The Lessee agrees to use the vessel responsibly and to maintain it in good condition, as well as to be liable for all items listed in the inventory, and therefore shall be responsible for any damage, breakage, theft, or loss. The company will be responsible for the vessel and for navigating under appropriate safety measures. Accordingly, the Lessee and the rest of the passengers agree to follow the instructions of the captain and crew at all times. In the event that the vessel subject to this lease agreement is rented, the Lessee is responsible for the actions of all persons listed on the passenger manifest. The Lessee agrees not to board more people than legally permitted or authorized by the vessel's license. The vessel must be used strictly for recreational navigation. Commercial use, subleasing, transfer, professional fishing, transport, races, or any other prohibited activity under the law is strictly forbidden. In such cases, the Lessee will be personally liable before the relevant authorities, even in the case of unintentional violations. If any of these violations result in the immobilization of the vessel, the Lessee must pay the Lessor a compensation equal to the current rental rate for the entire duration of the vessel’s detention. In case of confiscation, the Lessee must reimburse the value of the vessel within 10 days. The vessel's price will be determined based on the insured value stated in the vessel’s insurance policy. DAMAGES: The Lessee understands that all damages caused by the Lessee will be repaired solely by the company or its AUTHORIZED mechanics/employees. No repairs caused by the Lessee will be performed by UNAUTHORIZED third parties. The Lessee acknowledges full responsibility for any damage caused directly to the vessel by any passenger listed in the group. VESSEL OUT OF SERVICE FOR REPAIRS: In the event the vessel is out of service due to mechanical failure, the company will refund the full payment to the Lessee. We may offer alternative vessels in case of mechanical issues, if the Lessee agrees to the change. AUTHORIZATION / REVOCATION OF EQUIPMENT USE: Our company or its agents reserve the right to revoke equipment use. Decisions made by the company or its agents regarding the Lessee’s use of the vessel are based on safety reasons, including but not limited to: - (a) Inappropriate use of equipment - (b) Being under the influence of alcohol or any illegal substances, posing a risk to group or vessel safety - (c) Unsuitable conditions for navigation
