Unforeseen Vessel Circumstances Although highly uncommon, we reserve the right to postpone your charter should the vessel become unseaworthy, or for any other reason. We will do our best to notify you at least 12 hours in advance of any issue. Should we need to cancel your charter, you will be fully refunded and given booking priority for a future charter. Damages due to Intentional Negligence If the boat is damaged as a result of your or a guest's conduct, and that person did not act with reasonable care under the circumstances, you and the charter guest are jointly responsible to compensate the company for the damage. Reasonable care is defined as the degree of caution and concern an ordinarily prudent and rational person would use in similar circumstances. When an individual fails to act with reasonable care under the circumstances and the vessel or vessel accessory is damaged as a result of that individual failing to act with reasonable care, that individual will be liable to the company for the damage to the property. We have the right to charge your credit card for the cost of the repairs. Weather conditions policy Sunny South Florida can sometimes be rainy. Rain is not grounds for cancellation. We will monitor the weather as we get closer to your scheduled departure and will update you. Unless we inform you in advance that your charter is canceled, you must show up on time for your scheduled trip. Only your captain can decide if the conditions are safe to go out. The company also has the sole option to postpone departure for up to 2 hours in anticipation for weather improvement. We only issue refunds if your captain feels it is not safe to be on the water. To cover any expenses arising from a charter cancellation, we suggest that you purchase travel/trip cancellation insurance from a third party broker. All refunds to a credit/debit card (for any reason) carry a processing fee by the card processor. Note about disputes The venue of any action arising from this Agreement shall lie exclusively in the courts of Fort Lauderdale, Florida unless another place is mutually agreed upon, and both parties shall submit to the jurisdiction of such court. Drugs and Other Illegal Activities The use, transportation, or possession of illegal drugs or narcotics (including marijuana) or of any other contraband, or the participation in any other unlawful activity is strictly prohibited. The participation in any of these activities by Charterer or by any guest of the party constitutes a breach of the charter and shall be cause for immediate termination of the charter without refund of any payments made by Charterer. Charterer will be held responsible for any loss or damage to the vessel due to any such violations and will be put ashore at the closest safe place. Miscellaneous Smoking is not allowed on the vessel. Children are to be under the direct supervision of an adult in the charter party at all times and are not the responsibility of the crew. You have no right or power to permit or suffer the creation of any maritime liens against the vessel. The Charterer agrees to indemnity the Owner for any charges or losses incurred as a result of a breach of this paragraph, including reasonable attorney’s fees. The Owner shall not be held responsible for loss or damage to personal property or for any injury suffered by the Charterer or any member of his party during the charter, regardless of whether any such loss or injury occurs on board the vessel or elsewhere. More specifically, but without limiting the foregoing, the Owner accepts no responsibility or liability for accidents, injuries or death related to the swimming and/or the use of snorkels, masks or allied equipment (such as scuba equipment), water skiing, windsurfing, or other sports equipment, whether or not supplied by Owner or Charterer. I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH BOATING, including, but not limited to equipment failure, perils of the sea, harm caused by other vessels, acts of fellow participants, entering and exiting the water, swimming and wading, boarding or disembarking boats, and activities on the docks. I fully assume responsibility for my own safety (including, without limitation, following all directions of the boat's captain and crew) while participating in the Boat Ride, and verify that I am physically able to participate. I fully understand that the involved boat has limited medical facilities and that in the event of illness or injury appropriate medical care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions. No person associated with the company has made any express or implied representation to me that they or the boat's crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid I would like assistance and will not hold any person or entity responsible for their actions in attempting the performance or rescue or first aid. Having read this wavier, I agree to RELEASE from LIABILITY and HOLD HARMLESS the company, along with its respective officers, directors, employees, owners, members,managers, affiliates, agents, representatives, attorneys, heirs, personal representatives, successors and assigns, all individuals associated with the Boat Ride, and all individuals and entities having an interest in the boat being used for the Boat Ride, from any and all liability, claims, demands, equitable relief, damages, costs, expenses, and causes of action of any kind or character, of any type or nature whatsoever (including negligence), arising out of the Boat Ride.
