the use of watercraft in any waterway can be hazardous, and I assume all risks of injury, loss of life, and damage to person and property during such use, fully realizing that The company, or its agents have no control over the manner of use or the condition of any waterway, and I agree to release and to pay for, defend, indemnify and hold The company, or its agents, employees, successors, and assigns harmless from all liabilities, claims, and demands for loss, damage, or injuries to persons and property sustained by me, my heirs, children, dependents, and all other persons resulting from or in any way connected with transporting or use of the watercraft equipment furnished by The company, its agents, successors, and assigns in enforcing any obligations under this agreement. I specifically acknowledge and agree that the above release and indemnity includes and extends to, without limitation, any and all liability, claims, and demands for loss, damage, or injury to persons or property sustained by me, my heirs, children, dependents, and all other persons resulting from any use of waterskiing equipment or any other water sports activities undertaken by me or others with me with the full understanding that The company has not furnished any such equipment to me or sanctioned its usage. This release and indemnity is in addition to and not by way of limitation to any other release or indemnity I am making. I understand that the use of the watercraft and equipment furnished by The company constitutes an acceptance of said equipment on a rental basis "AS IS." I agree to pay for any damage done to said equipment or property of others. If I fail to return any or all of said equipment, including: Anchor & rode, dock lines, VHF radio, depth finder, AM/FM stereo, fire extinguisher, flares, whistle or horn, & pfd's (life jackets), I will reimburse The company for the full amount of the replacement cost. I agree to let no person(s) under the age of 25 years operate this watercraft. I further agree that no person(s), regardless of age, shall operate the watercraft without having first received pre-rental instruction pursuant to Florida State law 327.54 F.S. Any person born on or after January 1, 1988, must have a safe boating certificate to operate a vessel in the State of Florida. I, as parent or guardian or supervisor of a minor child, make this agreement individually and on behalf of this minor child to induce The company to allow the child to ride in a watercraft. It is understood that I am signing for the liability for all members in my party. I understand that Federal law requires that children under 6 years of age wear a life jacket at all times, and it is recommended that all persons wear a life jacket while underway. I agree to limit the number of passengers and gear to NO MORE THAN the number of passengers and/or weight specified on the United States Coast Guard capacity placard affixed to the vessel. I agree to assume the cost for all fuel and oil consumed by the watercraft. I further agree not to take said watercraft out of bay waters and agree that under no circumstances will I take said watercraft into the Gulf of Mexico. No vessel shall be operated after dark, defined as: from 30 minutes prior to sunset until 30 minutes after sunrise (Unless booked as a multi-day rental). There is a 10-minute grace period. After the grace period, I will be charged $2.50 per minute for any additional time. Please observe NO WAKE LAWS and all other boating laws. Failure to do so may result in a fine. I am responsible for following proper navigation and safe boating practices. Furthermore, I understand that I will be responsible for all towing and recovery fees resulting from my improper use and/or navigation of said watercraft. I certify that I have received pre-rental instruction pursuant to Florida state law 327.54 F.S., which includes but is not limited to: Operational characteristics of the watercraft, safe vessel operation and right of way, responsibility of the operator for safe operation, and local characteristics of the waterway where the vessel will be operated.
