Conditions, Liability Release, and Assumption of Risk In consideration of the services provided by Float My Boat Rentals LLC (hereafter “FMBR”), including its agents, officers, owners, employees, and representatives, I, the undersigned, on behalf of myself, my spouse, children, heirs, assigns, and estate, agree as follows: 1. Vessel Operation & Responsibility I certify that I am experienced and capable in the operation of the rented vessel and agree not to exceed its designated passenger capacity. Only designated drivers may operate the vessel. I agree to return the vessel in the same condition as received, except for normal wear and tear. I accept responsibility for all damage, loss, or cleaning fees due to misuse, negligence, or acts of nature. I agree to pay $200/day for loss of rental use (up to 15 days) while the vessel is out of service due to damage caused by me or other approved drivers, in addition to repair or replacement costs. 2. Operating Rules I agree to the following: FMBR will provide a safety and operations orientation at pickup. I will use a proper tow vehicle to transport the vessel. I will not operate the vessel: In a reckless manner or while under the influence of drugs or alcohol. Between sunset and sunrise. In violation of local boating laws. Beyond my skill level or for racing or towing other vessels. I will remain aware of hazards (e.g., shallow water, weather, other vessels). I will not leave the vessel or trailer unattended and will secure it properly. No refunds will be issued for early returns or inclement weather. No pets unless pre-approved; $100 non-refundable fee applies, and any pet-related damage will be deducted from the security deposit. No smoking on the vessel. Damages will be deducted from the deposit. 3. Liability & Insurance I understand that use of the vessel involves inherent risks, including but not limited to collision, drowning, and injury. These risks cannot be eliminated without altering the nature of the activity. I release and hold harmless FMBR from all claims related to injury, property damage, or death arising from my use of the vessel, including those of my guests or third parties. I am responsible for supervising the vessel and its proper use at all times. I affirm I have sufficient insurance coverage, or I accept full liability for injury or damage. I will not loan, sublet, or allow unauthorized use of the vessel. Legal disputes will be governed by the laws of the State of Utah and resolved therein. I have had sufficient time to read and understand this agreement and agree to its terms voluntarily. I am responsible for any recovery costs resulting from my negligence. I will pay any fines, impound fees, or tickets issued during the rental period. The vessel will be full of fuel upon pickup. I agree to return it full using 91 octane or higher or allow FMBR to refill it at current market rates. 4. Charges, Damages & Legal Remedies I authorize FMBR to charge my credit card for all rental fees, deposits, equipment, and any damage incurred. If I dispute charges through my financial institution, FMBR reserves the right to seek a legal judgment. I will be responsible for all legal fees and costs. Failure to enforce any part of this agreement does not constitute a waiver unless in writing. I am liable for all damage, theft, or loss, regardless of cause or fault (excluding normal wear and tear), including diminished value and administrative costs.
