REQUIREMENTS & BOOKING INFORMATION A valid Pleasure Craft Operator Card (PCOC) and driver’s license are required. Please arrive 30 minutes prior to your scheduled booking time. Notify us via WhatsApp or text upon arrival at the location. We will be in contact with you within the 30-minute arrival window. SAFETY FIRST SAFETY NUMBER ONE PRIORITY Please read below the entire agreement carefully before proceeding with your booking. BOAT RENTAL AGREEMENT, WAIVER OF LIABILITY & RELEASE (ONTARIO – LEGALLY BINDING) This Agreement is entered into by the undersigned Renter on behalf of themselves and all passengers (collectively, the “Participants”). 1. OPERATOR REQUIREMENTS • Must be 21 years of age or older • Must possess a valid Pleasure Craft Operator Card (PCOC) • Must present a valid driver’s license The Owner or the operator reserves the absolute right to require a captain at additional cost at any time 2. ASSUMPTION OF RISK The Participants acknowledge that boating and water-related activities involve significant inherent risks, including but not limited to serious bodily injury, death, drowning, collision, weather conditions, equipment failure, and operator error. All such risks are fully and voluntarily assumed, whether known or unknown, foreseeable or unforeseeable. 3. FULL RELEASE & WAIVER OF LIABILITY To the fullest extent permitted by the laws of the Province of Ontario, the Renter and all Participants hereby irrevocably release, waive, and forever discharge the Owner, Operator, and any affiliated persons from any and all claims, demands, damages, liabilities, actions, or causes of action of any kind whatsoever, including those arising from negligence, for: • Personal injury • Death • Property damage • Loss or expense of any kind • The Renter and Participants further agree to waive any and all rights to sue the Owner, Operator, or any related parties. 4. INDEMNIFICATION The Renter agrees to indemnify, defend, and hold harmless the Owner and Operator from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from: • Use or operation of the vessel • Actions or negligence of the Renter or Participants • Any breach of this Agreement. 5. RESPONSIBILITY OF RENTER The Renter assumes full legal and financial responsibility for: • Safe operation of the vessel • Conduct and safety of all Participants • Any and all damages, losses, or injuries • Compliance with all applicable laws and regulations. 6. INSURANCE ACKNOWLEDGEMENT & LIABILITY LIMITATION The Renter expressly acknowledges and agrees that NO insurance coverage is provided or included with this rental for the Renter or any Participants. The Owner and Operator make no representations or warranties regarding insurance coverage and shall have no obligation whatsoever to provide any form of insurance protection, including but not limited to coverage for personal injury, death, or property damage. The Renter is solely responsible for determining whether to obtain insurance and assumes full responsibility for all risks arising from the absence of such insurance. To the fullest extent permitted by law, the Renter and all Participants hereby: Irrevocably waive, release, and discharge the Owner, Operator, and any affiliated persons from any and all claims, demands, or causes of action of any kind; Waive any and all rights to sue the Owner, Operator, or any related parties; Acknowledge that this release includes claims related to personal injury, death, or property damage to the fullest extent permitted by law; Confirm that they are voluntarily assuming all risks associated with participation in this activity. 7. ALCOHOL & DRUG POLICY (ZERO TOLERANCE) • Strictly NO alcohol or drugs permitted onboard at any time • Any violation will result in immediate termination of the rental without refund • The Owner reserves the right to terminate the rental immediately and reclaim the vessel • Any illegal activity may be reported to law enforcement authorities • The Renter assumes full legal and financial responsibility for any violations 8. SAFETY & OPERATING RESTRICTIONS Vessel must remain in waters deeper than 13 feet at all times No beaching, approaching shoreline, or entering shallow areas No reckless, negligent, or unsafe operation All instructions from the Owner or Captain must be followed immediately 9. DAMAGE, LOSS & COST RECOVERY The Renter is fully liable for: All damages to the vessel and equipment Loss of use, repair costs, and associated expenses Any third-party damages or claims All costs shall be payable immediately upon demand. 10. WEATHER & TERMINATION The Owner reserves the right to cancel, delay, or terminate the rental at any time due to unsafe conditions. No refunds are guaranteed once the rental has commenced. 11. LATE RETURN & DEFAULT Late returns will be subject to additional charges at a higher hourly rate. Failure to return the vessel as agreed may result in additional charges and/or legal action. 12. GOVERNING LAW This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario. 13. SWIMMING & ENGINE SAFETY At any time the Renter or any Participants elect to swim, the vessel engine must be completely shut off before any person enters the water. The engine shall remain off until all swimmers have safely returned to the vessel and are secured onboard. Failure to follow this rule may result in immediate termination of the rental without refund and may be considered a serious safety violation. 14. SEVERABILITY If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 15. ACKNOWLEDGEMENT & ACCEPTANCE By proceeding with this booking, the Renter, on behalf of themselves and all Participants, confirms that they have carefully read and fully understood this Agreement, acknowledge the risks involved, and voluntarily agree to all terms and conditions set forth herein. The Renter further confirms that they have the authority to accept this Agreement on behalf of all Participants and that all Participants have been informed of and agree to be bound by its terms. By proceeding, the Renter and all Participants expressly acknowledge that they are waiving significant legal rights, including the right to bring claims or legal action against the Owner, Operator, or any related parties, and choose to proceed with the booking voluntarily.
