1. Purpose: This rental is governed by these rental conditions which the client renting the boat acknowledges having read before signing this contract. 2.Boat pick up: The charge of the boat by the skipper takes place after payment of the balance and the security deposit (4500E). The amount of the security deposit is 3500 euros, it is intended to cover the damage suffered by the lessor as a result of damage, or theft of the boat. The inventory and inventory of the boat are a descriptive statement of the boat attached to the contract, signed by the contracting parties. The tenant undertakes to identify and record in writing, before leaving the rental base, any apparent defects that are not included in them. Otherwise, the lessor is deemed to have delivered a boat in accordance with the descriptive condition .The signing of the contract and the inventory constitutes recognition by the head tenant of the good working condition of the boat and its equipment. The lessor reserves the right to refuse the provision, if the captain or the crew does not appear to have sufficient skills notwithstanding the references, certificates, permits presented. In this eventuality, the tenant must either accept the fees of a skipper, or have his contract cancelled and the amounts paid returned, with the exception of the deposit paid. In the event that the tenant cancels the rental, because he is unable to maneuver the boat, the amounts paid will be due.3. Boat insurance and insurance deductible: The lessor declares: Have taken out a special rental insurance policy with the following guarantees: loss and damage to the boat, total theft, civil liability, and legal protection. Attention: shocks caused to the transmission (propeller and base) as well as all the accessories (GPS, cushion, sun awning...) of the boat are not covered by insurance. Propeller value: 780E Propeller shaft value: on request Base value: 3500E GPS: 2000E Other: depending on damage This insurance policy does not guarantee persons transported from accidents of which they may be the victim. It disclaims all responsibility for losses concerning the tenant's personal property. Individual insurance can be taken out by the tenant, for his benefit and at his expense, to cover these risks. (the lessor can in no way be held responsible for goods that have been forgotten in the boat at the end of the rental ).The amount of the deductible per claim is fixed by the lessor in this contract. The tenant remains his own insurer up to the limit of this deductible. 4. Termination of the contract: 4.1 By the tenant Before taking charge of the boat, if the tenant renounces the rental and terminates the contract, the deposit paid will not be refunded. At the time of taking charge of the boat, if the boat delivered is not in a seaworthy condition, and if the lessor is not in a position to offer a boat of equivalent or higher range, the tenant may break the present contract and obtain the return of the deposit paid, without being able to claim damages. In case of difficult weather for navigation, the tenant must change his destination if possible. Under BMS, he can postpone his rental to a later day (depending on availability). In case of refusal, the deposit paid will be due to the lessor .4.2 By the lessor: At the time of taking charge, if the tenant is not in a position to leave the entire deposit, the lessor reserves the right to cancel the rental. The deposit paid will be due to the Lessor .In the event that, as a result of a damage occurring during the previous rental, or an impediment beyond his control, the lessor cannot give use of the boat mentioned above on the agreed date, the latter will be required either to make available to the tenant a boat of equivalent or higher range, or to return the deposit paid, without the tenant being able to claim damages. In case of difficult weather for navigation, the rental company will suggest another destination or a later day. The tenant will not be able to claim a refund. 5. Use of the boat: The tenant undertakes: To strictly respect the boat's coastal navigation rules (less than 6 miles from shore). That the pilot of the boat holds a license in accordance with the regulations in force. To board a maximum of the number of authorized persons is 10 people in categories C and D. To use the boat only for pleasure boating, within the framework of maritime and customs legislation in force, excluding all commercial operations, professional fishing, transport or other. Do not use the boat to be re-rented, to give driving courts or to push or pull another boat. Do not dock on the beach as this could cause the boat to run aground or capsize. Do not use the boat for offshore races, competitions or trials, regardless of the location. Do not sail at night. The tenant expressly releases the lessor from any responsibility for any breach of these prohibitions and will respond alone, with respect to maritime services and Customs, for the lawsuits, prosecutions, fines and confiscation incurred by him as a result. The renter is responsible for the boat for the duration of the rental, whether while sailing, at anchor, or in ports and marinas. 