1. BOAT INFORMATION Boat Name/Type: Boat Name and Type Capacity: Maximum Number of Passengers -12 Rental Duration: Start Date and Time to End Date and Time Departure Location: Dock Location Return Location: Return Dock Location 2. RENTAL FEES - The total rental fee for the boat charter is the agreed amount. - A deposit is required to secure the reservation. - The balance of the rental fee is due a set number of days prior to the rental date. 3. PAYMENT TERMS Payment of the deposit must be made at the time of booking. The remaining balance must be paid no later than a specified number of days before the scheduled charter date. Payments can be made via acceptable payment methods. If payment is not received by the due date, the reservation will be canceled, and the deposit will be forfeited. 4. CANCELLATIONS AND WEATHER RESCHEDULING A. Charterer Cancellations - If the Charterer cancels the reservation more than a specified number of days before the scheduled rental date, the deposit will be refunded, minus a specified cancellation fee. - If the Charterer cancels within a specified number of days of the scheduled rental date, the deposit will be forfeited. - No refunds will be issued if the Charterer cancels on the day of the scheduled rental, except in the event of weather-related cancellations (as outlined below). B. Owner/Operator Cancellations - The Owner/Operator reserves the right to cancel the charter at any time due to unforeseen circumstances, mechanical failure, or any other situation beyond their control. In such cases, the Charterer will be refunded the full amount paid, including the deposit. C. Weather Rescheduling and Cancellations - Weather conditions may impact the safety of the charter. The Owner/Operator reserves the right to reschedule or cancel the charter if severe weather conditions (such as thunderstorms, high winds, or other dangerous conditions) are expected. - If a weather-related cancellation occurs, the Charterer will have the option to: - - Reschedule the charter to a later date at no additional cost, subject to availability. - Receive a full refund of any amounts paid, including the deposit, if the charter is canceled. - If the Owner/Operator deems weather conditions unsafe for the planned itinerary, they may choose to alter the route or shorten the trip for safety purposes. 5. CONDUCT AND RESPONSIBILITIES A. Charterer’s Responsibilities - The Charterer agrees to comply with all applicable laws and regulations during the rental period. - The Charterer is responsible for any damage to the boat or equipment caused by their actions, misuse, or negligence. - The Charterer agrees not to operate the boat under the influence of alcohol or drugs. - The Charterer is responsible for ensuring all passengers on board follow safety instructions and wear life jackets as required. B. Owner/Operator’s Responsibilities - The Owner/Operator will ensure the boat is in good working condition and provide a safety briefing at the beginning of the charter. - The Owner/Operator will provide an experienced captain and crew as needed. - The Owner/Operator is responsible for maintaining the safety of the boat, its equipment, and all passengers during the rental period. 6. INSURANCE AND LIABILITY - The Charterer is advised to obtain personal insurance for themselves and their passengers. - The Owner/Operator maintains insurance for the boat; however, the Charterer agrees to indemnify and hold harmless the Owner/Operator for any injuries, damages, or losses occurring during the charter, except those caused by the Owner’s negligence or misconduct. 7. LIMITATION OF LIABILITY - The Owner/Operator is not liable for any damages, injury, loss, or delays caused by weather conditions, mechanical failure, or actions beyond their control. - The Charterer assumes all responsibility for personal injury or property damage to themselves or their guests during the rental period. 8. GOVERNING LAW AND DISPUTE RESOLUTION This Agreement shall be governed by the laws of the State of Illinois. Any disputes arising from this Agreement will be resolved through mediation or arbitration in the appropriate county in Illinois. 9. ENTIRE AGREEMENT This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements, whether written or verbal. No amendments or modifications shall be valid unless in writing and signed by both parties.
