Terms and Conditions The following conditions apply to all charters. By booking, you agree to these terms. A full rental agreement must be signed before or upon arrival for the charter. Failure to sign may result in cancellation without refund. 1. Cancellations by Charterer - Cancellations more than 48 hours prior to charter commencement: Full refund (less any payment processing fees). - Cancellations 24–48 hours prior: 50% refund. - Cancellations less than 24 hours prior, or no-shows: No refund, full rental fee forfeited. 2. Cancellations We reserve the right to cancel or modify a charter for the following reasons, with a full refund or rescheduling option provided: - If the vessel cannot be made available due to unforeseen mechanical issues or prior damage. - Adverse weather conditions that pose safety risks (e.g., winds >15 knots, waves >0.5m, or storms per BOM forecast). - If, at charter commencement or during the period, we are not satisfied with the hirer's ability to safely handle, navigate, or respect the vessel (e.g., lack of demonstrated competency or RMDL verification). We may provide a professional skipper at the hirer's expense, terminate the charter without refund, or recall the vessel to a secure mooring/anchorage if the vessel is in an unsafe location or the hirer's actions endanger the vessel, occupants, or third parties. 3. Vessel Usage and Limits - Vessels must remain in the designated operational area (Moreton Bay and Gold Coast Seaways) at all times, with passenger numbers not exceeding the maximum allowed (4 per Exemption 02 and vessel's builders plate). - For long-term hires (>7 days), trailering to other approved locations is permitted with prior arrangement. - Vessels must be secured on anchor or mooring one hour before darkness and must not maneuver during hours of darkness unless in an emergency or pre-approved by us. 4. Safety and Competency Requirements - All hirers must hold a valid Queensland Recreational Marine Driver Licence (RMDL), verified at pickup (no exceptions). - The hirer must be at least 16 years of age (minimum for RMDL), with a minimum of 25 years preferred unless specifically agreed upon. - All onboard must abide by Maritime Rules and Regulations, including COLREGs (e.g., maintain proper lookout, safe speed, and right-of-way). - Lifejackets (Level 50S) must be worn in adverse conditions, by children under 12, or at the hirer's discretion. Health declarations are required (e.g., no medical conditions affecting safe operation). 5. Boat Rules and Prohibitions - No modifications, smoking, pets, or firearms allowed on vessels (firearms only with prior arrangement). - The charter vessel must at all times be under the control of the designated hirer (as skipper). - The hirer or person in control must not consume alcohol or any judgment-impairing substances (BAC 0.00% tolerance). - Hirers must adhere to current Marine and Fisheries (M.A.F.) regulations for fishing. - All rubbish must be returned for disposal—no littering in waterways. - Damage beyond normal wear and tear will be charged to the $500 security bond. 6. Conditions of Payment - A booking is confirmed upon full payment and satisfactory completion of the Booking Application. - For self-drive charters, the $500 security bond must be paid. The bond is refundable within 5 days of return (extended if major damage occurs, with notification). Deductions may apply for: * Loss or damage to the vessel or equipment. * Refueling costs (55L tank + 2x 25L; expect $20–$50/day at $2/L). * Late return fees (extenuating weather exempt). * Cleaning fees ($50 if not returned clean). * Any other outstanding debts (e.g., fishing tackle hire or watersports pack). 7. Insurance and Liability - All vessels are fully insured for commercial use against fire, marine, collision risks, and third-party liability (including water skiers extension). - If damage or loss occurs during the charter, the hirer is liable for: * The full extent of loss or damage not claimable against insurers. * The full excess on the insurance policy. * The full amount if the claim is declined by the insurer for any reason (e.g., non-compliance with rules). - All equipment is used at the hirer's own risk. In case of an insurance claim, fuel and other debts will be charged in addition to the security bond. Note: The full rental agreement, including these terms, must be signed before or upon arrival.
