BOAT RENTAL TERMS & CONDITIONS 1. Operator Requirements - The renter and/or operator must possess a valid boating safety certificate or boating license as required by applicable law. - Proof of certification must be provided prior to departure. - Any individual acting as captain or operator must accurately represent their qualifications and experience. Providing false, forged, or misleading credentials is grounds for immediate termination of the rental without refund. 2. Use of Vessel - The vessel may only be operated by individuals approved by the owner. - The renter is responsible for the safe operation of the vessel and compliance with all federal, state, and local boating regulations. - Reckless operation, excessive speeding, operating under the influence of alcohol or drugs, or any unlawful activity is strictly prohibited. 3. Point Pleasant Canal Restriction - The renter must obtain the owner's prior permission before navigating through the Point Pleasant Canal. - Extra caution is required when transiting the canal. 4. Condition of Vessel - The vessel will be provided in clean and operational condition. - The renter agrees to return the vessel in substantially the same condition as received, normal wear and tear excepted. - The vessel must be returned cleaned and free of trash, personal belongings, and excessive dirt or debris. - Additional cleaning fees may be charged if the vessel is returned in an excessively dirty condition. 5. Damage and Liability - The renter assumes responsibility for any damage occurring during the rental period, except for documented pre-existing damage. - The renter shall immediately report any accident, grounding, collision, mechanical issue, or damage to the owner. - The renter is responsible for all fines, citations, towing expenses, and damages resulting from their operation of the vessel. 6. Weather and Safety - The owner reserves the right to delay, shorten, or cancel a rental due to unsafe weather or water conditions. - The renter agrees to monitor weather conditions and operate the vessel safely at all times. 7. Return of Vessel - The vessel must be returned at the agreed-upon time and location. - Late returns may result in additional charges. 8. Fuel Policy - The vessel will be provided with a documented fuel level at the start of the rental period. - The renter is responsible for returning the vessel with the same fuel level as received. - If the vessel is returned with less fuel than provided, a fuel charge will apply, including the cost of fuel plus a refueling/service fee at the owner's discretion. - The owner reserves the right to verify fuel levels upon return and assess any applicable charges. 9. Acknowledgment By accepting possession of the vessel, the renter acknowledges that they have read, understood, and agree to these Terms and Conditions. The renter further agrees to operate the vessel in a safe and responsible manner and accepts responsibility for any violations, damages, losses, or charges incurred during the rental period.
