In 2019, I left behind my corporate life in South Africa and embarked on a new journey in Thailand with my partner. Our adventure began on Phi Phi Don, where I worked online as a graphic designer and web developer, while my partner pursued a career as a diving instructor and underwater photographer. Eventually, we settled in Phuket and established a full-time private charter and tour operating company. 1. Altering a booking Minor alterations are usually free of charge, provided they do not interfere with our schedules. Major alterations that interfere with our booking schedules may be treated as cancellations and re-bookings, and the relevant charges may apply. 2. Cancellation policy a. Full refund will be given under the condition cancellation be made at least 7 days before the travel day. b. 50% refund will be given, if cancellation is made within 7 days to 3 days before the travel day. c. Should there be cancellation made less than 72 hours before the travel day, no refund will be given. d. In case of an unforeseen issue where the boat/yacht is unable to perform the trip i. a replacement boat/yacht will be arranged - no refunds will be issued. ii. If the company is unable to provide a replacement due to an unexpected issue, the entire deposit 100% of it, will be returned to you in the same method of payment it was received within 7 working days. e. In case of advance booking for peak season period, no refund will be given in any case of cancellation: New Year Peak Period: 15th December 2025 – 20th January 2026 Chinese Lunar New Year: 15th February 2026 – 20th February 2026 3. Cancellation policy for bad weather a. In case of severe weather and resulted in order by the Meteorological Department announcement of NO BOAT to leave for trip, the entire deposit 100% of it, will be returned to you in the same method of payment it was received within 7 working days. b. Due to unfavorable weather conditions (only general rain – no scattered rain/some places); We do not refund and charge 100% in cases boat is still operating normally. However, if the customer cancel, we charge 100% and will not refund any money in any case. 5. Insurance The customer must accept the intrinsic risks of taking part in the tour: • For insurance of each individual to be valid: the client’s full name; age; nationality; I.D. numberor passport number details must be fully accurate according to their identification card or passport. • An accident insurance policy is held; any valid claims can only be considered within the limitsof the stated amount in the policy under the laws of Thailand. • The company’s accident insurance will only cover medical treatment and medical expenseswhich caused from the accident that occurred during the trip only. • There is requirement for the injured customer to visit the hospital within the sailing day for theinsurance to be covered. • This insurance covers within Thailand territory only. 6. Force Majeure No compensation will be paid in the case of unforeseeable and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised. Such circumstances or events include but are not limited to, war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport, closure or congestion of airports, terrorist activity, natural or nuclear disaster, fire, pandemic, and adverse weather conditions. 7. Safety We take safety very seriously; the captain of the yacht has the discretion to change the planned route if he deems it unsafe. In the event of a route change, no refunds will be provided. Where itineraries are given, they may be subject to change based on weather conditions, guest preferences, or other circumstances. The final decision regarding the itinerary lies with the captain of the charter. Passengers must follow the safety instructions provided by our professional crew. Failure to follow instructions may result in the cancellation of the charter without a refund. Please note that our insurance does not cover intoxicated passengers and guests who consume intoxicating substances do so at their own risk. 8. Liability We accepts no responsibility for the acts or omissions of our clients, whether negligent or otherwise, and shall not be held liable for any claims made against them (or as a result of their actions) either by other clients or third parties. We accept no liability for losses that were not caused by any breach on our part and were unforeseeable at the time of booking. 9. Holiday & Cancellation Insurance We highly recommend that guests obtain travel insurance covering sailing, watersports activities and cancellation insurance. Please note that there will be no refunds in case of any kind of cancellation by the guests. 10. Equipment Breakdown While we take great care to maintain all systems and equipment, equipment failures or malfunctions can occur. Yachts are complex machines subject to a range of conditions and stresses, including heavy use, weather and sea conditions. Our crew is trained and experienced in handling equipment failures and malfunctions, we have procedures in place to address these situations promptly and effectively. Please note that we do not offer refunds for minor issues that do not affect the overall charter experience. If a significant issue occurs that affects the safety or enjoyment of your charter, we will take all necessary steps to address the issue and provide a satisfactory resolution. If we are unable, even through no fault of their own, to deliver the chartered yacht or a similar yacht at the commencement of the charter period, we will be obliged to reimburse a pro-rata sum of the charter fee. 11. Complaints Should a client have a complaint, he/she has to inform the skipper of the yacht or the shore base. The skipper or shore base will do their utmost to rectify the problem. If the outcome is not satisfactory, the client will have to inform us in writing within 14 days after the end of the charter. Complaints, which have not first been expressed to the skipper on the trip concerned or to the shore base, will not be taken into consideration. To handle complaints, we require the original complaint of the client, signed by the client him/herself. If the matter is deemed fair, the client will have their trip partly or wholly reimbursed. 12. Information Provided The information we provide regarding the yachts, itineraries, crew, sites, transfers, arrival/departures, prices, and all other aspects of the charters is correct to the best of our knowledge. However, we reserve the right to change any of the above as circumstances dictate without prior notice. 13. Price Changes & Promotions We reserve the right to change prices at any time or run promotions. The price quoted at the time of booking will be valid for the duration of your charter, but any promotions or discounts cannot be applied later on to the charter. You can stay informed about our promotions and discounts by checking our social media channels. 14. Intellectual Property & Privacy Policy We are committed to protecting our customer’s personal data and respecting their privacy. The company will only use personal data provided by the customer for the purpose of fulfilling the charter and will not disclose this data to any third party, except where necessary to fulfill the charter or as required by law. 15. Final Note By booking with us, you agree to our booking terms and conditions. These terms are valid for clients booking directly with us or through an agency. Any deviation from these booking terms and conditions must be agreed upon in writing by both parties. Verbal agreements do not hold any validity. These terms and conditions are governed by the laws of the jurisdiction of the Kingdom of Thailand. Any disputes arising from these terms and conditions or the booking will be subject to the jurisdiction of the Thai courts. If any part of these booking terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
