1. Reservations and Payment A full payment of total charter fee is required to confirm your booking. The charter fee does not include the captain's fee. A captain's fee of 20% of the total charter rate is paid directly to the captain on the day of your charter. 2. Waivers and Documentation All guests are required to sign an electronic liability waiver prior to boarding. No guest will be permitted to board without a completed waiver on file. The captain reserves the right to request a passenger manifest at any time, and guests must comply upon request. 3. Cancellation and Weather Policy Charter fees are non-refundable except in the case of weather cancellation as determined solely by the captain. If the captain deems conditions unsafe due to rain, excessive wind, or other hazardous weather, the charter will be cancelled and guests will receive a credit toward a future booking. No cash refunds will be issued for weather cancellations. Cancellations initiated by the client for any reason other than captain-determined weather are non-refundable. 4. Late Arrivals and No-Shows A five minute grace period is extended from the scheduled departure time. After five minutes, the charter clock begins regardless of whether all guests have boarded. No time will be added to compensate for late arrivals. In the event of a no-show, the full charter fee is charged. No refund or credit will be issued. 5. Alcohol Policy Guests are welcome to bring their own alcohol. The following restrictions apply without exception: Red wine and dark liquors are strictly prohibited aboard the vessel at all times. No glass is permitted outside the galley at any time. All beverages consumed on deck or in exterior seating areas must be in plastic or aluminum containers. The captain retains full authority to terminate a charter early if any guest displays excessive intoxication that, in the captain's sole judgment, poses a risk to the safety or comfort of others aboard. No refund will be issued for early termination due to intoxication. 6. Sanitation Fees A fee of $500 per incident will be charged for any vomiting aboard the vessel, whether in interior or exterior areas, with the exception of overboard. This fee applies to alcohol-related illness. We understand that seasickness occurs and approach it with empathy, however vomiting inside the galley or cabin resulting from seasickness will also incur this fee. A fee of $500 per toilet will be charged for any toilet blockage caused by improper use, including but not limited to flushing of wipes, paper products other than marine-grade tissue, food, or foreign objects. Guests are advised to ask the captain before placing anything in the vessel's heads. 7. Swimming and Water Entry Swimming and water entry are permitted at the captain's discretion and only when the vessel is anchored or fully stopped. No guest may enter the water while the vessel is underway. No jumping or diving from the vessel while it is in motion. All water entry must be conducted safely and in accordance with captain instructions. 8. Children and Life Jacket Policy No guest under the age of 18 may board without an accompanying adult. All children under the age of 13 are required by Texas law to wear a properly fitted personal flotation device for the duration of the charter without exception. This is a legal requirement and is non-negotiable. We assumes no liability for injury to minors resulting from failure to comply with this requirement. 9. General Vessel Rules No glass outside the galley under any circumstances. No red wine or dark liquors aboard at any time. No jumping from the vessel while underway. Guests must follow all captain instructions immediately and without dispute. The captain has full and final authority over all decisions made aboard the vessel including early termination of the charter. Smoking is prohibited aboard the vessel at all times. No illegal substances are permitted aboard under any circumstances. We reserves the right to refuse boarding to any guest at its sole discretion. 10. Governing Law These terms and conditions are governed by the laws of the State of Texas. Any disputes arising from or related to this charter agreement shall be resolved in the appropriate courts of Travis County, Texas.
