Any liability arising from non-compliance is entirely at operator’s risk. • Satellite TV is available where geographically possible. • The Stakeholder is hereby authorized to sign on behalf of Broker(s) and Charterer(s) the Charter Party Agreement and other necessary documents as required by the Greek Port Authorities for the handling and execution of the charter. Stakeholder and Owner confirm that the sole purpose of the Greek Charter Party Agreement is to obtain clearance from the Greek Port Authorities for the commencement of the charter. In the event of any inconsistencies between the terms of this MYBA Charter Agreement and the Greek Charter Party Agreement, the terms of this MYBA charter agreement shall prevail. • It is hereby expressly stated that VAT rate mentioned herein is the one applicable by current tax legislation valid to this date and subject to change without prior notice or responsibility on the Broker, the Stakeholder or the Owner. Should any changes in applicable tax legislation take place after the issuance of this document resulting in changes in total amount(s) due then the difference will be credited or debited accordingly to the Charterer. • A crew gratuity is customary but at the Charterer’s discretion. Usually varies from 10% to 15% of the charter fee). • All itineraries are suggested and subject to weather and sea conditions and approval from captain at the time of charter. Private charter vessels are not cruise ships and can alter point of call at any time during the charter for charter's safety and comfort. • Whilst every effort will be made to secure berthing in the chosen ports during the cruise neither the Owner or the stakeholder or the captain can be held responsible for the final allocation of any berth. • All parties agree that this contract may be transmitted via e-mail and that e-mailed contract containing either original or e-mailed signatures shall constitute a binding agreement. • WiFi available subject to geographical location. • Clause 23: Any arbitration will take place in Greece instead of London England. The following conditions have been removed from the Special Conditions as they are covered by the MYBA Agreement, however please advise your clients accordingly: • Smoking is not permitted inside the yacht. (see clause 13) • Rendezvous diving only. (see clause 13) • Children have to be under the supervision of an adult or nanny in the charter party at all times. (see clause 5b) • Funds must be received in full. Any bank charges will be deducted from the APA. • APA; Any outstanding accounts will be settled with the captain, on board and in cash prior to disembarkation. (see clause 8). In case clients receive an A.P.A. refund, this will be wired on the first business day following the Charterer’s disembarkation. • Pets are not allowed on board. (see clause 13) *Trained Pets Only Contracts: MYBA (2017-2025 Terms) & HYBA Details: CHARTER RATES 2026 High Season (July & August): 65,000 Euro/week [+VAT 6.5% & APA30%] Mid Season (June & Mid September): 60,000 Euro/week [+VAT 6.5% & APA30%] Low Season (rest of the season): 55,000 Euro/week [+VAT 6.5% & APA35%]
