    Had a great sail with Captain Martin and Caleb for my birthday with family. Would recommend a sail on the Saga to anyone looking for a local adventure with a fun and accommodating crew.

    Captain Martin and his First Mate Caleb were truly phenomenal to boat with. I booked this in order to propose to my significant other. Captain Martin called me a week in advance to discuss my plan and itinerary. He allowed my friends onboard prior to departure to set up the boat with some decorations as well and he was very understanding of the route I had chose and plan for proposal. My significant other was truly blown away! She and I loved every minute of the experience and the friendliness offered from these two outstanding gentlemen. We truly had an experience like no other despite the COVID-19 times we live in. Captain Martin was also understanding of my photographer, (@sphotoanddesign) and allowed him to take photographs from all angles. Overall a 10/10 experience, highly cost-effective, would recommend! Captain Martin will be my first choice if ever sailing again in NYC.

    Martin and Kara were great hosts on the boat. Provided clear instructions to locate the boat. Kara was very helpful with serving the food and beverages we brought on board. Boat was clean and just what we expected. This comfortably fits 6 people and crew and makes a great sailing experience.

WEATHER POLICY Each sail is flexible in nature due to tides, winds and other weather conditions. GSNYC will do their best to stick to the sailing schedule but cannot be held responsible for sails that end earlier or later than scheduled. There are no full or partial refunds for sails ending prior to the scheduled arrival time. GSNYC reserves the right to cancel any sail due to mechanical failure and/or adverse weather conditions. Adverse conditions include but are not limited to: excessive winds, thunder and lightning storms, small craft advisory, and other extreme conditions. Only the Captain can cancel a sail. Cancellations due to adverse weather conditions or mechanical failure can be rescheduled during the same year's sailing season ending October 31, subject to availability. No refunds will be issued. Rescheduled sails are not able to be changed, cancelled or refunded. CANCELLATION POLICY Cancellations 6 days or more prior to the scheduled sail will receive a refund minus a 15% service fee. Cancellations within 5 days of the scheduled sail are not eligible for refund. On the day of your sail, don’t miss the boat! Please arrive five minutes early for boarding. All passengers must complete the sailing waiver and show valid photo ID prior to boarding. We try to cast off five minutes past your scheduled sailing time. Due to a tight sailing schedule, if you do not arrive by five minutes past your scheduled departure, there is no refund. If someone in your party is late or does not show up, there is no refund. TERMS & CONDITIONS With GSNYC, safety is the priority. GSNYC recommends that you wear a USCG approved Life Jacket. If you want to wear a Life Jacket one will be made available. Adults 18 years old and up have the sole responsibility to decide if they want to wear a Life Jacket. Passengers under the age of 18 must be accompanied by a parent or guardian. Parents or guardians are responsible for determining if a minor ages 14-17 must wear a Life Jacket. New York State law requires persons 13 years of age and under to wear a Life Jacket. USCG requires all infants and children, regardless of age, to be considered in the six person maximum. For your safety, smoking, vaping, e-cigarettes are not allowed onboard. Beverages sometimes spill while sailing. Do not bring red wine or any beverages that could stain the boat or cause damage. The lavatory is onboard for our comfort. Boat toilets (heads) are notoriously easy to damage. Do not put anything down the toilet except 3 sheets of toilet paper. Privacy Policy and Personal Information: During reservation and registration, GSNYC may collect personal contact and/or transaction related information for GSNYC use only. GSNYC may also collect collect certain website usage data. GSNYC will not sell, share, or otherwise distribute this information to any third party without your consent and knowledge. Any film or photographs of you/your child, as participants, become GSNYC property and may be used for promotional or commercial purposes. ACKNOWLEDGMENT OF RISK There are significant elements of risk in any adventure, sport or activity associated with a working sailboat. By entering the premises of and/or accepting transit aboard a vessel owned or operated by GSNYC, you acknowledge that you are riding on a working sailboat that has inherent dangers associated with it and hereby exempts and releases GSNYC, their officers, members, agents, servants and employees from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties. You acknowledge that the following describes some, but not all of the risks one can face while aboard a vessel. 