TERMS AND CONDITIONS Disclaimer: This Agreement applies to all renters, operators, passengers, and users of equipment provided by our company. The term “our Company” includes all principals, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers, and subsidiaries of our company. If any other rental agreement is supplemented with this Agreement, the provisions herein will prevail over any inconsistent clauses in the rental agreement. The undersigned acknowledges they are also signing this Agreement on behalf of their minor children and agrees to disclose to the Rental Company all potential operators, passengers, and users of the equipment. Failure to disclose such information renders the undersigned personally liable for any damages to undisclosed individuals, even if such damages arise out of the negligence or fault of the Rental Company.   Acknowledgment of Risks: The undersigned acknowledges that participating in watersport activities involves inherent risks, including but not limited to: Changing water flow, tides, currents, wave action, and boat wakes. Collisions with other participants, watercraft, and natural or manmade objects. Capsizing, sinking, or other hazards resulting in injury, exposure to elements, hypothermia, drowning, and/or death. Encounters with insects and marine life forms. Equipment failure or operator error. Personal physical limitations affecting balance, coordination, and ability to operate equipment or swim. Wind, inclement weather, lightning, and temperature extremes. Heat or sun-related injuries or illnesses, including sunburn, sunstroke, or dehydration. This list is not exhaustive, and the undersigned accepts that unknown or unanticipated risks may result in injury, illness, or death.  Express Assumption of Risk: The undersigned agrees to rent, operate, or use the equipment provided by the Rental Company at their own risk and voluntarily participates in all related activities. Full responsibility is assumed for risks of personal injury, accidents, or illnesses, including but not limited to sprains, torn muscles or ligaments, fractures, eye damage, cuts, wounds, scrapes, abrasions, contusions, head, neck, and spinal injuries, insect or animal bites or attacks, shock, paralysis, drowning, and/or death, and any resultant expenses. All risks of injury, illness, damage, or loss are assumed, regardless of the cause, even if arising from the negligence or fault of the Rental Company.   Waiver/Release of Liability: By executing this Agreement, the undersigned voluntarily releases, forever discharges, and agrees to indemnify and hold harmless the Rental Company from any and all liability for injury or damage arising from personal injuries sustained by the undersigned or any minor children under their custody, care, and control, as a result of any activities related to the rental, operation, or use of equipment provided by the Rental Company, regardless of the cause. Full responsibility is assumed for any such injuries or damages, and the Rental Company shall not be liable for any loss or theft of personal property. The Rental Company shall not be responsible for such injuries, damages, loss, or theft, even in the event of negligence or fault by the Rental Company, whether such negligence is present at the signing of this Agreement or occurs in the future.   The undersigned agrees to indemnify and hold harmless the Rental Company for all personal injuries, property damages, or any other damages to third parties, including but not limited to operators and passengers of other watercraft and minor children under the undersigned’s custody, care, and control, as a result of any activities related to the rental, operation, or use of equipment provided by the Rental Company, even if such damages arise out of the negligence or fault of the Rental Company. The Renter agrees to 12 passengers and to accept the Boat delivered as provided herein, and to participate in a “Pre-Rental & Post Rental” inspection of the Boat. Renter agrees that a failure to complete this document or not providing adequate, time-stamped photos or video documentation in lieu of a Pre-Rental or Post Rental Inspection documents makes you responsible for ALL damages, and not just the deductible and/or security deposit. In the case of a discrepancy, each party agrees to note the document if it does not agree to any particular damage on the Pre-Rental or Post Rental Inspection document and sign the same.  Renter’s Responsibilities: Care of the Boat and Equipment: The Renter agrees to operate the boat and use all equipment and accessories in a safe and responsible manner. The boat, equipment, and all provided accessories shall be returned in the same condition as received. The Renter agrees that the Boat shall be used exclusively as a pleasure vessel for the sole and proper use of Renter, its family and guests during the term of this charter and shall not tow, nor transport merchandise or carry passengers for pay, or engage in any trade, participate in any race or contest of speed, nor in any way violate the Revenue Laws of the United States, and shall comply with state and federal law in all other respects. The Renter agrees not to assign this Agreement or subcharter the Boat, and Renter agrees that only the GetMyBoat authorized Renter may operate the vessel, unless a Captain, pre-approved by GetMyBoat Insurance Policy or the Owner’s own commercial charter policy has approved the Captain. Notwithstanding anything in this clause it is mutually agreed that full authority regarding the management of the Boat is hereby transferred to the Renter for the term hereof.   Damages and Losses: The Renter will be held financially responsible for any damage to or loss of the boat, its equipment, or accessories occurring during the rental period, regardless of fault. Charges for damages or lost items will be assessed and billed accordingly. The Renter authorizes the Rental Company to charge the credit card on file for any repair or replacement costs incurred due to damages or losses. There is a $500 security deposit required to rent our boat. Any excess damage will be deducted from the security deposit. If damage exceeds the security deposit amount renter agrees that The Rental Company to charge the credit card on file to replace accessories or repair damages.   Specific Charges: Broken Rope: $75.00 Lilly pad: $350 Tube Damage that results in replacement: $300.00 Life Jacket Replacement: $30 Additional boat damage will be estimated by a certified boat mechanic.   Additional Rules: - No shoes are to be worn on the boat. - No pets are allowed on the boat without prior approval from The Rental Company - Spray sunscreen or sunblock is prohibited on the boat. - Life jackets are not to be used as floating devices to sit on. - The Renter assumes full responsibility for any citations issued due to actions taken by themselves or their passengers and agrees to pay any fines in full.   - Fuel Policy: The boat is provided with a full tank of fuel. The Renter may:  - Refill the tank at the marina prior to return.   Add Ons: - Lilly Pad Rental: $25 - Tube Rental: $25 - - Sunscreen Policy: To protect the boat’s upholstery, only lotion-based sunscreens are permitted. Spray sunscreens are prohibited.   Return of the Boat: The Renter shall return the boat at the agreed-upon time, in the same condition as received. Late returns may incur additional fees.   Governing Law: This Agreement shall be governed by the laws of the State of Oklahoma.
