**Operators are prohibited from consuming alcohol while operating vessels, all tickets and citations received while on the boat are "Party A" responsibility, that do not pertain to the "boat". **Operating during active Notice-to-Mariners is prohibited (corrections to nautical charts and publication) **Vessel can be delivered to short term rentals with Gulf access for the duration of the rental. **A familiarization with the vessel will take place upon delivery along with area waters familiarization. **Possibility of renter assuming control of boat following interview and on water assessment/turnover. **No show policy will inquire a fee of up to $200, you are in FL and we cannot predict nor change the weather. No refunds for weather. It rains and the sun comes right back out 99% of the time. **If any items are broken, misplaced, damaged, or lost upon return of boat rental, "Party A" will be responsible for the replacement cost. This Indemnity Agreement ("Agreement") is made effective _______________________ (todays date), by and between ______________________________________ ("Party A"), residing at (renter address) _________________________________________________ and Russell Grimes ("Party B"), residing at 433 NW 24th Ter, Cape Coral, Florida 33993. Party A desires to use Party B's property, specifically a boat located at 2555 NE Pine Island Road, Cape Coral, Florida 33909, for boat usage purposes. In consideration of Party B making the boat available, Party A agrees to fully defend, indemnify, and hold harmless Party B from any and all claims, lawsuits, demands, causes of action, liabilities, losses, damages, injuries, or expenses arising from or related to Party A's use of the boat. This includes, but is not limited to, claims involving personal injury, wrongful death, property damage, negligence, or any other loss, and includes payment of all judgments, settlements, attorneys' fees, court costs, fines, penalties, and related expenses. Each party warrants that they have the legal authority to enter into and be bound by this Agreement. This Agreement shall commence on June 7, 2026, and remain in effect until terminated by either party. Either party may terminate this Agreement, with or without cause, by providing five (5) days' written notice to the other party, including notice by email. Any modifications or amendments to this Agreement must be made in writing and signed by both parties. Failure of either party to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision. In the event of any legal action, arbitration, or proceeding arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees, court costs, and other related expenses. This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior oral or written agreements, representations, or understandings. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