6. Crew list: The chief tenant affirms that he has the knowledge and experience necessary for coastal navigation that he plans to practice and undertakes to use the boat in a good manner, and in particular, without being under the influence of alcohol, narcotics or any substances likely to affect the piloting of the boat, in accordance with the regulations in force and in particular with the regulations of maritime affairs, customs, and the nautical brigade. 7. Fuel costs: Fuel costs are borne by the renter in charge of the trip. The head tenant acknowledges having received the boat with a full fuel tank and undertakes to return it in the same way. Otherwise, the amount of full fuel will be invoiced at the price of 2 €/liter .8. Losses, damage and breakdowns :In the event of loss or damage during the rental, the tenant is required to urgently notify the lessor by requesting instructions that he must follow exactly. The tenant will be required to have a report drawn up by a damage inspector so that the lessor can obtain reimbursement of the amounts due to him from the insurance company (except for the deductible). In the event that the tenant does not complete these formalities, he may be required to keep all expenses caused by the loss or damage at his expense.In the event of a failure (tip in the propeller, grounding, battery, transmission, fuel shortage...), the repair costs will be borne by the tenant. For this purpose, a deduction from the security deposit will be made. In the event of an engine lift problem (trim), the tenant must adopt careful navigation, any damage caused to the propeller will be invoiced. In the event of a GPS failure, the tenant is responsible, he must refer to the nautical chart provided in the boat. The GPS track is for information purposes only. 9. Return of the boat: When the boat is returned, the head tenant undertakes to carry out an inventory and an inventory with the lessor. In the event that this return inventory is not carried out due to the delay of the tenant or the lessor, or other incidents due to his fault, the lessor will carry out this inventory alone which will be notified to the tenant in charge of the trip. Unless denounced by the latter, the same day of notification, the inventory and the inventory of premises will be presumed to have been accepted jointly by the contracting parties .9.1 The head tenant is required to return the boat and its equipment, to the designated port of return (Marina Bas du Fort), in good working and maintenance condition, within the time limits agreed in this contract. If the tenant fears that he will not be able to return at the fixed time. he must notify the landlord. However, the tenant benefits from a tolerance of 30 minutes at the end of the rental before a new rental period is applied. 9.2 Each day of delay entitles the lessor to compensation at twice the daily price of this rental, regardless of the cause of the delay, except for duly justified force majeure. Bad weather cannot be cited as a valid reason .9.3 The delivery of a boat in a port other than that originally planned or in a condition requiring the vessel to be immobilized, and therefore penalizing the subsequent rental, is also considered to constitute a delay .9.4 If, for any reason, the renter is not in a position to return the boat himself to his designated port of return, he must have it conveyed at his expense and risk and ensure its security, after having notified the lessor. The Rental will only end after the boat is returned to the lessor under the conditions provided above. 9.5 If a deterioration or loss, both of the boat and of any accessory, is observed, the tenant is required to pay for the repair or replacement with a new one. As for the propeller in case of damage, and even minor damage, the element will be replaced by new one. Any damage found to the propeller, base, or hull, will cause water to leave the boat for inspection and repair, at the expense of the tenant. All stained sun loungers and inner cushions will be charged after being cleaned in the dry cleaner. Any new scratch will be invoiced with a minimum of 50E; 9.6 If the deterioration or loss results from a claim covered by the insurance policy provided for in article 3, an amount equivalent to the excess will be invoiced to the customer. 9.7 Any damage found will be invoiced to the customer at the new price, even in the event of slight damage. 9.8 If the condition of the boat upon return is satisfactory and in accordance with the inventory signed at departure, the security deposit is returned to the tenant, no later than one week after the date of delivery of the boat. The renter is responsible for the boat and the equipment, as well as for docking, until the return inventory, which will be carried out by the lessor. 9.10 The boat must be returned in a decent clean condition. 10 Dispute: For any dispute relating to the execution of this contract, it is agreed that in agreement with the contracting parties an amicable conciliation will be initiated before any legal proceedings. In the event that legal proceedings are initiated, the competent court is the court of Pointe à Pitre .The tenant declares to have read the general rental conditions:
