GENERAL TERMS AND CONDITIONS OF THE VESSEL CHARTER AGREEMENT 1. The lessor is obliged to hand over the vessel ready for navigation at the agreed place and at the agreed time. If from unforeseen reasons (eg damage caused during previous lease) the lessor is unable to deliver the appropriate vessel at a particular location is the lessor obliged to rent a vessel of similar length to the lessee and connection size, or fully reimburse the costs to the tenant. In this case, the tenant does not have to apply for damages. The value of the indemnity is calculated together with interest per day. 2. INSURANCE: The lessor is obliged to insure the vessel: -insurance against liability for damage to third parties (things and persons). The personal belongings of the renter and crew are not included in this insurance policy. 3. CHARTER NAVIGATION AREA: Agreed the area of navigation is navigation in the territorial waters of the Republic Croatia, unless otherwise agreed. 4. CONDITIONS OF NAVIGATION: By signing this contract the lessee confirms that it has total maritime and navigational knowledge to operate an outdoor vessel sea. Otherwise, he will appoint the captain of the ship, who alsoa charter agreement should be signed.By signing this charter agreement, the lesseeconfirms that he has a navigation license and that he doesappropriate level of maritime skills.The lessee will be responsible for providing false information.The charterer and the captain of the ship, in case they are not the same person,are subject to full compliance with these terms of the lease agreement.5. SPECIFIC RESPONSIBILITIES OF THE LESSEE:-The lessee is responsible for the maintenance of the vessel and equipment, andfor compliance with maritime regulations in the spirit of a good seafarer.* THE LESSEE MUST NEVER:- provide commercial passenger transport services by vessel- participate in sports competitions, unless authorizeddo it- rent a boat- towing another vessel, except in an emergency* LESSEE IS OBLIGATED:- if necessary, check the vessel regularly during the voyage (oilin the engine, coolant, etc.)- keep a logbook properly- navigate strictly within the territorial boundaries of the host countryavoiding restricted navigable areas- always be inside the sea routesThe lessee is obliged to report any accidents or incidents,including damage caused to the vessel and equipment. After eachaccidents or incidents, it is necessary to compile a detailed report asproof of luck to the captain, doctor or competent authority.Moreover, it is necessary to immediately notify the landlord of the accidentor accidents. The same goes for management skills, loss or incase of seizure or detention by the authorities. ifcosts incurred due to non-compliance are bornelessee.The lessor's registered office must be notified in the event of a breakdownfor damage examination. In case of damage or injury, costsrepair or doctor will be charged from the deposit.Cost of intentional damage caused to the engine or sails,loss of equipment, etc. due to delays in the return of the vessel or replacements, will be charged equally from the deposit. For any damage to which the exact cost cannot be determined, the landlord will retain the estimated value of the costs over a period of 30 days, after which the differences will be settled. 6. HANDOVER OF THE VESSEL: The boat is handed over to the lessee delivers with a tank full of fuel. When taking over the vessel on the inventory list, the lessee checks the condition of the vessel, completeness of equipment and inventory and confirms this with a signature. Subsequent complaints from the lessee about the condition and equipment of the vessel are not possible. If the landlord is unable to repair the fault or damage, at least in part, the lessee may terminate the contract or request a discount on the rental price. 7. BOAT RETURN: After the end of the boat rental the lessee is obliged to hand over the vessel with a full tank and equipment as specified in the inventory. 8. DELAY: The lessee is obliged to hand over the vessel to agreed time. This obligation should be respected regardless on weather conditions. It is necessary to plan the sailing schedule, so that the vessel arrives at the port of departure on time, regardless in adverse weather conditions. However, if the vessel is not handed in at the prescribed time, it is necessary to inform the landlord, and the tenant is obliged to wait for further instructions. All additional costs (refund fee, costs travel for a new tenant, etc.) will be borne by the tenant. For each overdue rental day, the landlord may request double the rental price per day. The tenant is responsible in case of delay. For every hour of exceeding the rental period (maximum 12 hours), the tenant is required to pay 2% of the corresponding weekly rate lease. 9. RESPONSIBILITIES OF THE LESSEE AND THE LESSOR: In the event of a breach of a contractual obligation, the lessee is liable compensate the landlord for all damages incurred. In case the chartered vessel causes damage to third parties due to misconduct or negligence, the tenant is released landlord of any responsibility. If the requirements of the tenant are not satisfied when returning the vessel, they have to settle in within 14 days of the end of the rental period. Landlord and the lessee confirms the details of the case in writing. 10. DEPOSIT: The deposit is paid at the landlord's headquarters in cash. Deposit returns to the lessee in full at the end of the lease period, if there is no damage to the vessel or its equipment even if there is none inventory loss. 11. FINAL PROVISIONS: Oral promises or agreements they take effect only if they are made in writing. All disputes will be settled amicably.
