Cancellation Policy: 2.1. Cancellations made by the client more than 30 days prior to the rental date will receive a 100% refund. 2.2. Cancellations made between 6 and 30 days prior to the rental date will receive a 50% refund. 2.3. Cancellations made within 5 days of the rental date are non-refundable. Late Arrival: 3.1. Clients must arrive at the designated embarkation point at the agreed-upon time. A grace period of 5 minutes will be granted for late arrivals. 3.2. If the client arrives after the grace period, the rental period will not be extended, and the client will be responsible for the full booking amount. 3.3. Early trip returns do not entitle the renter to a refund. No-Show: 4.1. A client is considered a no-show if they fail to arrive at the designated embarkation point within the agreed-upon time without prior notification. 4.2. In the case of a no-show, the client forfeits the entire booking amount, and no refunds will be provided. Notification of Delays: 5. The client must keep the rental yacht company informed of any changes to charter details, including but not limited to charter time, the number of guests, or other relevant information. Notification should be made as soon as possible, and the yacht company will make reasonable efforts to accommodate changes if feasible. Failure to communicate changes promptly may result in additional charges or limitations. Captain, Crew & Fuel: 6. A licensed captain and crew are included in the rental fee. The cost of fuel is included in the rental price. Safety Regulations: 7.1. The renter and guests must adhere to all safety regulations provided by the captain and crew. Inappropriate behavior, including excessive alcohol consumption, will not be tolerated. The captain reserves the right to enforce safety measures and take necessary actions to ensure the well-being of passengers and crew. 7.2. Clients are prohibited from engaging in any illegal activities, including the consumption of illegal substances, while on board. Any breach of this policy may result in the immediate termination of the charter without a refund. 7.3. Clients are encouraged to obtain travel insurance covering potential risks and liabilities. 7.4. Clients must adhere to environmental guidelines, including waste disposal, to minimize the ecological impact of the charter. Changes by Yacht Rental Agency: 8.1. The yacht rental agency reserves the right to make changes to a booking in the event of unforeseen circumstances, including mechanical failures, safety concerns, or other operational issues. 8.2. In the event of a necessary change, the yacht rental agency will make reasonable efforts to provide notice to the client as soon as possible and offer alternatives, such as rescheduling the booking, providing a replacement vessel, or offering a refund. If the client is unable or unwilling to accept proposed changes, a full refund of the booking amount will be provided. The yacht rental agency assumes no additional compensation or liability for changes due to unforeseen events. Force Majeure: 9.1. The yacht rental agency is not liable for any failure or delay in performance under this agreement due to circumstances beyond its reasonable control, including acts of God, natural disasters, government actions, or other unforeseen events. 9.2. In the event of severe weather conditions, the yacht rental may be rescheduled or canceled at the discretion of the rental company. Extension of Booking: 10.1. If the client wishes to extend the booking on board the yacht, the extension is subject to approval, vessel availability, and local regulations' maximum operating hours. The client must request an extension at least 60 minutes before the scheduled end time. 10.2. All payments for additional hours must be settled through the official payment channels provided by the yacht rental agency. Payments to the crew for additional services require explicit approval and instruction from the yacht rental company. Under no circumstances should the client make direct payments to the captain or crew for the extension without prior approval, as this may result in the immediate termination of the charter without a refund, and the client may be held responsible for any resulting damages or losses incurred by the yacht rental agency. Beach Stopover Clause: 11.1. If the client decides to make a stopover at a beach or beach club during the charter, the agreed-upon return time to the yacht must be honored. If the client wishes to extend the stopover time beyond the initially agreed-upon schedule, additional hours will be incurred, and payment must be made immediately using the payment method agreed upon during the initial booking. Failure to pay for additional hours related to the beach stopover may result in the yacht departing the beach location before the end of the initially agreed-upon charter time. The yacht must return to the marina at the agreed-upon time initially booked, and any delays caused by the beach stopover will be at the client's expense. Guest Count: 12.1. The client is permitted to bring on board the number of guests initially booked for the charter. No refund will be offered for unused capacity if the actual number of guests is less than booked. 12.2. If the client brings more guests than initially booked, additional payment must be settled immediately using the agreed-upon payment method during the initial booking. Failure to make the additional payment for extra guests may result in penalties, and the yacht rental agency reserves the right to take appropriate action, including the termination of the charter. 12.3. The total number of guests on board must not exceed the maximum legal limit set by local regulations. Seasickness Provision: 13. In the event passengers experience seasickness or discomfort during the charter, they have the option to request an early end to the charter and disembark at the nearest land or beach accessible by the vessel. Any lost time due to the early termination of the charter because of seasickness cannot be refunded, and the originally booked charter period remains unchanged. The decision to end the charter early due to seasickness is at the sole discretion of the passengers, and the rental yacht company is not responsible for any resulting inconveniences or additional costs incurred by the passengers. Items Permitted and Restricted On Board: 14.1. Clients are allowed and encouraged to bring personal belongings such as clothing, swimwear, sunscreen, and personal care items on board. The consumption of food and beverages brought on board by clients is permitted unless otherwise specified by the captain or crew for safety or regulatory reasons. 14.2. Clients are prohibited from bringing any illegal substances, hazardous materials, or items that may pose a risk to the safety and well-being of passengers, crew, or the vessel. The captain and crew reserve the right to inspect and restrict the possession of any items that may pose a safety risk or violate maritime regulations. Parental Responsibility: 15. Parents or legal guardians are fully responsible for the supervision and behavior of their children while on board the yacht. Children must be accompanied by a responsible adult at all times, especially when moving around the vessel or engaging in water-related activities. Any damage caused by the actions of children on board is the responsibility of the parents or legal guardians, and they may be held liable for associated costs or repairs. Confidentiality of Contact Information: 16. The exchange of personal contact details between clients and the captain/crew is strictly prohibited to maintain privacy, security, and professionalism. The client acknowledges and agrees not to exchange personal contact details, including phone numbers, email addresses, or social media accounts, with the captain or any member of the crew during the charter. Any information or coordination related to the charter should be conducted through the designated channels provided by the yacht rental agency. Damages and Liabilities: 17.1. The renter is responsible for any damages to the yacht or its equipment caused by negligence or misconduct. 17.2. The yacht rental company is not liable for any injuries, accidents, or loss of personal property during the rental period. Governing Law: 18. These terms and conditions are governed by the laws of Mexico. By booking a yacht rental, the renter agrees to abide by these terms and conditions.