1) Slips, trips, falls or painful crashes while aboard the vessel and using the facilities; physical demands involving moving about the vessel. Risks to moving about the vessel on deck, below deck, or in the bathroom facilities: 2) Misuse of the equipment of facilities or failure of equipment: 3) Users (your) physical strength, coordination, sense of balance, and ability to follow or give directions while moving about the vessel: 4) Fatigue, chill and/or dizziness, which may diminish the users (your) reaction time and increase the risk or accident: 5) Injury from entanglement with ropes or equipment: 6) The presence, actions or falls of other participants. The user (you) understand(s) the descriptions of these risks is not complete and that other unknown or unanticipated risks may result in injury, illness, or death. The user (you) understand that the user (you) will use good judgement to be aware of my surroundings at all times. In addition, you agree to hold GSNYC harmless to possible injury, physically or mentally or even die. ASSUMPTION OF RISK & RESPONSIBILITY In recognition of the inherent risks of sailing which you and any minor children for which you am responsible, will engage in, you confirm that you are physically and mentally capable of participating in the activity and/or using equipment. You participate willingly and voluntarily and assume full responsibility for personal injury, accidents and illness (including death), and any related expenses. You also assume responsibility for damage to or loss of your personal property. You recognize that GSNYC, as a provider of services, will operate under a covenant of good faith and fair dealing, but that GSNYC may find it necessary to refuse or terminate, passengers GSNYC judges to be incapable of meeting the rigors or requirements as a passenger. You accept GSNYC’s right to take such actions for the safety of yourself and/or other passengers. You hereby authorize any medical treatment deemed necessary in the event of any injury or illness while participating in this activity. You either have the appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services as may be incurred on your behalf. RELEASE OF LIABILITY Any claim of damage shall be governed by Federal Maritime law. In any action against GSNYC, or its officers, members, agents, partners, employees, or servants which results in a judgment, decree, order, stipulation or settlement substantially upholding GSNYC’s position, the adversarial party shall reimburse GSNYC attorney’s fees, court costs and expenses. You have read and understood the foregoing acknowledgment of risk, assumption of risk and responsibility, and release of liability. You understand that by signing this form you may be waiving valuable legal rights. COVID-19 POLICY In consideration of being allowed to board the vessel of GSNYC, you understand, acknowledge and agree to the following: The novel coronavirus (“COVID-19”) has been declared a worldwide pandemic by the World Health Organization and is considered extremely contagious. You agree, represent and warrant that you will not board GSNYC’s vessel within 14 days after (i) exposure to any person who has a suspected or confirmed case of COVID-19, and/or (ii) experience symptoms of COVID-19, and/or (iii) has a suspected or diagnosed/confirmed case of COVID-19. You agree to notify GSNYC immediately if you believe that any of the foregoing access/use restrictions may apply. You agree to (i) wear acceptable face coverings while less than 6 feet from GSNYC personnel, and (ii) wear face coverings while in the boat cabin below deck at all times. Acceptable face covering as defined by New York State as any well-secured paper or cloth that covers your nose and mouth. A face covering with an exhalation valve is not acceptable as it allows unfiltered exhaled air to escape to others. If you do not have an acceptable face covering, GSNYC may offer acceptable face coverings. If you refuse to wear an acceptable face covering, you will not be allowed to board GSNYC’s vessel and you will not receive a full or partial refund. GSNYC is taking certain steps to implement recommended guidance and protocols for slowing the transmission of COVID-19 issued by public health agencies (World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), and New York State Department of Health). GSNYC may revise its procedures at any time based on updated recommended guidance and protocols issued by the public health agencies. You understand and voluntarily accept and assume all the foregoing risks related to COVID-19 and accept sole responsibility that you may be exposed to or infected by COVID-19 by boarding GSNYC’s vessel, and that such exposure or infection may result in personal injury, illness, permanent disability, and death to yourself, your spouse, guests, unborn child, or relatives. Further, you understand and agree that this release includes any Claims based on the actions, omissions, or negligence of GSNYC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after boarding GSNYC’s vessel.
