5.1. Within 15 days prior to the reservation, another available date will be sought for a trip with the same characteristics. This is the responsibility of the Renter. Renter acknowledges and understands that in the event of unavailability, no refund of the deposit will be issued. 5.2. If cancellation is made more than 15 days in advance, the Company will refund 80% of the reservation. 5.3. If the cancellation is due to force majeure, a fortuitous event, or weather conditions beyond the company's control, the Renter will be immediately informed of the reasons for the cancellation. 5.4. If the boat is damaged, the boat must be replaced with a boat of similar characteristics and price. If the price is lower, the reservation amount will be adjusted. 5.5. If the boat is damaged or the client does not wish to sail, a 100% refund of the reservation will be issued. SIXTH: PROHIBITIONS In accordance with Law 30 of 1936 and Law 1336 of 2009 and other applicable regulations, the use of the boat for activities primarily or similar to sexual exploitation, pornography, sex tourism for minors, or the production, manufacturing, export, import, distribution, trade, use, and/or possession of narcotics is prohibited. Subletting the boat is also prohibited. In the event of any of the conduct described herein occurring on the boat, THE LESSEE will be held liable before the competent civil and criminal authorities, and THE LESSOR will be held harmless. PARAGRAPH. THE LESSOR assumes no responsibility for the activities carried out by THE LESSEE on the boat from the moment the boat is returned. SEVENTH: DELIVERY, RECEIPT, AND CONDITION OF THE VESSEL THE LESSEE declares that he/she has received the vessel and other items in perfect condition and undertakes to return them upon termination of the contract in the same condition as received. Any material damage caused to the vessel due to misuse, neglect, or imprudence by THE LESSEE will be his/her sole responsibility, and he/she therefore agrees to pay for all damages caused. THE LESSOR assumes no liability for the loss, destruction, or damage to any property owned by THE LESSEE on the vessel. EIGHTH: LESSEE'S LIABILITY THE LESSEE declares that he or she is aware of and assumes the risks, dangers, accidents, or contingencies that may occur in connection with his or her participation in the activities of using and navigating this vessel. Therefore, he or she assumes all civil and criminal liability from the moment the vessel is delivered until its return in accordance with the provisions of the Civil Code and Penal Code. NINTH: GUARANTEES THE LESSOR has an insurance policy issued by an insurance company legally authorized to operate in Colombia, covering death due to accidents, funeral expenses due to accidental death, medical expenses due to accidents, and accidental disability and dismemberment due to accidents. Notwithstanding the foregoing, the initial responsibility for these concepts falls to THE LESSEE, who is the person carrying out the activities on the vessel. TENTH: DOCUMENTS 10.1. The Lessor declares that he has all the ownership documents and all other legally required documents for navigation, which are up to date. 10.2. The Lessee declares that he is aware of and has the required documents at the vessel's location: CITIZENSHIP CARD, FOREIGNER'S CARD, PASSPORT, among others. ELEVENTH: CONFIDENTIALITY The Lessee declares and acknowledges that the information exchanged and provided during the course of this contract is confidential and will therefore be kept strictly confidential. This contract is signed in the city of Cartagena on the 11th day of the 8th month of the year 2025, as proof of acceptance of the terms.
