- Guests will receive a full refund minus a $100 booking fee if canceling more than 60 days prior to their arrival date. - Guests canceling between 59 days to 30 days prior to their arrival date will receive a 50% refund. - Guests canceling less than 30 days prior to their arrival date will not receive a refund. This cancellation policy is driven by the very short operating season (less than 100 days) and the near impossibility of filling cancelled dates on short notice. However, if we are able to book the boat for the cancelled day, we will give a full refund to you. Lessee waives any and all claims which may arise against Lessor and release Lessor from all liability for personal injury, death, property damage or any other loss Lessee sustains as a result of using specified boat due to any cause whatsoever including, without limitation, negligence on the part of Lessor. Lessee further agrees to indemnify and hold harmless the company for any and all legal fees or costs which Lessor may incur in defending any such lawsuit or claim Lessee may bring. The contract is amended as follows: A. It is the renter's responsibility to fill up the fuel tank PRIOR to returning the boat to its slip. If tank is not completely filled, a $100.00 convenience fee will be charged to your on-file credit card, plus market rate per gallon of gas required. Boats not in the slip at 8:30 PM will incur a $60.00 charge (dollar/minute) per hour in addition to fuel. B. Shore landing is prohibited as is operating the boat in areas which become unnavigable at low tide. Unauthorized beaching of the boat will incur an automatic $1,000.00 charge to your credit card on file, plus any damages and related costs of recovery and/or rescue as required. C. Boats must be returned free of all fish scales, blood, trash, debris, etc. If the boat does not meet the Lessor's standards, a cleaning fee will be applied at $75.00/hr with a minimum charge of 1 hour. D. Once a boat leaves the harbor and mechanical difficulties arise, a refund of 50% of that day's rent will be made. Normal fuel charges apply. E. In the event of damage or lost equipment, you are authorizing the company to charge your on-file credit card the Lessor's estimate of damages including, but not limited to the estimated cost of repair for physical damage, replacement of equipment, fuel charges, costs of trailering boat to repair facility, cost of towing, salvage environmental cleanup costs and lost rental revenue due to damage or missing equipment. When the final actual costs are tallied, Lessor will charge or refund the residual difference between the paid estimate and actual costs. Unpaid charges will be pursued for collection through legal action. Any lawsuit, judicial proceeding, or any other action concerning this contract or provisions hereof shall be instituted only in the State of Alaska. Parties acknowledge that they understand all the terms of this contract as amended and furthermore agree that this contract as amended shall be governed by the laws of the State of Alaska, both as to its interpretation and performance.
